DV 2022 AOS (Adjustment of Status) Only

No I haven’t what did you do to receive this response. That’s the response I received.
you will have to make it like a formal request state your full name and literally mention and confirm the full names of your derivatives that they are based outside The US and that they will pay DV fee when they appear for their interview at the consulate or embassy whatever applies to you (mention city and the country). In the second paragraph, Copy paste some1smom FAQ on FTJ on the spreadsheet regarding the DOS consular affairs statement and copy the link and include it in your email.Et Voila!!!!. Hopefully it work. Me they almost turned me crazy after sending them 6 or 7 emails about my derivatives payment fee. Each time with different response lol.

I will send one again this is the 4th time. The officer at the FO said he will communicate with KCC too

Guys I have been waiting for response since 57 days, that was the last day my case status changed to "Fingerprints were taken", July 16. I was at NY at that time and moved to TX to attend college in August. I did my address change through USCIS on July 30. My case number is 2022AS0005XXX (July current).

I have contacted USCIS, but cannot get through to automated voice mail.
I tried Emma and she wasn't of any help as well.
I have contacted congressman from TX and I'm waiting for their response.
I have also contacted ombudsman and they haven't said anything as well.

Since I moved in between processing I'm not even sure which FO is processing my documents. What are my options here? Please let me know if I can do anything. Thank you so much.

You should also contact the congressional person with jurisdiction over your previous address in NY requesting their assist with following up on your case (don’t disclose to them upfront that you already moved, because if you do, they will not assist you). Keep trying with phone call and online chat with Emma by saying to typing “INFOPASS” until you get through to a live agent. Mind you there’s no guarantee a life agent will be able to provide you with accurate information as to where your case file currently is though.

The interview experience for my wife and I at San Francisco Field Office was the nicest one, more than we could ever imagine. We were there at 8:15am for our 9:20am appointment and were told by the guard to come back at 8:50. After entering and giving our fingerprints and photos we barely had to wait 10 minutes before being called in.

The officer was very courteous. The questions asked were very straightforward. Within a minute of the interview we felt so comfortable and all the nervousness went away. He only confirmed all the main info on our forms with us and went over some yes/no questions. The only questions we were asked were - names and dates of birth of our parents and some questions about how we met and details of how the marriage happened.

The documents we were asked to give:
- Our daughters birth certificate (who was born in the US after we had entered for DV)
- Joint tax returns of the past year for proof of relationship. (We submitted for the past 3 years and he was happy about that)

He was very considerate of the fact that we had a toddler and even offered to allow one of us to walk her out if she gets fussy inside.

He told us right then that he was going to approve our case and that he was going to move it as fast as possible since the deadline is so close.

Our interview was at 9:20 am and it was updated to ‘new cards being produced’ by evening.

Couldn’t have asked for a better experience.
Forever grateful to this forum, everyone who helps others and also everyone who asks questions and posts about their experience. We haven’t had to post anything because most of our questions were already asked and answered.

Sending an email for Dv fee receipt and contacting live agent and asking about interview letter both helped us receive those documents in the next couple of days.

We received our green cards about 10 days after the interview.

So I contacted USCIS live agent and I found out that my case is still at Queens Field Office at NY. I requested him if there's anything I can do to expedite my case since its time sensitive and asked him if the case will be transferred to Dallas FO and process on time; he gave me reply saying "Your case being not at your local field office is to help with the processing of the case. Please continue to wait." Not sure what that actually means. I was disconnected after this. Anything I can do at this point?

I also contacted congress person from Queens and requested a call back via phone call. So I'm waiting for that as well.

The direction I received from the KCC is that once the paid receipt is received, I am to resubmit to KCC. Once I get acknowledgement from KCC then I can approve. This all has to be done by Sep 30th.

I guess I have to just pay

Don't get me wrong, if i were you i would have paid already.
 
Update:

Just got off the phone with USCIS agent. She told me my case is currently in transit from Queens Field Office to Dallas Field Office. I asked her any possible time frame, but she said there's no way to check that. Like the online agent she also told me to just wait. Any idea how long it will stay on transit?

I have no idea what that is supposed to mean either. The agent possibly made that response to simply get you off the queue.

Also, you might want to take that update with a grain of salt. It's not like the file transfer involves someone physically walking or driving over to Dallas from Queens, hence it's being "in transit". Case transfer is done electronically. I have no idea how long a case transfer may stay in transit. But I do know it may take a while for a transferred case to get assigned to an IO at the new FO, or for the IO to review the case file - it all depends on whatever the level of work they're currently dealing with when a new case gets assigned to them. I did warn you about the potential for additional delay once you disclosed you relocated after sending in your AOS package and completing the bio.

If you take a look at the Timeline spreadsheet (which you should add your storyline to by the way in order for us to have a better insight into your progress and advice accordingly), you should be able to get an idea of how your FO is performing/handling other DV based AOS cases.

I honestly do not understand what you've written above, in terms of who is doing or supposed to do what. I will however say it's a shame some IOs are insisting on some folks making the DV payment for their derivatives processing FTJ, and blaming it on KCC, considering we have confirmation of KCC sending the required KCC file of other folks processing AOS alone (while their derivatives are processing FTJ) to the FOs as requested by the IOs.

Like I earlier on responded though, it's your call at this point as to if you want to take another shot at contacting the KCC and requesting they forward your case file, or go ahead and make the DV payment right away to at least give you a shot at getting your GC, even if it will eventually mean sponsoring the rest of your family later on (assuming they're not able to complete the FJT portion before the end of the FY).

It may not necessarily be an indication the KCC case file has been transferred to the USCIS, it however is an acknowledgment of their understanding of your plan for your derivative(s) to process FTJ.

Should I file go ahead and file I-824 follow to join tomorrow. I have emailed the embassy to inform them and ask for requirements. I plan to follow your recommendation. I’m really tired of the back and forth.

The attorney does not understand this process despite sharing the link you provided. I also sent the money order. He insisted that it’s the only way to go so that he can contact the USCIS officer. I can’t wait to close this chapter with him.
He emailed “I don't want you to lose the chances of applying for your child. It may be safe as mentioned to pay it to be on the safe side and that $330 has to be paid before September or child losses the chance of DV benefits. If not required that would be the best protection for your child.”

I wouldn't recommend submitting an I-824 now considering your own AOS application is not yet approved, and you do need to include the approval notice with the I-824. Considering you did not concurrently file the I-824 with your AOS package, I do not think you can simply file an I-824 now without the approved NOA from your AOS application. But you may still go ahead and file it nonetheless, if you do not mind the potential of loosing the filing fee (considering how close the FY end is). On the other hand, you just may be able to generate action with proof of filing the I-824 and the NOA from your AOS approval by sending those to your embassy after your AOS application gets approved. So yeah, it is your call on what to do at this point.
