DV 2022 AOS (Adjustment of Status) Only

Hello everyone two questions please,
1) I got my physical test as soon as I knew that I won the DV lottery (May) so need to get it again closer to whenever I send my documentation for the AOS since the old physical test signature already expired. Are the blood tests good for 1 year? Or do I need to get them again?
2) Using the excel sheet, I came up with the following list of documents to include in my application + a few extra ones, would you mind please taking a look at the list and telling me if I should not any some of those or if I am missing something?
I am currently on an F-1 Visa under OPT, concluded my studies on December 2020.

1. The only thing that matters to USCIS is for the CS’s signature to not be older than 60 days as at the time of AOS filing - your CS will confirm what is needed when you contact them to re-do the medical exam.
2. You might as well remove the extras such as reference letters, SEVIS payment, driver’s license, 1098T, which you added, they are redundant and irrelevant.

Hello everyone, two questions if someone could please give me a hand with form I-485 (Expires 09/31/2023).
  • Part 2 question 3 states:​

    • “Receipt Number of Underlying Petition (If any)”
      • Would this be my DV case #? Or the Confirmation Number we received on the DV-2022 Submission Confirmation form?
  • Part 2 question 4 states:​

    • “Priority Date from Underlying Petition (if any)”
      • Little confused on this one. IF FOR EXAMPLE my case is SA50 (which is inside the cut-off which will apply in October) what should my answer by for this question?

DV 2022 selectee here, Nepalese citizen living in US with H4 visa. My case number is on the higher side, around AS13XXX. I can see that all cases of DV20 & DV21 were current from Asia. However, I am cautious on processing further because I intend to apply for F1 if I cannot get a green card with DV. Currently, I am planning to join university on H4 from Jan 2022 and plan to change status later. How do I proceed further without compromising a chance get F1 visa even if I cannot get green card from DV 2022?

Some more specific questions
  • I know that submitting DS 260 is optional and it provides an option for Consular processing if I decided to change my mind from AOS to CP. Is it too late submit DS 260 only after my CN is current? (not before June 2022, I guess)?
  • What can be the conditions that makes my AOS processing time longer?
  • Is it fine if we get approval letter/welcome notice by Sep 30th and not the green card?
  • How is the violation of admitted status (Undertaking of unauthorized employment) assessed? I had to work online for my employer at my home country even after I arrived US (for about a month). Will this cause a problem? If yes, how can I fix this?

DV cases have no underlying petitions, so those two questions are not applicable to DV based AOS applications. Write “N/A”

1. “Too late” or not depends on when the CN becomes current.
2. AOS processing delays varies for people - could be due to prolonged background check clearance, package rejection from the Chicago lockbox, FO workload, ASC backlogged, pending KCC file request, inclement weather, COVID, etc. Numerous reasons!
3. Yes.
4. Unauthorized employment is defined as any service or labor performed for an employer within the United States by a noncitizen who is not authorized by the INA or USCIS to accept employment or who exceeds the scope or period of the noncitizen’s employment authorization.
INA 245(c)
Such a violation if it already occurred cannot be fixed.

p.s. use numbers, and not bullet points, for multiple questions, that makes it easier for cross referencing.

I have few doubts about filling the form I-485 and thought of asking here since some of you have already encountered this.

1. the first one is about filing the address history during the last five years (part 3, page 5). I had 3 addresses in the US and 1 outside the USA for the last five years. since it is only possible to put 2 addresses for the past 5 years I had to use additional space at part 14. So I am going to fill out 2 blocks in part 14 as below

My question is on numbering the items. I'm using only the relevant items and their respective item numbers under Physical address 2 on part 3 for both blocks on part 14. Is this the acceptable way? (I am using the Physical address 2 on part 3 too. So I have a doubt whether it would cause any confusion for them)

2. On Part 8 item 63.b - I didn't have any removal proceedings filed before but since we cannot put N/A there shall I simply tick No.

3. when filling out the employment history (Page 5 Part 3) dates is it fine if to write down "current" for item 14.b since I am currently working there. And the same question for the Organizations that I am a member of in Part 8. Since I am actively holding memberships for some professional organizations in my home country.

4. When filling the form I have used BLOCK CAPITAL letters for names - Applicant Name, employer name, Parent's Name. for the other fields I have used Camel Case Since there was no instruction to only use CAPITAL letters. Is that okay?

And should we send and fasten all documents together in one paper cover?

1. Don’t overthink this. Follow your instincts. It is basically an address, there’s no possibility of this causing confusion for anyone.
2. You can simply click NO and move on (as against leaving the section blank) they’re not going to read too much or any meaning to it since you already correctly answered the preceding question.
3. Yes.
4. Just be consistent with whatever method you wish to go with.

As the date to send my package gets closer, I have a couple of questions to polish if someone could please give me some guidance.

I have created two identical AOS Packages with all the documentation. One package will be shipped, and the second one will be used as my backup which I will bring with me to the interview.

1) Any suggestions on what documents should be send in original format? Or is it all copies?

2) I was thinking on sending a copy of my birth certificate and bringing the original one with me to the interview on my backup package. Should I do this or send the original with my AOS package? The same with the official translation, for this one I just have a copy that the translator emailed me, but I can have him ship me the original document with his actual signature from my home country.

3) Am I good to send my package when my number is listed under the Advanced Notification in the VB (Section C) the day the VB comes out? Or do I have to wait to the 1st day of the next month to send it? I read the “USCIS Early Filling Policy Memorandum” and it states applications can be sent the day that my number is within the CUT OFF of the Advanced Notification Section, so pretty the same day the VB comes out. However, I just wanted to check with the forum to see if any of you had any suggestions or thoughts regarding this matter.

1&2. Any original document you send in with your AOS package will not be returned to you. So based on this, you should be able to figure out if you need to send the original version of a specific document or not. You can also take a look at the AOS Package tab of the AOS process spreadsheet for what is listed there.
3. Take a look at the FAQ section of the AOS process spreadsheet for further guidance on early filing.

lastly, what does the 2NL look like? before I knew the difference between the process for KCC and AOS I sent an email to the KCC and got a reply that said

I'm not sure if this counts as a 2NL but I don't think so?

1. You are expected to attend your interview with the original copies of the documents you send in with your AOS package.
2. Include the “replacement diploma” and the 2 bachelors degrees.
3. Use your discretion regarding the job experience.
4. That is your 2NL.

Do you have any idea if I need to translate this birth certificate into "English language only" or this should be fine to include in the AOS package? Please suggest to me if you have been through this or have any idea.
