DV 2023 AOS (Adjustment of Status) Only

Hi Mom, so I had my interview yesterday. The lady was very sweet. And the interview was so quick!!! She basically just confirmed details from I-485 and asked to see my birth certificate and Bachelors degree. Then she said she would do a security check and update my file online. I checked my case status online 15 minutes later and it said card is being produced. I have checked the status multiple times since then as it just doesnt seem real lol. I'll believe it when I have a physical copy of the card in the mail hahaha.

I have a question about my husbands case which was initially rejected for forgetting to sign the application form. His money order was cashed last Thursday 24th August. Do you think his case will happen before September 30th? Especially now since mine was approved? Is he allowed to drop out as an international student yet? He will continue his study but doesnt want to be in the 11 week program that is specifically for international students and charged at a way higher rate than for residents. Fall semester started yesterday and he has one week to un-enrol before he is charged. They dont offer any sort of refund of course for international students. What do you advise?
Congratulations and thanks for the update. Did you inform the IO about your husband's case?

I wouldn't recommend your husband intentionally fall out of status at this point. Yes, I understand the associated cost of remaining in F1 status at this point with the potential of becoming a LPR shortly after the un-enrolment window closes is quite a lot. Your approval does not automatically guarantee his approval, so if he falls out of status now and his AOS application ends up not being approved before the end of the FY, you do realize he will need to depart from the US as a result? You will not be able to sponsor him while he is OOS as the OOS is not forgiven/overlooked for the non-USC spouses.
 
I just received my card in the mail. I greatly appreciate you @Sm1smom and every other persons that updates the cases on the spreadsheet. It helps a lot to know you aren’t alone with your issues. I have duly updated my case on the spreadsheet. I wish everyone the best as they continue to await good news. Nashville field office put me through a long wait but they finally came through.

TODAY, I am thrilled to share that I've finally received my GREEN CARD in the mail after 200 days from filing.

After INTERVIEW I have to wait for almost 2 months, facing uncertainty with each passing moment. I engaged in multiple congress inquiries. I also sent an unsolicited mail to USCIS, and I followed up with multiple second-tier inquiries with USCIS but I believe in my case the Congress inquiry played a crucial role in expediting my case decision.

But with my card in hand today, I'm certain that the journey was worthwhile. To those who are still waiting, I'm sending my best wishes and hope your cards will arrive soon.

I want to express my gratitude to our Super Moderator Sm1smom in this forum for immense support, guidance and expertise in the immigration journey.

Another great update. Congratulations.

You just need to inform your school you’re now a LPR, no details of how you obtained it required. I believe they’ll need a copy of your GC in support of the claimed status, so I’ll recommend waiting until you receive the actual GC before informing them.
 
I wanted to share my interview experience, which was last week in the San Jose field office. My interview was long, it took around 35 minutes. The IO was a very sweet and kind lady. She went through my I-485 and asked me almost every question and information from that form. She also asked to see the original California ID and my EAD cards. After that, she asked if I have done military service back in my country or not, and asked for the related original documents. Then, she told me she has my paychecks until the date I submitted my package, so I gave her the more recent paychecks as well. I also gave her a more recent verification of employment letter from my company which included my job title and my base salary. After that, she told me since I am a male applicant from a specific country I need to answer some extra questions, which were some yes/no questions related to the government in my home country.

Even though I received the approval notice yesterday, I am waiting to receive the physical card before celebrating and considering it official.

@Sm1smom hi mom good morning! To my surprise I received the text this morning from uscis with receipt number that my application was accepted. The case status shows finger print fee was received and national benefits is working. Hopefully I will get my bio waived. Do you think its a good time to reach to senator and ask them to request uscis to expedite my case as FY is approaching?

Good night Mom, my case does not seem to follow normal procedures. I had lost biometrics in the month of June, that is, USCIS scheduled my biometrics for June 9th but I only received this NOW on July 5th, I lost my biometrics so I went to my FO they said I had to call to schedule another biometrics, I made so many calls I went to the senators and finally they scheduled the biometry for the 3rd of August but on the 17th of July the FO girl called me I went there and I just did the biometry before the scheduled day. I waited for a month for the interview, no letter came to me, desperately I started calling the USCIS every day but without success, only on Friday the 18th I managed to speak with a level 2 officer, I explained that my process was in the final stretch and She understood me very well, she gave me a case number and if she said that within a month I would receive a call from the USCIS, I was more stressed one month, at least in the second half of September. On Monday, August 21, I received a call from my FO, it was the supervisor himself, he said your case is for 4 people and because you only paid for one person and told me to go there, I got there, he received me very well, we started talking, I explained that I am a student, I didn't have enough money to apply for my family who are outside the US, he said to do it by enrollment. and we sat there for about 15 minutes talking about me. he asked me without fail the next day to take the letter to him and I did as he asked the next day very early I took the letter. in my mind that basic conversation was already my interview. I waited a week and nothing was updated on my status. Today, the 29th, I received an email from the congressmen saying that my status had already been updated to a new card in production. I am very happy I thank God, I thank Mom who has helped us unconditionally, may God bless you a lot. I am now waiting for my Green Card. About my family, I had not done any more FTJ with form I-824. Now that I'm going to receive my GC, I'm going to apply for them as soon as I receive it, I want them to be here with me by the end of the year or the beginning of 2024. thank you very much

Yes, the bio appointment will most likely get waived. You can try that if you like, it wouldn’t hurt at this point.

Again, it would be helpful if you could add your case updates (both attempts) to the Timeline spreadsheet. That will be your way of giving back to the forum (without just consuming) just so you know.

Congratulations again and thanks for the additional updates. Kindly update the Timeline spreadsheet with your interview and CPO dates, they’re much more useful there for future AOSers.

I do not understand what you mean by the supervisor asked you to do it “by enrollment” - do you mean he asked you to make the DV administrative fee payments for the rest of your family and return to show him the proof of payment?

Also can you explain what you mean by you’ll be applying for your family as soon as you receive your GC - precisely how will you be doing this, as FTJ or through family sponsorship?

This is super awesome! Congratulations!! I'm truly happy to learn you managed to pull through as yours was indeed a complicated case.

Yeah, the lost medical report isn't surprising due to the case being sent back to the NBC in order for it to get forwarded to the New York FO. My guess is the LA FO received the medical report after they had already sent back your AOS file to the NBC and couldn't be bothered to forward the requested updated medical report upon receipt. All is well that ends well like they say, I suppose. So you can put all that behind you and enjoy your new status :).

Just make sure you do your research and ask pertinent questions when the time comes to file for citizenship (should you decide to become a USC) before you actually file :D

When did you initiate the congressional inquiry?
When you say you haven't received any response back from them yet, do you mean to say they are yet to acknowledge receipt of your congressional case assistance, or they're yet to get back with a response from USCIS?

Tier 2 call backs can take a while.

Nothing else you can do at the moment, except continuing to remain patient. Alternatively, you can pay an unscheduled visit to your FO and hope the security guards will admit you into the building to plead your case in person after explaining your situation to them.

By mentioning "I haven't received any response back", I meant the congressman is yet to get back with a response from USCIS. Congressman said USCIS has not replied them yet.
