DV 2022 AOS (Adjustment of Status) Only

Hello everyone! Yesterday my husband and I finally got our green cards delivered.

Thanks to the forum for step-by-step guides and helpful advice. Here is our timeline, I would appreciate it if someone could add it to the spreadsheet:

By the way, we also received our new SSC with the same restrictions as our old cards. I guess @Sm1smom is right that there is no point to request a new SSC through the i-485 if you already have one.

Almost certainly not, even aside from the fact that should CBP figure out you plan to enter on non-immigrant F1 with the immediate intent of filing AOS they would almost certainly deny you entry.

1. Can my friend pay DV Administrative fee on my behalf with all my information on cashier's check?
2. How much time does it take approximately to get I-693(Medical Examination) completed? and how much does it cost?
3. Do I need to submit form I-765 Employment Authorization even if I already have EAD card (F1 OPT)? As I understand from the spreadsheet, if my application will be denied, I may no longer have a valid status to fall back on.
4. What's the chances my package get rejected If I send it without DV administrative fee?
5. Is it possible to complete the bio before receiving bio notification letter? Or there is only one option to walk in prior to the bio appointment scheduled date to speed up the process?

2. depends on the doctor and their availability. Anywhere between $100 to $600.

4. I sent it w/o and I was just fine. But your case, your decision.
5. No. You can try walk in after reciving the letter.

PS: do yourself a favor and read the spreadsheet more CAREFULLY.

Are you wanting your friend to pay the fee for you because you won’t be back in the country yet? Telegraphing to the IO, if you get as far as interview, that you entered on F1 with established intent to adjust status?

Hi congrats for receiving your green card. Did your status change each time? Did your status change to your card has been mailed ? If yes, how many days later did you get it?

Yes, our status changed twice: “we ordered your new card” on June 24 -> “we approved your form I-485…” on June 27 -> “card was mailed to me” on June 28. Eventually cards were delivered on July 2.

I am waiting for the last invitations from the embassy in my country. It should be on July 13-14. I thought maybe I can speed up the process of AOS by paying DV administrative fee before entering US, because paying fee can take so much time. Do you think it is better not to pay in advance?

Hi Den. Do you think that you will have sufficient time to apply for AOS if you waited 13 July? People here are very discouraging by saying that I will not have time to fill my aos. I applied to master's program in the US and if accepted, I am planning to travel. What will be wrong if I also applied for AOS, my initial intention is to study but I also can apply for AOS.

You consider people being frank and telling you there’s no way you can successfully complete the process based on your plan to enter the US in September and subsequently file for AOS as “very discouraging”? Sure, don’t listen to them, proceed with your plan.

Oh, and seeing you don’t even have the student visa as of yet, when you do get the admission and subsequently go in for your student visa interview, be sure to disclose to the CO your initial intention is to study, but you also do plan on applying for AOS when you get to the US.

What's the point of asking if you already know the answer? Take a leap of faith.

In order to know if there’s nothing wrong with your plan or not, be sure to declare it to the CO when you go for your student visa interview. Don’t conceal the immigrant intent of filing for AOS and see if you will get issued with a student visa or not. That is all I can say to this.

Hm, so you’re just ignoring the requirement of non immigrant intent for a student visa /entry on a student visa? There is nothing wrong with using your student visa for a masters, but using it with intent to adjust right after entry is ripe for a denial under section 214b of the INA, either at application or - if you are successful getting a visa (and please remember misrepresentation in a visa application/interview can get you permanently banned from the US) - on entry. If you’re denied entry you’ll also lose your visa, and depending on the exact situation could even get a 5 year ban from the US. Just so you understand what all the potential consequences are. Not sure how important doing a masters in the US is to you.

To be honest, I don't know. Anyway, I would like to take any chance to get a green card.
 
I-485 NOID after won Dv lottery
Here’s a whole story Came to us legally at the mid of 2015, j1 visa then apply for asylum beginning 2016.. For now( after 6 years) case status still shows your next step is interview. In May 2021, I found out that I won the dv lottery green card. With a lawyer filled out i485 for me and my husband. I’m mid-January 2022 there was an interview. Very nice officer asked all the simple questions same like on i485. She(officer) took my and my husband's I-94 form from the passport. A few days later, a request for evidence came with a request for a receipt for payment of the DV fee to the US department of state which is $ 330 per person (which we paid back in November). Well of course we attached the recipe and sent it right away. At the end of March 2022, NOID comes in which says that asylum is not a status and USCIS intends to deny. Has anyone had a similar experience? Is there any option to protest or open the case again. Any advises? Some forums says suggestions to go to our country and try to go through the whole process through US Consulate, but we can’t leave like asylum seekers and it is simply dangerous for us to get there plus in our country the last USA consulate was closed last year ... We live in the USA for many years we are follow the law and pay all taxes and we have here some friends who, being in an asylum status, won a green card (dv lottery) and successfully received it while in the United States and without leaving through I-485 ... ‍♀️
