DV 2023 AOS (Adjustment of Status) Only

Thank you

dear Mom ,
Thank you for your response.
One more question, when I first came to US i took my driving license in WA, but now I am residing in California as for my education ,
So, My residence address would be WA or CA in this case? Does it even matter?

Also, I received a letter from KCC with and attached letter notifying me that they are aware that I want to do my adjustment inside US. Is this the 2nL that I should include in my package?
1. You address should be wherever you're residing.
2. Take a look at the AOS Process Spreadsheet.

1. I cannot give you a specific amount you can use in demonstrating you're unlikely to become a public charge, which is why I typically recommend for a selectee with no current or ongoing income to consider finding someone to provide them with an I-134. Other than that, you'll still have to use your own discretion in this case (like some selectees have done), hard as it may be for you.
2. Include whatever you deem necessary.

p.s. there are instances where it is indeed possible to gain college/university admission and attend accordingly without a HS diploma.
Thank you for your reply.
1. As I have no chance of finding someone to provide them with an I-134, I will include both US and my country bank statements. Can I write a short note in the bank statement explaining that I can withdraw the life insurance money whenever I want or do I need an official note from the bank?
2. So it's not mandatory to include the high school diploma? Is this also at my discretion? Because my problem is that I have a copy but I don't know if I will be able to get the original sent to me in case they call me for the interview, and I don't know if it might be a problem not to have it that day.

Hi! Can anyone direct me to apost/instruction how money orders ($1000+$225) for i485, biometrics etc would look like? I would need especially Memo name, full recipient name etc.
Thank you!

1. Including such an explanatory note would be considered as volunteering unsolicited information IMO - considering the fact that volunteering unsolicited information has been known to backfire, I wouldn’t bother including such a note.
2. I went to great lengths to put together the AOS Process Spreadsheet as a tool to help guide DV selectees. I took great effort at compiling what I deem pertinent information to help ensure a successful DV based AOS processing, you posted trying to justify why you think including a copy of HS diploma is not necessary, when the actual reason for your reluctance is the fact that you don’t have the original copy of your HS diploma (which you could have sent for all this while, and is still not too late to do so IMO by the way). So don’t include it if you don’t think it is necessary. You have the sole discretion of including or not including any supporting documents with your AOS package, as a matter of fact. It is your case after all.

Your daughter will need to apply for a replacement SSN by visiting her nearest SSA office with an ID and her GC. I’m assuming your daughter had a SSN issued while on F1, hence my reference to a replacement card.
Thank you for the response. No , she did not have an SSN while she was having her F1 visa. We had requested an SSN while filling I-485 form. Can she still apply for replacement card? I doubt it take this long to receive.

She will not be applying for a replacement card in that case, she will be applying for a new SSN. Three weeks is not long enough to start fretting over it though. Yes, I know some have received within a couple of days or weeks. However she can still wait for about 4 weeks, if it still does not show up after that, then she should visit her nearest SSA office and submit an application for the SSN.

Hi @Sm1smom , I worked part time as student and full time after I graduated in the same company. Can I mention those two jobs in two different fields? I have verification of employment which has hire date of full time.

1. I didn't know that. Could a bank verification letter also be considered as volunteering unsolicited information?
2. I definitely did not mean to belittle your work! I can imagine the effort to put all the information together and create the AOS Process Spreadsheet, and I am very grateful because without your document I really wouldn't have known how to do it. But you have to understand that this is the opportunity of a lifetime, and we are worried about getting it wrong because it's quite a complicated process.
Saying that, I wasn't reluctant because I don't have the original (it's not a matter of time, it's that I can't go to my country to get it, and my things are in a storage, so it's difficult for someone to send it to me). I really thought it wasn't necessary because in my country you can't attend any University without a high school diploma. And I know that is my case, but some documents are mandatory (such as the long form birth certificate), it's not all at our discretion what should be included in the package, so I wanted to know if the diploma was also mandatory or not.
Thank you again for your help.

Dear @Sm1smom,

We got our NOA letter on May 15th (text on the 9th), and Bio Appointment letters on May 19th. We did the Bio on May 25th in NYC field office.
We got no interview invite as of yet.

It looks to me from the limited data on the timelines, that with our field office we should got it by now. I tried to chat with Emma multiple times, and every time I get a generic replies that "you will get it when you will get it" and "processing as usual, wait".

Should we reach out to the congressmen or the senator? Wait more?

Thank you.

PS:

This is the last reply from Emma's agent:

"We received your application April 24th 2023. The last update is biometrics were completed May 25th. No request for evidence or interview notice has been mailed. Your I-485 has been at the New York City field office since May 23rd. The NYC field office are working on I-485s from December 29th 2022. There is still around 115 days until they reach your case and April 24th 2023. Your case is still pending."

It seems that with the 115-day timeframe, there is no point to wait as the 115 days from now is October 20th.

Most of the applicants who have filed AOS in April have been waiting for interview letter. It is so hard to wait everyday. Chatting emma is of no use as well since they tell that the case is under normal processing time, dont know how long will be the wait

ah, I see now. Are you saying you would leave the address set to NY? Won't LA simply transfer it to NY after I get the RFE checked off? It seems to me that if I complete an address change now, it may just finish processing in LA? Or is the concern the oscillation between the two addresses? I have proof of address in both locations and truly do live in both locations.
The good news is your RFE does not expect you to re-do the entire medical exam - the RFE clearly states that. It gives you the option of going back to your CS or visiting a new CS to get the Part 10 Vaccination Record portion of the I-693 completed once you've obtained the Hep B shot (which you can get administered anywhere of your choosing).

Personally, I would recommend the option of going back to your original CS to get the report updated (following the administration of the shot, or obtain the shot from them if you prefer), as against visiting a new CS who may decide to charge more for simply completing the vaccination record. Using the same CS creates less complication IMO.

Since the RFE is from the LA FO, this means your AOS application is still with the LA FO, all the more reason why I personally will make the effort of going back to LA to get the vaccination record updated there. You can update your address back to LA. Personally, I will not mess around with any more address change at this point, so as to not create any further potential needless case adjudication complication at this point. You however should be prepared to demonstrate you're still based in LA should the question of your current address come up if or when you get called in for your interview.

1. You can use a bank verification letter in place of recent bank statements if you like.
2. You think if I do not understand what a lifetime opportunity for anyone fortunate enough to be selected, I would have relentless spent the last 12 years+ volunteering my time and sharing the needed knowledge to demystify the process free of charge? You actually need to understand while a document may not be specifically listed upfront as mandatory, the absence of such a document may lead to a delayed approval process. While the HS diploma may not been listed as mandatory, there have been one or two cases in the past where whose approval was held up until the applicant was able to produce the diploma, despite having higher degree diplomas/certificates - they had to return to the FO with the diploma after getting it sent from their home country. And of course, several cases have been approved without a request for the HS diploma to be presented. So go figure in terms of what is “mandatory” or not. When I say use your own discretion for something like this, I’m simply encouraging you to make the best decision you can live with under the circumstances and hope for the best.
