DV 2022 AOS (Adjustment of Status) Only

Honestly, up until the biometrics I had no issues. Although, my case became current in June so I wish I had put in the application around May as an early submission rather than mid-June. Then, I wish I hadn't waited until late August to make congressional inquiries, or to get an immigration lawyer involved (obviously pending the urgency of the case and your personal immigration journey). Dealing with this in September when my current non-immigrant visa is up in October was very stressful. I should have jumped on it in August but again, all a learning curve!

@Sm1smom Is there an agency that I can call or email to influence a fast production of the KCC receipt? The money order has been marked as out for delivery. My hope is that it will be cashed by Thursday. Also, do you think requesting a tier 2 call back to inform them that the money was received would help? My first receipt took 17 days to come back which is time I do not have.
The paralegal explained to me that including my son's details in the AOS package that was compiled might have influenced the current events. She also admitted that they now understand that DV-AOS is different. We included my son's birth certificate and maybe passport bio page. I still hope it will be well.

1. None that I know of .
2. I don't think so. The tier 2 person will have no idea as to what you're talking about. Your lawyer has supposedly been in contact with the IO right? The information you've been getting about the IO waiting for the payment to be made in order for KCC to release your KCC file has been coming from your lawyer's office, right? So have your lawyer contact the IO and inform them of the progress made to date re the payment.

Yeah, I have no idea as to why you and your lawyer felt it was necessary to include your son's documents in your AOS package.

First, thank you for always responding.
Yes, they are in contact. He wants to wait for the receipt before contacting the IO again so that he can forward it to him. I explained a receipt may take up to 4 weeks which is time we do not have.
About the child, the rationale provided is that they needed to inform USCIS that I have a child. I sheepishly followed.

The information about your child is already listed on your I-485 as required, right? They were trying super hard to impress you in that case I guess, hence the silly recommendation.

You should probably consider the possibility of visiting the FO on your own in that case. You may be fortunate to meet with some guard who may be kind enough to let you in without an appointment and plead your case directly in person.

Hi @Sm1smom,

My case has been added to the timeline spreadsheet (row 71 for now), the field office is Portland, OR. After a long wait, me and my wife finally had interview last Tuesday (Sep 6th). The IO was kind and the interview went well, at the end he said everything looks good and he's gonna approve our case, and we will receive our cards pretty soon within 4 to 5 days. However, our case status does not get any updates after the interview, and the latest status in the system still shows "Fingerprints were taken" which was updated on May 6th. I talked to the Emma live agent, she only sees "The interview was scheduled." at her side. Since it's already very close to the end of September, I am anxious about current situation a lot. May I have you suggestion? Should we keep waiting or is there anything we can do at this moment? I appreciate your great help.

Did you ask if 1) IO received your KCC file, 2) your background check was cleared?

I asked Emma the two questions and she replies "You are not entitled to that information. We do not provide internal case information."
Well, that was a question for IO, not EMMA, EMMA does not know that either way. Probably one of these is the issue.

Your bio was back in May based on the spreadsheet, that would make it unlikely to be the case. Are you from a country that usually takes longer to be cleared or does your field of work fall under TAL?

I see. Tried to ask if EMMA could help schedule an InfoPass appointment with IO but she rejects. Should I visit FO and see if they let me in and talk to IO in person?

1) No, I believe my country usually get cleared fast. 2) Yes, I just checked the TAL list and my field of work is in the list.

We have interviews for 9/26! For background, we sent an expedite request on August 19 as my spouse (and dependent case) couldn't leave the country with AOS pending, and was missing out on an international contract. The expedite was based on severe financial loss. I posted earlier about the fact we were asked to send supporting documents to an email address that read "insert email address". We mailed the documents through USPS and called several times to try and get a proper email address and were constantly told we would be called back. I received several emails and text messages saying I would receive a call in the next 1-2 days but no one ever called. Finally, after calling AGAIN on Friday, the agent we got said she could see the email asking us to send documents to a blank email address and said we would be called back within 72 hours and we actually were! The caller said said she would let the Los Angeles Field Office supervisor know what had happened. A couple of hours later my congressman emailed to say they'd received an update that we had interviews and included the letters scheduling my interviews. I sent my request to the congressman 30 days ago. Anyway, the deadline for my partner's contract passed, so we missed out on that, but we are excited to have interviews. I was worried I was pestering USCIS too much by calling, but I think it was the right thing to do. I think we just finally got someone who bothered looking at our case and could see the USCIS error and then actually put in a request for us to be called back urgently, rather than just saying they would, like all the other people we had spoken to had done. So persevere.....Just incidentally, I'm not sure if the fact we asked for our case to be expedited actually slowed the process down initially. Also, not sure if the fact that there are 5 of us (me, my spouse and 3 kids) made it slow. Who knows?

One more question. We live in LA and our interview is in LA but we have kids in college in Boston and Rhode Island. They will both be in California this weekend. Would it be crazy to call USCIS and ask them to bring the interview forward? I know it's probably impossible, but would save us a lot of money. However I'm very wary of messing with an interview that is already scheduled. My feeling is best to leave it.

It's only been a week since you had your interview (yes, I'm aware there's like 2 weeks and 3 days left till the end of the FY), there's quite a bit of time left for the case to get approved. I honestly think you just need to remain patient. If your background check has already cleared and the IO has your KCC file (unfortunately, those are 2 major questions you failed to ask them at the end of your interview), they will go ahead and approve the case before the FY sunsets.

Care to disclose your chargeability country? Your background check clearance may indeed be pending considering a the other Portland OR case (similar story line as yours) got approved same day of their interview.

Congratulations of finally getting scheduled for your interview. I doubt the number of applications in your package caused the delay, except of course if your background check clearance took a while to go through.

@cbs5hiuc I came back here to check on you (I've been on the absolute edge of my seat this entire time) and OMGGGGG I am THRILLED to see your update!! Best feeling ever!!!

I definitely owe you that celebratory drink! Cheers!!
Thank you!!! My status changed to Case Is Approved today. I am over the moon! Perhaps Aussie meet up somewhere in the city? Not sure how we go about organising that haha @AustrAlien @dazza2104 @Blade_ (I think you are all Australian)

Thanks for your reply! Me and my wife are from Taiwan. And yes, I see there's another case got approved from my FO at the same day of interview, that's why we keep wondering why there's no any update on our cases...

Thanks for confirming your chargeability. It is indeed not the reason for your pending approval. It possibly could be travel history related in addition to your field of work being TAL related. Just hang in there, I’m keeping my fingers crossed for you.
