DV 2023 AOS (Adjustment of Status) Only

Hi, I requested for inquiry through a congresswoman, it's been almost 20 days since they sent it and haven't heard back yet. I submitted i485 in February and had the biometric appointment in April. Is there anything I can do right now to expedite the process.? maybe through a lawyer?
 
No, completing the interview does not secure a visa for you. The case status is also not unusual. Did you confirm from the IO at the end of your interview if your background check had cleared? That is one of things that could delay the approval, regardless of what the IO says at the end of the interview. Just be patient for now. Meanwhile, it would be nice if you could also add your case data to the Timeline spreadsheet.

1. At what point is the GC guaranteed to you, if not after the interview? Is it when you physically have the card? Or when online status gets updated to ‘card being produced’? If the IO says you’ve been approved, do they allocate your GC immediately?

2. If the embassies schedule interviews in September, I gather they think they can get interviews and approvals done by end of fiscal year?

3. Have you heard of cases reaching interview stage and being told they’re approved, and then no GC being available?

Check in with your congressman’s office to see if there’s been any update from your FO. You can also initiate an ombudsman’s inquiry at this point - no guarantee it will move the needle considering I told you not quite 4 weeks ago that your FO is one of those that tends to bundle DV cases towards the end of the FY.

1. Visas do not get allocated or reserved based on verbal approval. When the online status shows CPO, it means the IO was able to confirm visa availability following visa request submission in IVAMSWEB and has been successfully assigned to the case.

2. Embassies do not schedule interviews, KCC schedules DV interviews for the embassies. Please note, this is the AOS thread, let’s keep CP related questions off the AOS thread so as not to confuse other folks going through the thread.

3. This is not a straightforward question - I don’t know if you’re asking about AOS or CP cases. Plus the verbal approval means nothing anyways, be it for AOS or CP.
 
For anyone worrying about available visas running out, YouTube channel BritSimon had a live video on July 15, called "DV Lottery | Live Q&A July 15 2023" and as part of the vide he analyzed the number of visas for DV2023. I recommend watching it on his channel (the Live section).
 
My suggestion is to truthfully fill out the form. If you have no ongoing income, put zero there (a stipend is not an income). Don’t try to pad things up. You have no listed job to attach the mere income to.

INA SECTION 212(a) (4). what would be the correct answer for this?
I have read the sample form and in that, they marked ''yes''
but I quite dont understand this question correctly and do not know what to write.

The correct answer is what is listed on the sample I-485 which you already saw. You can search this thread for the explanation as to why which I’ve provided a couple of times in the past.

1)One last question, as for form i 693, I have to only send my sealed envelop and that is it? ant other supplemental document is not needed. Am I correct?
2) as for the city of last arrival, should i write the place of my connection flight or or my final destination where I started to live after landing?

1. It is not unusual for the agents to state anything they feel may one wants to hear, as long as it enables them to quickly round up and end a call/chat.
2. A quick review of the the 2022 and 2021 Timeline spreadsheets shows applicants from your FO did not have to wait as long as you have. The good news is it shows your FO is familiar with DV based AOS applications and the need to expeditiously process them. The long wait you're experiencing may be due to pending background check clearance , hence the yet to be scheduled interview. If that were to be the case, there's really nothing else you can do except "patiently wait", keep your fingers crossed and hope for the best.

Had my interview scheduled last week for today (104 days since bio) and completed it this morning. Case updated to show “New Card is being Produced” after a couple of hours.

General questions about the I-485 form were asked; passport, birth certificate and drivers licensed were requested during the interview. After about 20 minutes officer congratulated me.

I just wanted to share my recent experience at my interview. It took place about an hour ago. During the interview, the officer asked me a series of yes or no questions, and that was pretty much it. On the immigration website, it now shows that my "new card is being produced," which is great news. The officer also requested my official medical exam results, passport, and driver's license. She was incredibly respectful and kind throughout the process. Towards the end, she mentioned that she understands the fiscal year is almost over, and she updated my status from "interview was scheduled" to "new card is being produced." I'm really grateful for the support of this forum, and I sincerely hope everyone here receives their green card soon.

On a personal note, in two years, I'm planning to attend law school to become an immigration attorney, and this was my first experience with an immigration case. I stand in solidarity with all immigrants, and I want everyone to feel safe and welcome here. Please don't lose hope.

P.S. I was wondering if I could request permission to access the timeline sheet so that I can fill out my case's information accordingly. Thank you!
 
1. No need for a new medical report. Just address the noted issue and send everything back as is.
2. Send it back.
3. Is there no indication of where to send the package on the paper you’re supposed to place on top of the package for when you send it back? If there isn’t, I would send it to Dallas.
4. Yes, they’ll know and eventually process both together - although you’re likely to receive your bio appointment notice before he does.

No there wasn't an address. Just that the green slip should be placed on top of the new package. The I-797C seems to have come from Dallas.
So I guess I'll send it back there. Does that mean Dallas will be processing or will they eventually still send the paperwork to Chicago?

Question: what do you mean by official medical exam ?
Isn’t that the sealed envelop that we are sending with our package?

1. Just the sealed envelope containing the medical report.
2. The place where you went through CBP process.

Here is the paperwork that was received.
So send back the package to the Dallas Lockbox. They sent you the rejected package and issued the I-797C.

p.s. I deleted the I-797C from your post has it contains personal information. Be careful with posting personal information in a public forum.
