DV 2022 AOS (Adjustment of Status) Only

One month is extreme, I know. I might get the admission these coming days and apply for f-1 and be in the states in beginning of August. I would go to the master's even if I didn't have my DV, so one doesn't conflict the other. There is nothing wrong if I go to study, but I also have a chance to apply for AOS?
Why don’t you get your green card through CP? Once you have it you can come to the US to study in January .
 
I-485 NOID after won Dv lottery
Here’s a whole story Came to us legally at the mid of 2015, j1 visa then apply for asylum beginning 2016.. For now( after 6 years) case status still shows your next step is interview. In May 2021, I found out that I won the dv lottery green card. With a lawyer filled out i485 for me and my husband. I’m mid-January 2022 there was an interview. Very nice officer asked all the simple questions same like on i485. She(officer) took my and my husband's I-94 form from the passport. A few days later, a request for evidence came with a request for a receipt for payment of the DV fee to the US department of state which is $ 330 per person (which we paid back in November). Well of course we attached the recipe and sent it right away. At the end of March 2022, NOID comes in which says that asylum is not a status and USCIS intends to deny. Has anyone had a similar experience? Is there any option to protest or open the case again. Any advises? Some forums says suggestions to go to our country and try to go through the whole process through US Consulate, but we can’t leave like asylum seekers and it is simply dangerous for us to get there plus in our country the last USA consulate was closed last year ... We live in the USA for many years we are follow the law and pay all taxes and we have here some friends who, being in an asylum status, won a green card (dv lottery) and successfully received it while in the United States and without leaving through I-485 ... ‍♀️
Unfortunately, there is no appeal option in this case. Yes, it is not unusual for a DV based AOS application with an asylum pending status to get denied, because like the notice stated, asylum pending is technically not a status an applicant can AOS from - this is quite common. Notwithstanding, a few cases have been lucky to have been approved, yeah those cases were fortunate, but not so in your case. And even if you can leave the US (as in abandon your pending asylum case), you can no longer process CP, your DV selection has been adjudicated to a conclusion as is.

Keep your fingers crossed and hope your pending asylum application gains traction and gets approved soon.
 
Below are the updates of our cases,

After we left the field office (first interview), we sent the email to the KCC on 6/22.
KCC replied on 6/26 with the general guidance as same as the contents showed on the official website.
So we decided to fill out the DS-260 on 6/26, and walked-in to the field office on 6/28.

We tried to persuade the officer that we have done everything, and also on the official website
it said "It will not be necessary for you to contact the Kentucky Consular Center (KCC) for any further information or instructions if you are eligible and apply to adjust status in the United States. "
However, the officer still asked us to wait until she received my wife case file from KCC so that she'll continue to process our case.
In order to speed up, we sent the email again on 6/27 to inform KCC about our situation, and ask them to send my wife's case to the field office as soon as possible.
KCC replied us on 6/30 said "The information you provided will be forwarded to the appropriate department."
Finally, our case status has changed to "New card is being produced" in the evening on 6/30, and became "Case was approved " at the next day.

Thanks to this forum and mom for all the help and guidance.
Last but not least, I would recommend the lottery winner to fill out the DS-260 for both you and your spouse if decided to get marry after won the lottery!
Hi there i had similar situation like ours my wife is principal applicant and i am derivate applicant we both fill our DS260 form in Ukraine but due to war we have to do AOS in USA. Today they approve my wife card without interview but for me they said that KCC is not providing a visa number to USCIS for me as a derivative appliant because the KCC was not notified of the marriage prior to the lottery selection. For now we have send email to KCC with the supporting documents marriage certificate, DV receipts, and wait for the response @Sm1smom could please provide me some future guidance if possible.
 
It has been almost a month since I did my biometrics walk-in but I have not received my interview letter yet. When I checked with Emma a few days ago, they said my case is currently with NBC, but when I checked back today they said the Philadelphia field office is currently processing my case but no interview has been scheduled. Does this mean that my case was now transferred to the field office for the interview and I should expect an Interview notice soon?

You’ve already contacted the KCC, you just have to wait for their response/action at this point. Give it some time for now.

Take a look at the Timeline spreadsheet to get an idea of how long on average it took other AOSers from your FO to get their IL.
 
Hi Friends. I received my interview notice but the interview time is noted as 12:30 AM! I assume this is a mistake but should I call the number on the letter and check this with them? Also, I received two separate copies of the same letter in two different envelopes! Thanks

Not sure what number is provided, but apart from that, try contacting EMMA and confirm the time. if the mistake persists, ask for a call back. Depending on the interview date, you may convince them to submit an urgent call back request. If non of above helped, and the date was close, if it was my case, I would have also tried to go there and show it to the security and see if they will let me in to fix it.

Did you get married after the DV lottery, and did you let KCC know about your AOS decision after submitting the ds260 forms?

I had my interview today. I got there 20 minutes early and there was no line. Sat at the waiting room and got called in for the interview right at the designated time. The officer said before we started that they only did one DV interview every year at this FO and he is not too familiar with it. He went through the answers in the i485 and asked to see the 1NL and DV receipt fee. He then took a look at the packet I sent in and said “I am not sure what else I need from you but if we find something we need we will send you a request to send in more information”. The whole interview took 15 minutes. I did not show any originals. One hour after the interview my status changed to new card being produced.

Good luck to everyone still going through the process, it is stressful and slow but definitely worth it. Thank you mom and Susie for all the help.

Testimonials like these make me wonder about the reason why we need to have an interview for DV in the first place. For CP it makes sense since they're admitting people outside of the US. For AOS, DV winners are already there (meaning they have already passed the vetting process at the POE) and the rest is taken care of with biometrics.

Wait, do you mean you were already married before the DV registration and your spouse did not include you on the entry form they submitted back in 2020?
When she fill the entry for lottery she was single but before the result was announced of DV 2021 in may we were married in March2021

Just got reply from kcc saying please contact USCIS for your enquiry and USCIS is saying contact KCC
