DV 2023 AOS (Adjustment of Status) Only

If the delay you’re experiencing is AP related, the question isn’t about if it is too late to switch to CP or not, the same prolonged AP will still be applicable for CP. And that would even be worse as a matter of fact, as it would have resulted in your being stuck outside the US following the interview until the AP clears.

If the congressional inquiry you initiated came back on the 15th indicating your case will be adjudicated within 30 days, then you basically need to wait for the 30 day clock to wind down, and if there’s no update at the end of the 30 days, you update your congress person’s office and request another case follow up assistance.
Literally, nothing. I mean I am 21 and I have been here since I am 15. I have been in and out without any problems. I never encountered any issues. I have never had a single criminal record. Should I go ahead and initiate something to find out whether I am under AP or TAL?

It would be an extra burden to do consular processing. But since I am desperate I will do anything to make this journey possible.

I understand you’ve been in and out of the US several times in the past with no issue. The scrutiny accorded potential immigrants is of a completely different level compared to non immigrants. And like I posted earlier, even if doing CP wouldn’t have been an extra burden for you from the get go, if the delay you’re currently experiencing is AP related, the same AP would have been applicable if you had gone through CP and you would have been stuck outside the US until it clears, you wouldn’t even have been able to return on your NIV in that case as a matter of fact.

The truth is your Senator has no special magic for moving cases along, they can only inquire about the case status just like your House of Rep person already did. The purpose of a congressional inquiry is to help move along cases that might have been overlooked or stuck on an IO’s drawer for one reason or the other. No senator or house of rep can force USCIS to approve a case they’re not ready to approve. My recommendation, stick with what is currently working.

FOLLOW UP UPDATE TO THE MEDICAL REPORT

USCIS has updated the I-693. Effective May 31st, only the new 03/09/23 edition of the I-693 will be accepted. The 07/19/22 will continue to be accepted until then.
 
Add your information to the Timeline spreadsheet, doing so can shed more light into what may be going on with your case. We will be able to tell if others who filed around the same time as you already received their NOA or not.

@Sm1smom I received an email from KCC last week with my DV fee payment receipt. The weird part is that I already received that exact same email in february 12th. I responded to the KCC email to understand what I should do with this new email since I am currently 2 weeks post-biometrics & waiting for the next step (you alluded that I am very likely to get called up for an interview). Still no update on my online case status and it's still showing "Case updated to show fingerprints were taken". I imagine this may be a sign that there was communication between KCC/USCIS on my case?
 
I'm not really sure about what's going on at the St. Louis field office, but it seems none of us have bypassed the biometrics stage (checking from the timeline of 2023). I did my biometrics 31 days ago. I called the USCIS to check up on my status, and they mentioned it's still under review.
My question is:
1. After how many more days can I contact USCIS again or take action?
2. Can I apply for my OPT while my case is pending?

Don’t read any meaning into that email, I wouldn’t treat it as an indication of some sort of communication between KCC and USCIS - KCC is not known to willingly indicate when they’ve received the KCC file request from the USCIS. You’re not likely to see any further updates on your case status until after the application as been adjudicated - this is covered on the AOS Process Spreadsheet. I’m guessing someone wrongly assumed that email from KCC was not previously sent to you, hence it got sent again.

Interestingly or should I say strangely, a quick look through the past 4 years or so of previous Timeline spreadsheets shows no update for St. Louis, MO; making it hard for me to get a read on that FO. However, seeing as your package was delivered late January and you completed your bio precisely one month ago, I think waiting one more week or so wouldn’t hurt. If no interview notice or waiver shows up after that, then it wouldn’t hurt to initiate a congressional case inquiry assistance at that point.
 
DHS proposed a high increase in the fees to USCIS in the 1st week of January. Since the 60-day comment on proposed fees is over,
1. is there any set date by which this new rule comes into effect?
2. how much is the proposed fee for the AOS package? Is it $2820 from $1225? (increase by 130%)?
 
Hi Sm1smom, I have a follow up question regarding the AP. I am in the same field office as @Hamo , and have been subject to the SAO when I visited my home country in the summer. The SAO was given due to my area of graduate study Genetics and Genomics . It is even indicated in the visa stamp that security clearance obtained on date July 12, 2022. However, I have read previously the security clearance is valid for a year . I got the clearance when I applied to return to the US in July last year. So it would still be valid until July 2023. In addition to not having the Dv receipt attached, do you think my delay could also be AP related ?

P.S I already reached out to the congress man' office ( after our last discussion ) in my district and they said they have contacted USCIS and will let me know when they say.

@George99x Hey! Sorry to hear about your delay. Who is your congressman? Keep me in the loop and let me know if your have any progress on the case.

I prefer to adopt a wait and see approach for an official announcement as against speculating or trying to predict what happens next.

Yes, the delay could be AP related. Unfortunately, USCIS will be conducting their own background check on you afresh, they will not be relying on the clearance you obtained leading to your NIV approval.

It all depends on the reason for the flagging in the first place. It varies for individuals. Some APs could clear within a couple of days/weeks, while some could take several months to clear.
