DV 2023 AOS (Adjustment of Status) Only

Hi Brit,
I have TPS status and F1 as well, should I answer yes or no on question 23: have you EVER applied for any kind of relief or protection from removal,exlussion or deportation?
I have never done it .Thank you
Answer NO if you’ve never sought protection from removal, exclusion, or deportation.
 
USCIS had removed the requirement that civil surgeons must sign Form I-693 no more than 60 days up until March 31. Have they extended this provision now? or have they ended this?

They have permanently removed the 60 day signature requirement (not able to post the link or full wording here but you can look it up) :

Yes, the 60-Day CS signature rule is no longer been enforced.

"Due to the COVID-19 pandemic and ongoing related processing delays, USCIS has experienced delays in all aspects of operations. Applicants have also experienced difficulties beyond their control, including delays with completing the immigration medical examination. In response, USCIS has temporarily waived the requirement that the civil surgeon sign Form I-693 no more than 60 days before the applicant files the underlying application since December 9, 2021.

USCIS is now removing this requirement permanently. Applicants, civil surgeons, USCIS officers, federal partners, and other stakeholders have consistently expressed concern that this requirement is confusing and necessitates Requests for Evidence (RFEs) to be issued for otherwise valid Forms I693. While the 60-day rule was intended to enhance operational efficiency and reduce the need to request updated Forms I-693 from applicants, in practice these efficiencies have not been realized"

After more than 4 months of waiting, I initiated a congressional inquiry with a phone call on the 7th of March. Congressman's office told me that USCIS responded on the 15th of March saying that the case will be adjudicated in 30 days. April 1st, my case is still stuck at fingerprints were taken. I do not have any Faith that they will look into my case anymore. I am tired of checking my case status 8 times a day and searching all over the internet about timelines. Hopeless at this point.

That is a physical address if sending by courier. If the FedEx office you visited can’t figure that out maybe you should visit another FedEx office or consider using UPS.

Which country are you chargeable to?

Considering another applicant from the same FO as you, who filed in January (couple of months after you) already got approved without an interview, my guess is you may be stuck in AP - which may be due to places you’ve visited in the past or your line of study/work experience being TAL related. Take a look at this Penn State material which can help shed a bit more light on prolonged AP and TAL related courses.

Thank you, Mom! I took a look at these materials. But the thing is that I have never been to any of those countries. I have been sponsored by the US Department of State many times for different programs. I finished high school in the US and continued my bachelors here the US as well. I am not saying I cannot be subject to any of those but there is none that I am aware of.

What would you suggest me to do? Should I take it to Consular Processing? Would that be too late? I am really confused and desperate.

If the delay you’re experiencing is AP related, the question isn’t about if it is too late to switch to CP or not, the same prolonged AP will still be applicable for CP. And that would even be worse as a matter of fact, as it would have resulted in your being stuck outside the US following the interview until the AP clears.

If the congressional inquiry you initiated came back on the 15th indicating your case will be adjudicated within 30 days, then you basically need to wait for the 30 day clock to wind down, and if there’s no update at the end of the 30 days, you update your congress person’s office and request another case follow up assistance.
