DV 2022 AOS (Adjustment of Status) Only

Hello!

I've read about the first payment that "A cashier’s check or postal money order for the correct Diversity Visa Lottery fee amount, with the DV case number noted on the cashier’s check or money order". So I am a bit confused. Should I write my DV case number on a money order or it is just enough to include that additional paper with my info from the website?

And I just copy identical that text from the website for first payment, insert my personal information and don't change anything in the sentence order there? Thank you a lot

What website are you talking about? This one? https://travel.state.gov/content/tr...m-entry/adjustment-of-status-fee-payment.html The instructions seem clear to me, it tells you to both write the case number on the check and include the information in the “fill in” form.

Writing your CN on your money order is not enough. You need to include the “form” from the website with your payment. Yes, copy the text to a word document verbatim and fill it out.

If i want to change a page in 485 form can i just print that particular page and not the whole 18 pages? This barcodes are unique or they are generated everytime we print on 485

It's a pdf, it's not generating a barcode each time.

Getting ready as others are to submit my AOS package - CN OC1XX, number is valid in October.

My husband and I are both on E3 visa currently, my question is, after we submit the AOS application, if my husband decides to leave his job, does the I-485 application allow him to stay in the USA, or does he need to keep his visa (in this case an E3) until the green card is approved?

Under normal circumstances he could apply for an E3-D (dependent visa) under my E3, but my concern is, once we apply for the AOS, he may not be able to get the E3-D due to immigrant intent.

Apologies if this is out of the wheelhouse of AOS questions, we may need to speak with a lawyer, I just thought I'd ask here first! Also, how do we contribute our AOS timelines to the spreadsheet?

Click on "view only" and then on "Request edit access".

You can stay in US with a pending I-485. However, if the application is denied for any reason, he has no fall-back status. It's always safer to have a fall-back status in case something goes wrong. Let's say you forgot to sign your form. If he leaves his job and losses his current status and USCIS return your application to sign it, then you don't have a status to adjust from anymore and have to leave US.

Once the application is accepted (you get a receipt notice) he can leave his job and stay in the US under “adjustment pending“ (which is not a status as such but is authorized stay). Note that he will not be able to work until and unless he gets an 485-based EAD (not sure if you are applying for one, but they take months anyway). He (and you) also cannot travel out the US without AP until the adjustment is approved. Note that the normal recommendation is to maintain prior visa status if possible, because it gives you something to fall back on if for whatever reason the i485 is denied - without a fallback option he would have to leave immediately if there was a denial.

By the way I assume you are aware that it can take months to get a green card under AoS - being current in October is not at all a guarantee of an early adjustment process being finalized.

Just open up the spreadsheet and update as needed.

Thanks Susie! This is great news for us. He is applying for the 485 based EAD but my guess is we would probably get the green card before the EAD anyway with the current wait times. Thank you for heads up re: maintaining the current visa status just in case the AOS is denied. We were just curious about our options as we want to move from Texas to California which would mean he would have to leave his job (I would support us in the interim), but it's food for thought to stay in Texas as long as possible or until we (hopefully) get the GC.

So one more caution is to be careful about moving during the process. You have no real insight as to when your FO starts work on it, moving states means your FO will change and you won’t know at what stage of the process it is (unless of course you are lucky enough to get a quick interview before you move). Don’t delay filing in AR11 if you move. It is likely that such a move could add some delay to your case.

Thanks you so much again for this advice. It sounds like it would be better if we stayed (less stressful also), we have a few other factors contributing to a possible move, but really appreciate your advice and the tip on the AR11.
