DV 2022 AOS (Adjustment of Status) Only

The official current status is what you’re able to see - fingerprints taken, bio completed. The unofficial status IMO is although bio completed, background check clearance is still pending hence no interview schedule as of now. Your FO is already aware of your case being a DV one, they’re aware of the process involved. They’ve already contacted the KCC to request your KCC file - that is the reason for the initial email request from KCC. KCC wouldn’t have asked you to explain why only one payment was made, if the FO was yet to send a request for the KCC file.

1&2. That is just a confirmation your AOS application already got sent from the NBC to your FO like it should, and it is currently awaiting an interview slot at the FO.
3&4. Congressional inquiry is usually sent to the FO. A Tier 2 agent (if you’re able to get one) may be able to submit an inquiry on your behalf. You can also try using the to see if the system will allow you to submit a case inquiry.
Hi Thanks for the reply!
1) If it is a case of a pending security clearance, does that mean it has been pending since the biometrics were taken? or is the background check initiated when they request the file from KCC/case transferred to FO for review? I have seen cases here were the BC would still be pending even though the applicants would have completed their interview?
2) How long do these background checks typically take?
3) Is there a risk that my I-485 would expire while it is pending?

Hi.
I received the SMS and receipt number on June 22nd and still waiting for Official letter or an email. The status on USCIS is Fingerprint Fee was received. Should I wait longer or call USCIS? Please, I need some advice.

1. Initiated immediately following the bio completion. Some FOs and IOs are willing to schedule and complete the interview before the bio appointment gets scheduled or the background check gets completed - they just wouldn’t complete the adjudication process while the background check clearance is still pending. Others (like yours seem) are not willing to schedule the interview while the background check clearance is pending.
2. It varies for people. Could take a couple of hours for some, and a couple of weeks/months or even years for some. There are several factors at play such as an applicant’s country of origin, places/countries they’ve visited in the past, line of work or study, etc. Or simply being unfortunate to share common names with people already under government watch.
3. Yes there’s a possibility of that happening. There have been a couple of cases in the past that couldn’t clear the BC by the end of the FY, once that happens nothing else can be done about the case at that point.

Do you use the USPS Informed Delivery? If you’re not, now is a good time to sign up for it - it enables you to see upcoming mail delivery. As for your pending NOA, you’ll probably need to wait a while. USCIS recommends waiting at least 30 days before following up on missing/non-delivered documents.

I have signed up for it but it does not show as well. I will wait for it.
So, is there any possibility of getting biometrics appointment without official confirmation? I guess at the moment I have nothing to do but just wait.

You can try talking to a live agent through Emma to get bio appointment. I was able to get mine through there. I can’t use it for a walk in tho

Hello SM1smom,
Please Help!

I had my biometrics scheduled for June 28th but I completed a walk-in on June 15th. I had my house fumigated and I put my mail on hold for 4 days. I set up informed delivery and I received a notice on July 1st that a letter from USCIS would arrive that day. The letter was stamped on June 29th from the USCIS in Santa Clarita CA which is near where I reside. My mail has been off hold for 3 days now and the letter hasn't arrived. I have had other mail that was set to arrive on July the 5th which has arrived. I contacted the local USPS and they don't know where the letter from USCIS has gone and they said everything that was on hold has been delivered. I have tried calling USCIS and they have no record of the letter that was sent and are unsure what is inside it. When I check my USCIS account the latest update is that my biometrics was received on June 15th. I'm nervous that I won't receive the letter and it might be an interview notice that I might miss?

Is it common to receive a letter that your biometrics was received?

What should I do?

Regards,
Jackson

So that most likely means it has not yet been mailed. You may be able to obtain the bio info (if already scheduled) by chatting with an agent via Emma, you however cannot attend the bio appointment without the bio letter itself.

Nope, USCIS does not send out letters on bio being received or completed, but they do send out new bio notices if the previously capture bio turns out to be unusable. It could be your IL. Your best bet at this point is to make a trip down to your FO and explain your dilemma to the security guards about USPS having lost the mail - you’ll need to show them the USPS informed delivery notification. They should hopefully allow you to enter the premises and speak with an IO who will be able to pull up your file and see what was sent. And just to be on the safe side, go to your FO prepared for the possibility of an on the spot interview - this has happened in the past.

GOMAJ: Our Application was received on April 1st 2022 and we have done the Biometric on May 18th 2022. Our field office is Brooklyn New York. So far we have not received an interview. I keep contacting USCIS asking for updates using info pass tool and phone calls and online account but I get the same message that no interview is scheduled or waived. My H1B visa expired on June 30th. I am looking for work now but my worry is that most places offer J1 visa only. very few hospitals offer H1 visa.
so today I kept asking the agent to schedule a call with tier 2 officer but was told that cannot be done for this reason.
Should I just wait now or is there anything else I can do? Should I contact congressman?

My FO is also LA, timeline is similar to Ckb and micleung.
However I still haven't got assigned an interview. This make me really worried.
When I checked with Contact Center the agent said my case is at FO in May till last week, and it's transferred back to NBC yesterday.
I didn't front load medical (not my idea and I definitely regret not doing so...)
Is it still possible to waive interview and receive RFE instead? Should I interfile?
Following for a response

btw, could you share your timeline? when did you complete the bio?
My case arrived on April 25th. I got a Bio appointment for June 22nd, but I did a walk-in on the 13th. Today I contacted USCIS and they said that my case is now at my local field office but I still have not received any interview notice.

Hi,

My wife and I did our interview back on 05/19 at Newark office. It has been 7 weeks now without any updates on our case. Our case still shows "Case was Updated to show fingerprints were taken." Since it is getting closer to the end of the fiscal year, is there any recommendation I should make now? Should I still keep waiting for the update on our case? Or should I start the follow-up process (like requesting a Tier 2 officer call back, USCIS case inquiry outside normal processing time, congressman inquiry? By the way, do you recommend sending an email to confirm with KCC that they send my wife's case and my case to our field office or the immigration officer? Thanks in advance

Hey! @dv2022gcc was wondering what method of contact did u use to get the info? I have a very similar timelines as you but when I chatted w an officer online a few days ago they said that my case is still at the NBC and not at any of the FO.... I’m so worried, this is also a question for @Sm1smom , is this normal? (I checked past timeline and it seems like for my FO they got their interview notice way before mine, it’s been three weeks.... should I wait? Or should I initiate an inquiry?

Yes, you can email KCC now to find out if your FO already requested your KCC case file (when it was requested and if requested, when it got sent). I doubt you’ll be able to get a Tier 2 agent call back or initiating a USCIS case inquiry outside normal processing time (no harm in trying though). I’ll suggest waiting till the end of July before initiating a congressional inquiry if there’s still no update by then.

Be patient, your FO is familiar with DV based AOS applications.

p.s. add your timeline on the Timeline Spreadsheet.
