DV 2023 AOS (Adjustment of Status) Only

You are forced to return to the US in what status?
 
The government, probably with the best intention of issuing all the visas, have gone ahead and overscheduled DV2023. There are more people scheduled for interviews in July - September than the quota will (should) allow. So - that means people on 221g and AOS cases will be competing for visas from a very small pool which relies on refusals and no shows. It looks impossible to imagine we will NOT hit a wall on visa availability (unless they exceed the quota as they did in DV2022). So - for AOS cases still processing - no self inflicted delays or dillydallying!

This intention destroys our dreams as AOSers. We have no chance to learn that we will get gc or not even if we have scheduled interview. Its a little bit complicated situation for people who applied AOS. And also there will be a lot of rejected case if you are doing AOS or CP on September or late August because of this 55k quota. Last year a lot of AOSer did get their visa in last two months of FY. For this year there is low possiblity to happen this again. That is what it is unfortunately.

Okay, so you plan on returning to the US on a visitor's visa, the validity of your visa is irrelevant to the question I asked.

Anyway, like I stated earlier on, entering the US on a B1/B2 with a preconceived intent of filing for AOS is frowned upon, (regardless of the primary reason for coming to the US).

Thanks, will do it, I already requested access to it. Mom, it seems like the San Francisco FO didn't schedule any interview so far, even for people who applied in January/February. Do you think is possible for them (FO) to not schedule any interviews this year? I was looking at some past timelines (2020-2022) and they had some interviews scheduled along the year. I also read that some people from this FO already contacted a congressman. What can we do at this point mom?

For those filing AOS in the last two months of the fiscal year:

1. Are they processed in order of date received? Or processed in order of case number?
2. Are AOS cases processed by individual field offices or at a central USCIS location?

Everyone should have filed by now, and probably 2 or 3 months ago at the latest. Very few people have become current in the final VB.

I'll leave Mom to answer your questions.

Yeah, it's such a shame the San Francisco FO is yet to schedule any interview for DV based AOS applicants this year AFAIK. They will definitely schedule or decide to waive the interview (because they are familiar with DV based AOS applications and the deadline associated with them), we just hope it will not be too late by then.

If you personally have not yet contacted your congressman's office, you should do so at once. They more complaint they receive, the better the chance of their getting the FO to start scheduling interviews may be. You can also send an unsolicited letter by courier to the San Francisco FO Director, there's no guarantee the letter will get to the Director himself/herself, but it's worth a shot at this point considering visas may have ran out by the time they decide to start scheduling their interviews.

2. It depends on which step of the process.

I have to say it seems like you're straddling two worlds: AOS and CP and are subsequently not able to focus on what the AOS process entails. Please spend some quality time by going over the AOS Process Spreadsheet if you plan on processing AOS. The answers to most of your recent questions have already been addressed there. There are several tabs on that spreadsheet, going over each one carefully will greatly enhance your understanding of the DV based AOS process.

I’m confused.

Didn’t 850 OC cases just become current in the August and September visa bulletin? They would only be able to file as of mid July when the bulletin was released, right?

Or maybe I’m misunderstanding something??

So where are the AOS visas actually drawn from If the amount of scheduled CP interviews (which have visas reserved) already exceeds the global quota? If I were to have an interview tomorrow and be approved wouldn't it have to be drawn from that pre-allocated pool and therefore a scheduled CP applicant would miss out?
I know that's just the way it is but it's a bit ridiculous that AOSers are only assigned a visa after an interview were as CPers have a visa reserved. Why aren't AOSers reserved a visa once we receive our NOA? USCIS have just as much information - if not more - about AOS applicants as they do CP applicants. To top that off, some FOs batch process which basically makes the case number order irrelevant. Sorry to vent!

I have briefly reviewed the AOS spreadsheet but will definitely look back over it again. I am trying to learn both filing methods to determine what is the best route.

The reason for my line of questioning is in relation to the last lot of OC case numbers that were released for August/September. If the available number of visa's available are dwindling, I'm trying to ascertain/judge the likelihood that an AOS application would get approved in time.

There's nothing ridiculous in USCIS's inability to reserve to visas for DV based AOS applicants - USCIS cannot reserve visas for AOSers, same way the embassies cannot allocate or reserve visas for CPers. KCC has oversight of the DV program, they process the DS260 forms for CP cases, which enables them to schedule the interviews and allocate the visas. KCC does not process the DS260 forms for AOSers, and most AOSers' do not even submit the DS260 form in the first place.

Thank you very much Mom for the access and for your promptly reply. I already added my case to the timeline. I was looking at my congressman website and it says that they can help if our case is beyond normal processing time. 1. Can I still contact them even thought I received my NOA on June 30th? 2. Is there a template that someone send before as an unsolicited letter to a FO? Thank you very much Mom.
 
Hi @Sm1smom,

My AOS package was delivered on July 5. I included two Forms G-1145 - one for Form I-485 and one for Form I-765 - but have not yet received any e-notifications (I check my spam box every day) or NOA from USCIS. The strangest thing to me is that I asked my bank to check and the cashier's check has not yet been cashed.
Aside from exercise some patience, as you always remind us, is there anything I can do to find out what is going on (e.g. send an email or call)?

Hi Sm1smom,

I had an interview at NO, FO on July 06. Interview went well. IO officer only asked few questions and Yes/No questions from my form I-485. IO officer told everything is completed and background check too and final step was she just need to confirm with KCC in order to Approve the Case. Today it has been 14 days since my Interview I have not received any decision from visa officer regarding my case. What should I do at this moment.

Okay, so this is why I sometimes get snappy when responding to questions. If you had provided pertinent information such as when you filed or received your NOA, I wouldn’t have expended so much energy providing my previous response. I don’t expect your congressman’s office to be willing to follow up on your case considering it is actually less than a month. And no, I do not have a template for sending unsolicited letter to Tye FO.
