What evidence do an employer need to submit for "Evidence of company's ability to pay" for I-140 petition?

-birth certificates of any children born of your union;
-jointly filed tax returns;
-recent statements for jointly held bank/credit card accounts;
-phone/utility bills in the name of both you and your spouse;
-lease/deed for real estate/housing in the name of both you and your spouse;
-insurance documents showing either party as the named beneficiary of the other;

* All documents submitted to the USCIS must be in English or accompanied by a signed, certified English translation. See memorandum with details on translation certification

My question is Can I go for Medical and Finger prints meanwhile, before getting the paperwork? I don't want to waste time from my end (As Labor itself took 3 SOLID YEARS). PLS. ADVISE

You can go for medical & get that done BUT You cannot go for FP (where would you go for FP ???).. FP is done only after you get FP notice from USCIS

My Company is acquired recently by another company. I am still working in the same job, location. Also company name is not changed. What documents will be needed for I-140 keeping this scenario in mind (for EB3). Because we don’t have Annual report with old company name any more, however I believe we still have Federal Tax ID separate from the parent company. Shall apprecaite help. Thanks
 
Need urgent advice

Hi GP111 or other gurus,

I am in a hard cituation now. My labor was approved recently with Master + 2 years requirements. But there was also note "In lieu of Master's degree and 2 years of experience, will accept a Bachelor's degree and 4 years of experience".
I have Master + 4 years, PD November 2002.

My lawyer initally told me that I can file for EB-2, but today he called me saying that he has a doubt that USCIS approves it, because the minimum requirements MS or BS+5 and I have to file for EB-3. My husband was on H1 too and laid off recently and we hoped that we could file for I-485 and get EAD for him quickly, but now I do not know what to do: file for I-140 EB-3 and wait for October 1 to file I-485, or file for EB-2.

Does USCIS give a chance to change EB-2 to EB-3 if it does not qualify for EB-2 or they just reject the whole package?

( 1) Would you please type the sample of "employment reference letter"....Well it can be written in many ways but i do not want to take risk and get RFE etc.

So i would appreciate if some one can print the sample " employment reference letter".

(2) Also, who can give this? and should this be typed on plain paper (word document) or printed on letter head?

(3) Also, do we need to add RESUME for I-485 documents in addition to employment letter and reference letter.

Please let me know asap.

I think in 3-4 months (EB-1/2) they get to Aug cases (probabley around
Nov/Dec). If no RFE there would be either Approved or Rejected. If RFE it
depends when they get the documents they want... Hope that helps.

The work experience that has been claimed on your Labor Certificate needs to be proved by providing previous employer's letter. Basically saying that you have been working in position X from date Y till date Z which com plies with what you claimed on your labor certificate from. This will be considered a supporting document for your I-140.

Plus, your current employer which sponsers for your I-140/485 has to issue a letter (preferebly company letter-head and signed by the same individual who signed your I-140/labor certificate) saying that the job will be available to you and confirms that your salary is X (above the prevailing wage and preferably the same as what has been mentioned in your labor certificate).

As far as I know, resume is not mandatory for I-485.

They check for TB (skin test), and basic tests like breathing, joint flexibility, eyes, etc.

The results take a while to come back, though.

And also, the skin test for both my wife and myself came out positive, most likely because of existing vaccination antibodies in our body. So they called us back for an x-ray just to confirm that there was nothing else and that took another 30 minutes. The x-ray results, at least on a yes/no basis, came back immediately.

Today we went for medicals and they charged 400$ for each person.

I haven't received the receipts yet. My applications were received by USCIS on Aug 9th. How long does it typically take for receiving the receipts?

There is a doctor at Fremont who will charge a basic of $150.00 if you have all the vaccination records. Usually if you don't have any records related to vaccination he charges $50 per vaccine (you will need 2 atleast). The blood test is included in the $150.00 For the TB test if you are positive then the X-Ray is an additional $60.

His name is Karim Hussain... he is a bit weird (not in any bad way.. just in general behaviour) but gets the job done and quickly. My medicals were done in 2 days (including X-Ray for my wife and my TB skin test)

At the end he will give you a sealed envelope with the originals of the medical results... and he will also give you a copy just in case.

Dude, Get a list of designated civil surgeons in here http://uscis.gov/graphics/exec/cs/index.asp. Then call them up and get a quote on 'immigration medical exam and vaccination'. Pick one depending on price/schedule/distance...
