DV 2023 AOS (Adjustment of Status) Only

I wrote to USCIS live chat today about the status of my case. Has anyone had a similar response and a result before?
Response: 'I do see you have a pending expedite request on your case, this request should assist you in receiving further information and if possible speeding the case processing along with receiving a sooner interview date. '

Hi,

My field office is Brooklyn FO too, I gave my fingerprints and bio two months ago, so far every time I talked with live agent or Tier-2 they told me my case is pending and it is within their current processing time. Were you able to get a different response?
I have had the same response from them too. Still no luck.

When I tried to expedite, they asked me which options to select.

"We may consider an expedite request if it meets one or more of the following criteria or circumstances:"
1. Severe financial loss to a company or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure to:
  • Timely file the benefit request, or
  • Timely respond to any requests for additional evidence;
2. Emergencies and urgent humanitarian reasons;
3. Nonprofit organization (as designated by the Internal Revenue Service) whose request is in furtherance of the cultural or social interests of the United States;
4. U.S. government interests (such cases identified as urgent by federal agencies such as the U.S. Department of Defense, U.S. Department of Labor, National Labor Relations Board, Equal Opportunity Commission, U.S. Department of Justice, U.S. Department of State, U.S. Department of Homeland Security, or other public safety or national security interests);

5. Clear USCIS error.

I tried getting infopass, but neither I got it from emma nor after calling USCIS for infopass appointment.

So what’s your question?
 
Which one should we choose for expediting the process, which one of the reasons aligns to the circumstance that fiscal year is going to end and also the visa cap?
None of them is applicable. I’m aware of those official expedite criteria. I did not recommend initiating an expedite request yesterday when you asked me if there was anything else you could do because I already know non of them is applicable to your case. In general, DV based cases are already expedited compared to all other AOS cases.

Good luck for your interview. Nope I didn't get approved there. They said since my case is at Vermont service center, they can't give me any approval until the service center approves it. So I left empty-handed.

Do you mind sharing what you actually told the IO that attended to you?

When I walked in, I talked with front desk. I told them I am Diversity visa winner and told them I applied for adjustment in April. My bio was waived on April 7 and I have no update since then. I gave them i797 notices of me and my wife and other documents as well. He told he will look into the documents and give approval notice. After one hour of waiting outside, he came back and said he cannot give approval since the case is not here in field office. They should get an approval from vermont center to issue me a greencard. I told them if there is any way they can contact service center but the supervisor said vermont center does not give any information and I have to wait for decision from them.

Thanks for the update. Did you ask if they know why your case was sent to the Vermont SC as against the Dallas FO which it ought to have been sent to?
 
Yes they told that they have my uvisa case pending in the service center. So they sent it there. Thats the response I got.
 
Hmmn! Your AOS file should not have been sent to the Vermont SC in that case, it's adjudication is not pending the UVisa approval since you have a currently valid status. I think USCIS messed up on this. I suggest you initiate an Ombudsman Case Assistance Request at this point.
 
Hello Sm1smom,
I chatted with an agent via Emma just a moment ago. He said that my case was sent to National Benefit Center from Memphis Field office. When I asked why is that? He said "This is the way cases are handled. They change the office frequently".
Is this the bad signal? Any suggestions at this point of time? Is this something Annpa was talking about?
