DV 2022 AOS (Adjustment of Status) Only

Hey Ivanze, Can I confirm with you that you are saying you just paid the DV administrative fee, and the KCC sent you a 2NL, around 4 months later? I have receive my receipt, is that the 2NL, or is the 2NL always an email? And according to the AOS FAQ's on the spreadsheet, I don't need a 2NL anyway. Sorry just confused about this?
 
What are the documents I should provide for proof of maintaining a valid status in the US as an H1B status applicant? The AOS process document mentions copy of EAD and current/past I-20 is viable documents "if applicable". I would think the I-797 should be enough for an H1B applicant? Please advise,

Yes, you can have multiple applications in the system at the same time. Upon approval, the second application gets cancelled. And for the DV based AOS, the passport you use is irrelevant. The passport is not used in determining DV eligibility.
Dear all, how do I know that both K-1 and DV process can be done simultaneiously? K-1 is already at CP now, but due to pandemic its delayed, whereas DV AS20K number seems high. If K-1 is approved within next couple of months, does not DV gets automatically cancelled? Or since I have 6 months after K-1 approval, can I wait and see whether DV CN comes up and go through that process too and choose only one?

I never got a 2NL and no one asked for it.

Take another look at the “AOS Package” tab of the spreadsheet, it mentions other documents besides “copy of EAD and current/past I-20 is viable documents” for proof of maintaining a valid status

You are trying to compare apples and oranges with my post which you’ve quoted with yours. To help put things in context, that post was a response related to applications with USCIS. Your K1 and potential DV applications are not going through USCIS, they will be going through consular processing. So my statement of “Upon approval, the second application gets cancelled” is not applicable in your case - that was in the context of cases with USCIS.

Like I already responded to your initial PM, based on your scenario, you can also have both your K1 and DV based immigrant applications in the system at the same time. For CP, the second application only gets canceled if you do not show up for your appointment (assuming the first one (whichever got processed first) already got approved). Since you cannot be issued with two visas simultaneously, if you do show up for the second appointment, the first visa which already got issued will then be canceled without prejudice in order for the second visa to get issued.
 
Hello,
I sent the Dv fee to the department of state on 09/22/21 . While I was tracking it has been saying it's on Missouri, St Louis 63197 and available for pickup. Today it has a remark saying"Reminder to Schedule Redelivery of your item before Oct 8".Does this mean they still have not picked up the mail or is it something wrong from my side and I need to do something about it?

Yes, that is correct. We just paid the fee and got 2NL by the email a month later. The receipt stamped "PAID" is not a 2NL
 
Hey guys, wanted your opinions on filing the AOS process with lawyers. I currently have all of my documents ready (i-485 filed + additional evidence required, DV fee receipt, 2NL) and I was thinking of getting lawyers' help with review of documents. Is that a service that lawyers help with?

Maybe you should contact the delivery service you used for further clarification on that update.

This is a DIY forum, majority of the members here have successfully processed their DV selection without the use of a paid service. You'll need to make a personal call regarding the use of a lawyer if you feel more comfortable with hiring one and relying on them.

You may feel more comfortable having an “expert eye”go over your documents if you do not feel the guidance here is sufficient, your choice. Bear in mind though that with around 1000 DV AOS cases a year spread over the whole country, most of whom DIY, the chances of you finding an expert lawyer in DV AOS is tiny. Some people have used lawyers and been fine (other than maybe spending money they didn’t need to if their cases had no complications) while others have actually had their cases damaged by lawyers who did not understand the differences between DV and other types of AOS. So if you do go with a lawyer, I suggest you ask them exactly how many DV cases they have assisted on.
