DV 2023 AOS (Adjustment of Status) Only

I got my receipts on mArch 1st. I sent my package the February 9th , and included early filling memo, since my numbers were current in march
Glad to know your package got accepted before the expiration of your I-94. Thanks for keeping the forum updated. You should consider adding your updates to the Timeline spreadsheet though for easier monitoring and comparison to similar case(s).

Do we really need give evidence that I included my kids and husband in application for DV lottery? Should we have screenshots our application? Because I didn’t see it before. Thank you so much!

Don’t stress this if you do not have a copy of your submitted electronic entry to include with your AOS package. KCC will provide that information with your KCC file when it gets sent to your FO.

1. Filed at lockbox on 10/31/2022
2. Biometrics 12/06/2022

When I contacted a live agent, they said that my case has been in the Kansas City field office since 11/18/2022. It has almost been 4 months that it is stuck at the field office. My case status is still "fingerprints were taken". I also requested expedite which was denied saying that the case is being processed at normal processing time. I am not getting any interview notices or any updates at all. What should I do? Should I keep waiting or take an action and call the congressman?

Yeah, you should go ahead and initiate a congressional follow up assistance now.

When I call them, how should I approach them? How do I explain that 4 months might not be a long time for other cases but a DV case is very time sensitive? I would appreciate it if you could briefly explain what I should explain to them. Thank you so much in advance!

You’ll tell them exactly what you just did above ^^ - DV based AOS is time limited, it does not follow the typical AOS processing, you’ve not received any update about your case since bio completion. So you need their help with following up on your case to obtain updates as to what could be causing the delay.

Hi @Sm1smom, I am in need of some information.
My wife and I are in the AOS process of being selectees of DV2023. We are both on H1B visas (needing a stamp renewal on our passports). We have an emergency (loss of a family member) and will be on a flight today to go to our families. At the moment of filing AOS she was still under J1 visa, my questions are the following:

1. what are our options in such a short period of time?
2. Does any of us needs AP to re-enter the country?
3. Would it be anyway to communicate to USCIS that our leaving is because emergency and not because we are not interested anymore in the AOS?
4. In case any of us need AP, can we apply from our country or can we apply at the board check when re-entering the country?

Hello, can I confirm my I-485 without send a dv payment receipt , I made a payment for dv lottery but I didn’t receive the receipt yet , i have fears to take a process a long time to get a interview appointment,bc there is deadline for dv lottery

I’m sorry for your loss. If your wife submitted her AOS application and it was subsequently accepted while she was still in J1 status, I don’t think she will be considered as H1B now - my understanding is she immediately fell into the AOS pending status upon the expiration of her J1 (even if H1B was subsequently approved), therefore upon departure from the US, her AOS application could be considered abandoned in such a case.

1. I don’t see an issue in your case, I’m assuming you were already in H1B prior to AOS filing. I have my doubts about your wife’s. Based on these, I think you both can determine what your options are.
2. I think having an approved AP on hand prior to departure would be advantageous to your wife.
3. Even if there’s a way to communicate the reason behind your sudden departure, it wouldn’t help. They will tell you that is why the option to apply for the AP exists.
4. The AP must be applied for and approved prior to departure. Unfortunately today is Sunday, USCIS offices are not open. If you can delay your travel plans till tomorrow, you could try a walk-in attempt at your FO to obtain an emergency AP.

Correct, I was already on H1B when filed AOS. Since my wife is dependent and I am the principal applicant. In case her case will be considered abandoned, will my case be considered abandoned as well? I am asking because I am the principal applicant while she is dependent.

Since you are the main selectee, hence principal applicant, your case will not be impacted by your wife's.

One thing I forgot to point out in my previous response: make sure you take into consideration how long it takes to get a new visa, since you will need a new visa stamp yourself before you can return to the US. With your AOS application already pending for a while, be aware your IL could show up any time soon. So be sure you will be able to return in a timely manner to attend your interview.

Since I have already listed in appropriate section - employer names , schools and universities . Do I need to list them again in this section?

Hi Mom, I looked at at this and taking it as ref to fill up, I have listed my academic orginizations (college/schools) but not sure if I need to list my employer as well.
