DV 2023 AOS (Adjustment of Status) Only

1. Visas do not get allocated or reserved based on verbal approval. When the online status shows CPO, it means the IO was able to confirm visa availability following visa request submission in IVAMSWEB and has been successfully assigned to the case.

2. Embassies do not schedule interviews, KCC schedules DV interviews for the embassies. Please note, this is the AOS thread, let’s keep CP related questions off the AOS thread so as not to confuse other folks going through the thread.

3. This is not a straightforward question - I don’t know if you’re asking about AOS or CP cases. Plus the verbal approval means nothing anyways, be it for AOS or CP.

Could someone please confirm the information one is write on the I-485 check,
I read this on the USCIS website
"write the form you are filing and your A-Number or other applicable identification on the check or money order."
if one writes the form number in the subject line of the check, in the absence of an A-number should the applicant write the DV Selectee number on the check?

I just wondering about NOA of the interview ( i did my bio on june21 in Jacksonville ) and still until now didn't received anything or updates to my case . Should i wait till 21st july then call the ASC ..
also if its interview waiver how i will know ><
because in the bio NOA was June 2nd but i received the letter by june 11th .. and my appointment was at june 21st
thats why i wondering if there something missed on usps mail

1. Just be patient for now, looks like your case is on track with your FO processing timeline. ASC does not send out the IL - they have nothing to do with the interview scheduling as a matter of fact, and there's no number for contacting the ASC directly anyways.
2. You will see the card production ordered update on your case status if your interview is being waived.

Be sure to register for Informed Delivery with USPS if you have not yet done so, this will give you a heads up on what may be coming your way. And if the mail ends up not being delivered (as in if it got lost before delivery), you know.

p.s. number your questions when you have more than one per post.

Question about i-485 , in item 61, one is given "yes" or "no" option for public charge and says if you answer "no" go to item 69. However item 66 and 67 asks about your educational and professional qualifications. Are they (item 66 and 67) to be left unfilled? Please advise .

If you are not subject to INA 212(a)(4), you answer NO to Item 61, then go to item 69 like the instruction says - no need to overthink anything in-between. However, you ARE subject to INA 212(a)(4), so you should be answering YES to item 61, and the following items from 62-68.
 
Patiently I waited…

Had my interview scheduled last week for today (104 days since bio) and completed it this morning. Case updated to show “New Card is being Produced” after a couple of hours.

General questions about the I-485 form were asked; passport, birth certificate and drivers licensed were requested during the interview. After about 20 minutes officer congratulated me.

my file number is 27K and I still haven't received the interview date. I have a lot of concerns about this issue, apart from that, I have a question I would like to ask you, and if you have any experience, I would like you to help me. I am in f1 status and my husband was f1 before, but later he lost his status and after that he applied to aslyum. What I am wondering is that I am the winner, but my husband also applied to dv2023 with me. Will they give my husband a green card too?

2-Has there been anyone before who got rejected only because USCIS did not follow up their case before the end of FY even if they had low case number?

He became out of status on March 1, 2021. He applied for aslyum on June 14, 2021. Afterwards, the work permits came immediately. Our application date to AOS is March 24, 2023.

1. What do you think my statement about “your FO is one of those that tends to bundle DV cases towards the end of the FY” was referencing?
2. There have been a few cases that got scheduled for their interview after the FY was over - those eventually got denied as they could not be approved once the FY was over.

So he was OOS for roughly 3 months before filing for asylum, the OOS may be hard to overcome in that case. But stranger things have been known to happen, there’s a possibility the IO may miss that detail and he ends up being approved with you.

Not true, the selectee is not the only one required to be in a valid status. All the derivatives processing AOS are also required to be in a valid status in order to be eligible to process AOS. The selectee’s situation is more important in the sense that they could be approved even if the derivative gets denied for being OOS.

No you do not need to contact KCC after filing out the DS260.
Go through the AOS Process Spreadsheet. Post subsequent questions (after going through the spreadsheet) on the DV2024 AOS thread.

Q 1: Do I notify the KCC that I want to switch from CP to AOS, early? Or inform them when I arrive in USA?
Q 2: What is the letter content for the transfer request to AOS?
Q 3: Does the request to switch to AOS need to EDIT anything in DS260?

I requested a call back from a Tier 2 officer, but USCIS sent me an email stating that "my application is still pending consideration". Does this mean that my background check has not been completed? Or has the background check been completed, and I am now waiting for a final decision? Has anyone else had a similar experience?

Since you're currently outside the US, I'm sorry I cannot provide you with any guidance at this point as entering the US with the preconceived intent of filing for AOS is frowned upon, plus I do not know the status in which you plan on entering the US. After you've successfully entered the US, and you make the decision to process AOS from, I will be happy to guide you through the process at that point.
