DV 2023 AOS (Adjustment of Status) Only

Is anyone here using a lawyer for their application? Every office I call tells me that they don't handle DV cases. If anyone has any information about a lawyer that does please send it me. Thank you!

A fellow AOSer from my year, @Milz , used to know an attorney in Milwaukee who took AOS applicants. You might wanna reach out and ask.

Why would you need a lawyer for AOS though? Is there anything particularly tricky about your situation?

I am just scared of messing up something, and also KCC is refusing to correct a typo in my name that they put in the DV paid fee receipt. I just feel like a lawyer can help me if something goes wrong.

I also noticed that our case is scheduled for an interview today (Denver Field Office)! The whole process took 35 days! Our biometrics were waived since we had already done this 6 years ago. We are currently out of status (pending Asylum), so we have very little hope of getting our case approved.
fingers crossed for you

If you filed for asylum before your visa expired you will be eligible for AOS and chances are high it will be approved. Don’t lose hope

From my experience on this forum, there were seldom cases where a lawyer was knowledgeable about the DV process. In most cases, unlike TV shows, due to their unfamiliarity, they tend to make things worse, and at the end of the day, people start to take matters into their hands.

The only exception was a recent case where a lawyer took applicants inside the FO while attending another case and was able to propel their case. There was supposed to be a spreadsheet of sorts to document these lawyers.

Bottom line, IMHO, if there is nothing tricky with your case and you still have enough time to get through this process, take matters into your own hands.

Hi Sm1smom,

I'm an F1 student and I won the DV 2023 I want to change status but my wife and children are in Angola - Africa. My case number 2023AF54XXX. I filled out all family D's in December 2022. I submitted my I-485, doctors, and all other documents with payments on March 11th, but the USCIS returned my file saying I submitted it earlier. Please, I would like to know what is the right time to send? and how is my family?

Thank you

Unfortuntely! This is not the case! I applied for aslyum(2017) 4 years before my immigration status got terminated in 2021! When it comes to DV lottery and AOS, you should have a valid/lawfull immigration status when apply for AOS! With "Pending Asyulm" case you are only "authorized to stay"in the U.S! Authorised to stay means you have not accured any unlawful presence.

Please do yourself a favor and familiarise yourself with the AOS process by going through the AOS spreadsheet, listed on the first post of this thread.

1. As for the time, look at the visa bulletin here to see when your number is current. It seems that as of May, your number has been current.
2. As for your family, the processed is referred to as FTJ. Again, look through the spreadsheet.

Dear @Mira22 @mbsambo and @wadzanai . You guys are my fellow DV winners whose Field Offices are also in St. Louis. I wanted to deliver the good news that our Field Office offers Interview Waivers afterall. I had my packet delivered to the Lockbox on March 15th, Bio was scheduled for April 17th, then today, my USCIS account is showing the update: "New Card Is Being Produced". So I believe they have decided to approve my case without an interview. I wish all three of you to be met with similar fortune.

Dear @Sm1smom , I appreciate all that you do for us clueless lucky individuals. The steps you have outlined on the spreadsheet, and the constant feedback and assistance you provide for everyone here has made this whole process a breeze! God bless you!
wow! Congratulations, and thanks for the update. I am hoping for something positive in the coming days. I did my bio 61 days ago.

Hi @Sm1smom!
Does USCIS have a way to check if I paid 330$ fee other than the copy of the SASE response?
KCC has reached out to me and now USCIS sent RFE. Copy of the notes from AOS.
- Sent in April (no Early Filing)
- Apr 19, Received an email from KCCDV@state.gov stating that "Adjustment of Status - Fee Not Paid" (330$). Indeed, the proof of payment is missing in the filing but the fee was paid. Replied to the email and attached the receipt that was delivered to me on Mar 30, right after I sent my filing.
- Apr 27, received RFE request to provide proof of DV Processing Fee (330$) payment. Send response with original RFE, cover letter, SASE received with stamp that the fee was paid on March 15, and copy of the Cashier Check (customer copy).
- May 2, status of the case is not updated yet.
How quickly do they review RFEs now? and what is the difference between KCC and USCIS requests?

1. Yes, through your KCC file (file sent by KCC to USCIS which contains all correspondence with KCC, eDV entry, etc) is another.
2. Hard to determine.
3. KCC administers the DV program. USCIS process the AOS application.

Hello, finally today I received my dv receipt by email.

Hi @amir0207 !
When did you receive REF from USCIS?
And when did you send a a response?

Thanks, I'm confused b/c I received the SASE on Apr 30 stating that the fee was paid on March 15.
I guess what happened is USCIS reached out to KCC to confirm payment. KCC couldn't find the payment and sent an email to me. I replied to the email and attached proof of payment. I don't know what they did after that.
And USCIS sent me the RFE for the DV fee payment as well. I replied pretty much with the same documentation.

Based on the DV payment fee form I sent the payment to the Department of State (DOS). How is KCC being informed of payment?
