DV 2023 AOS (Adjustment of Status) Only

Hi Mom, my application was accepted and I also received the receipt number in my mail. After a week, I also received a biometric appointment letter. But in the meantime, I chatted with a live agent through Emma and requested them to send me the email of an appointment if possible but today I got an email that my older biometric appointment was canceled and they will send me the new biometric in my mailbox which I can also access from my USCIS account. I am asking if I can walk in for a biometric with my older appointment letter that I have just in case USCIS would take longer to send me the new appointment letter.
You can try, I don't know if the code on the appointment notice will still work or not.

I'm however wondering why on earth you requested they send you an email confirmation of an appointment which you already received by regular mail. What were you trying to accomplish with that request?

Right now, the 2NL is irrelevant, so stop following up on that. What you need to be following up on is actually your IL, because compared to two other cases from your FO (first one filed before you, the second one filed after you), your case seems quite beyond the applicable processing time for your FO. It is possible your background check clearance is still pending. In the interim, help me better understand your follow up efforts by answering the below questions:

1. Precisely what did you ask USCIS when you reached out to them regarding your case?
2. Also what did you request assistance with from your congressperson and precisely when did you contact them?
1. I asked emma for info pass and explained my case to a live-person how my case is tied to DV2023 and that the deadline was september 30, 2023 (I even used the words "2 months" to signify the situation) she looked into my receipt and told me my AOS is within normal processing time and that I should wait till september 27, 2024. I explained how I only have two months left and she said to call them back on september 30, 2023 (she was basically being passive aggressive by that point) so I said ok.
2. Based on the link provided in the spreadsheet, I looked up my local representative and filed a form (with a template text from here) which explained I am a dv 2023 winner, that I had sent all required documents and finger prints over 5 months ago and that I was approaching the deadline (template from AOS 2021 only, I changed the date and added some info) I also used formal writing and avoided abbreviation. Reiterated how the deadline was in 75 days. And a call to action at the end that I needed their help with my case and uscis. I also filed another form for a second congressman in my state (I got his email from a friend who was on asylum). The prior gave me a call a week ago saying they will file an inquiry, but to not expect too much as they cant force USCIS to make decisions.
I've seen others finish all their process in two max months after finger prints so I'm worried on why they arent updating my case after 5 months since my bio date

I asked them to email me because the appointment letter was taking longer to arrive in the mailbox. But unfortunately, a few days after the request I received it in my mailbox. Bad luck!

How many days did it take for the appointment letter to arrive in mailbox? I have been waiting since last 8 days. I am not sure what to do. Does it get updated in online case status if biometric is scheduled?

I’m guessing your background check clearance is still pending in that case, considering one of the two cases I mentioned earlier on filed after you and got approved without an interview. If that is case, there’s really nothing you can do to move your case along unfortunately. The background check clearance may be due to places you’ve been to in the past, or your area of study which may be within the TAL category.

You can initiate an ombudsman inquiry at this point if you like, I doubt if it will move the needle though. You can also keep checking with your congressman’s office every other week to see if there’s any update.

How did you conclude your bio notice was taking longer to arrive considering your payment was cashed about two weeks ago according to one of your previous posts? This is why I keep telling you folks to exercise some patience, give the process a chance to work. I guess the agent thought you were requesting a cancellation.

Anyway, I suggest you add your case data to the Timeline spreadsheet - this will at least allow you to do a real case comparison going forward.

No, it does not. Add your case data to the Timeline spreadsheet - this will give you better insight into how other cases (especially those in the same ASC and FO as you) have progressed.

Hi Mom! What could this status mean/lead to? It doesn't look like RFE. For the record, the previous status was "RFE sent" which I replied to.

No you do not need to contact KCC after filing out the DS260.
Go through the AOS Process Spreadsheet. Post subsequent questions (after going through the spreadsheet) on the DV2024 AOS thread.
 
This may be a dumb question, but do AOS cases on DV lottery also account for the 55,000 visas that are rewarded yearly? I always thought that those with AOS don't really count.

I just wondering about NOA of the interview ( i did my bio on june21 in Jacksonville ) and still until now didn't received anything or updates to my case . Should i wait till 21st july then call the ASC ..
also if its interview waiver how i will know ><

Hi Mom, I gave my interview on June 29. The VO was nice lady. she told, she still needs to request KCC files. And also mentioned she will do that the same day and every other things was good plus she was confident that I will receive my green card in two weeks. My case status was updated to 'Interview was completed and case must be review' same day. It has been two weeks. Does this secure my visa? Is there anything I can do at this point ? Should I reach out to congress? I am worried thinking 55000 visa limitation.

Add your case data to the Timeline spreadsheet - this will give us better insight into how other cases (especially those in the same ASC and FO as you) have progressed.

No, completing the interview does not secure a visa for you. The case status is also not unusual. Did you confirm from the IO at the end of your interview if your background check had cleared? That is one of things that could delay the approval, regardless of what the IO says at the end of the interview. Just be patient for now. Meanwhile, it would be nice if you could also add your case data to the Timeline spreadsheet.

Hi Mom, I have some urgent questions.

I recently wrote to you about accidently sending my package to Dallas instead of Chicago (which is where I think it should have gone?).
Anyway, today we received the package back but it seems that they kept my package (I am the principle applicant). They however returned my husbands application because he forgot to sign the I-485. So there is a green slip that says rejected etc.

Some odd things to note:
~We noticed that his sealed medical report has been opened and sent back.
~The money order has stamps on them that say "Department of Homeland Security" or something like that.

QUESTIONS
1) Does he need to get a new medical report since they opened it? Or should we send it back since they were the ones to open it?
2) Should we send the same money orders back to them even though they have stamps on them?
3) Should we send his package to Dallas or Chicago? Since we now do not know who is processing my application.
4)Will they know and still process our applications together as a couple or did we screw up??
5) Lastly I just want to confirm what the Chicago Lockbox address is???

You asked the IO, or the IO specifically told you your background check has cleared? I typically stay out of conversations about visas running out.

1. No need for a new medical report. Just address the noted issue and send everything back as is.
2. Send it back.
3. Is there no indication of where to send the package on the paper you’re supposed to place on top of the package for when you send it back? If there isn’t, I would send it to Dallas.
4. Yes, they’ll know and eventually process both together - although you’re likely to receive your bio appointment notice before he does.
