DV 2023 AOS (Adjustment of Status) Only

Hi MOM,
I would like your advice on this.
It has now been 110 days since I gave my biometrics and have not heard anything yet.
I did a congressional inquiry as suggested and they were very helpful. On June 21st, the congress office emailed me and said that my case is pending review at the Brooklyn Field Office and was informed that my application is in queue and has not been overlooked and will keep me posted if any updates become available.
I have called USCSIS almost every other week and two officers mentioned that my case is processing as usual and I have to wait till i am called for an interview. They said that if I did not hear anything from them before August 28th, to inform them and then they can raise a ticket.

I am not sure if I should just wait or follow it up back and forth.

Your advice will be much appreciated as always.
Thank you!
Hi,

My field office is Brooklyn FO too, I gave my fingerprints and bio two months ago, so far every time I talked with live agent or Tier-2 they told me my case is pending and it is within their current processing time. Were you able to get a different response?

By mentioning "I haven't received any response back", I meant the congressman is yet to get back with a response from USCIS. Congressman said USCIS has not replied them yet.
I asked 2 questions, you only answered one. Anyway, it also takes a while for USCIS to get back with a response to the congressional inquiry, just like it often takes a while to get a Tier 2 call back.

I have not yet received any update on my case since biometrics and finger prints taken which was on April 10th.
based on a recent congress inquiry response which was more indicative of a potential interview waive, should I still expect to get an RFE for medical docs within the next month?
And in case I get an RFE how soon would they get back to me?
Thank you.
Have you received your IL or RFE for your medical report? Any update on your case?

Congratulations again and thanks for the additional updates. Kindly update the Timeline spreadsheet with your interview and CPO dates, they’re much more useful there for future AOSers.

I do not understand what you mean by the supervisor asked you to do it “by enrollment” - do you mean he asked you to make the DV administrative fee payments for the rest of your family and return to show him the proof of payment?

Also can you explain what you mean by you’ll be applying for your family as soon as you receive your GC - precisely how will you be doing this, as FTJ or through family sponsorship?
Hello mom, I can't update my data on the timeline, can you please give me access?
I want to do FTJ now, is it feasible to do it now? Or do I have to file a petition with the I-130? I'm a little confused right now

You need to send an access request through the spreadsheet.
You also need to answer the first question I asked in my previous post before I can determine if you're still able to process FTJ.

The supervisor asked me this process is for 4 people and why didn't you make the payment for everyone? I replied that I don't have enough money at the moment but I intend to apply as soon as I receive my GC and start working. He told me to explain this in writing, so I wrote a letter explaining that my family is in my country and I didn't pay them because I didn't have enough money at the time, I put their names and their ages.

Okay, with that explanation, I think you missed the opportunity to initiate a FTJ with the supervisor's help. You should have explained your family was back in your home country and was not eligible to process AOS with you but would be processing FTJ and that you need USCIS to send your case file to the embassy with jurisdiction over your family's location. Without the case file being sent to the embassy, you cannot do a FTJ.
Right now, you do not have enough time to file an I-824 to get your AOS file sent to the embassy before the FY ends.

It seems to me your only option at this point is a family petition which will take about 1 to 2 years before your family can join you in the US. Unless the supervisor understood (based on your response) you wanted to do FJT for your family and has sent over your AOS case file to the embassy accordingly, in which case the embassy will schedule and invite your family for an interview before the end of the FY.

Today, our case status has been changed to New Card Is Being Produced. Special thanks to mom and all the forum members. Your guidance and provided information were invaluable throughout the whole process. For all other forum members who are waiting for their decision, all the best and good luck!! Don't lose hope.

Congratulations! Today (the next day) our Providence cases have changed to "New Card Is Being Produced" as well in my.uscis.gov.
Thanks everyone and particularly the main moderator for the invaluable information on the application process!

Hi Mom. I had a call with a Tier 2 explaining the DV situation and he created an expedit request ticket for the field office. Now the field office has emailed me the following message:

"Thank you for contacting USCIS concerning the above-referenced application. Below is a summary of what we have found.

Your case is under active review by an immigration officer. You should be receiving a decision or notice of further action at the address of record shortly. Also, we will need additional information and/or documents in order to consider the expedite request. If you have not received a decision or notice of further action within 60-days of this response, please feel free to submit a new inquiry by calling the USCIS Contact Center.

Please send documentation to support your expedite request to our office at the address below.

I hope this information was helpful to you."

Besides the DV deadline, I have some family reasons for the expedite requests. But I am not sure if they are enough or how to put them together. Can I send a private message to you, please?

Good to hear that. Congratulations!!!

Hi @Vega2000, i have got the same respond. When did you file? Have you had any luck so far?

Hi, I am going through the same as you. What was your field office? Did you ever visit your field office while waiting?
Hello guys, I hope someone who is still worried reads this (please read my earlier posts as well). After ~8 months I just received my green card today (I have updated my timeline). Here are some highlights:
- My CN is ~AF18xxx and my visa number became available in January, and gave my biometrics in March.
Ever since then, there have been no updates. I did everything I could (wrote my senator, emailed KCC, service centers, info pass, and wrote letters directly to USCIS) but nothing. According to the timeline, people with similar F1 visas and CN >AF50xxx already got their GC before me so I was worried. Even @Sm1smom was worried as my case was peculiar. But to my surprise, USCIS all of a sudden approved my case and I got my GC. I can't thank this community enough for their guidance, Simon, Sm1smom, and of course Lord Jesus.

- If anyone is worried the deadline is approaching, do your best to complete everything you can, and follow the advice given here, which is what I did. It is not over till it is over. You got this guys

Hi, I am going through the same as you. What was your field office? Did you ever visit your field office while waiting?
My FO is Oklahoma City. I didn't visit my FO, what I believe worked best was the congressional inquiry. After a ~ 2 weeks of waiting, my senator emailed me a response from USCIS that said "My case is being actively reviewed by an immigration officer, and they will contact me after a decision is made,...". This was in late July, and on August 16, my case was approved.

Thank you! I received Ssn some time ago through work and travel and it says on it “dhs aurhorization”. Do I need to renew my ssn or this one is still good. I know it’s not exactly about DV lottery but I don’t know if I need to change it. Thanks for any info!

Go to the appointment fully prepared for the possibility of having an interview on the spot. In terms of how to talk about your case, I think you already have an idea of what to do based on how you succeeded in getting a Tier 2 agent to schedule an INFOPASS appointment for you. If you do get the opportunity to speak with the IO in charge of your case, you can request to know if your background check has cleared, and if your KCC file has been received. If they positively to both questions, ask to know what could be responsible for the delay you’re experiencing.
Hi @Annpa, can you please tell me how you got in touch with a Tier 2 agent?

Hi @Annpa, can you please tell me how you got in touch with a Tier 2 agent?
Hi @vojinee09,
When I called them, i told them about I have been waiting for update on my case since April and other applicants who filed after me already got approved. I also told them fiscal year is approaching and I am really scared that my case will be adjusted before sept 30 and asked to connect to tier 2 officer.

Hello everyone! My journey has come to an end, my card is being produced and case was approved! I would like to thank @Sm1smom for all the answers, @Britsimon for leading me through very beginnings on YT. Thanks to everyone for any help and info! Wish you all who are waiting the best!! Don't give up on waiting for your turn!
@Sm1smom as an International student, do I need to inform school about any specific details about my adjustment or just letting them know that I am permanent citizen will be enough?

Thanks again!!
many congratulations!
did they ask you anything about your F1 status and your immigration intention?
