Hi Guys,

I am new to this forum. I have just heard from a immigration lawyer said that DOL is not processing LC for IT folks because the lay offs in this occupation, so they don't believe that there is labor shortage in IT area. Is that true??? How can we find out the truth? My PD (LC RIR) is May 2001, I did not hear anything from CT DOL yet. Is it a nightmare?

Wel-Come! Wel-Come!

Jharkhandi, thanks for deciding to stay. Suddenly, things have come to life!

Welcome aboard ran123. Hope you don't run away fast :)

Anyway the latest list is:

**************************
LCVPain May 2001
avipin June 2001
Zenman - July 2001
vkml september 2001
aargee Oct 2001
lcman - Nov 25 2001
Winnie33 - Dec 2001

Jharkhandi - April 2002
Yeswe - April 2002
Ran123 - Sept 2002
****************************

Please add to list if I have missed someone.

LCVPain, Generally it is 3-5 days after you send application that you get your PD. So perhaps you have a wrong date - could you confirm your Lawyer as to what is your exact PD?

Hi Jharkhandi

I have confirmed with my lawyer that my LC (RIR) PD is May 14, 2001. I also confirmed that with CT DOL, and they said my LC(RIR) was filed on May 16, 2001. I am in IT field. Is it true that DOL is not processing IT folks's LC?

Thanks,

Don't think they don't process those. More likely - they process them with more scrutany and increased chances of NOF. At least, my lawer specifically pointed that filing RIR for IT-s now is not a very good idea. Besides, it probably depends on state too.

Hang in there, if it's no DOL you should not have to wait long...

LCVPain,

I guess Hexamon is right about NOF. But CT SESA has been pretty cool till now - I don't think you need to panic. Also CT SESA is working on only on RIR currently.

I will suggest call 1-860-263-6020 (CT SESA) after say 2 weeks or so. Just keep in mind that you don't tell them it is Your's LC - talk on behalf of your company.

whats an NOC.....and I wont run away fast:( .......

Jharkandi u seem to be the most popular person here..............keep your good work on...........and any predictions for my case(sept 2002 RIR)...........

new to this forum

Hello all,

I came to know about this message board today and it had some excellent info, and hence decided to join.

My PD is early June 2001 and last I heard from my lawyer was about a month ago and he told me to sit tight for another 3 to 5 months.

Additionally, I had asked my lawyer if CT is declining a bunch of RIR applications and according to him there is no such trend or shift in CT's processing. The only thing he did mention is that CT has been increasingly asking the applicants (lawyers) to provide additional supporting documents.

NOF Questions

Hi Guys,

What is NOF? What should the empoyer respond to the DOL for their employee if they get NOF? What will the lawyer respond to DOL for his client if he gets NOF? I know the chance of NOF has increased for IT folks, so what should IT folks do to better prepare for this situation? Please respond!!!

Thanks!

Good I like it folks - now it is indeed live thread.

LCVPain, NOF is Notice Of Findings. It is couple of questions directed to your employer. You can't help it - lawyer has to take care of it.

Request participation from May 2001 PDs

The only way we can track progress is by monitoring the May 2001 PDs. We have only LCVPain in this category.

Surely there must be many others with PDs in May 2001. I request all those with May 2001 PDs to provide their details for tracking progress....

Hope CT SESA gets out of this April 2001 loop soon....

How long it take in Bostaon Fed

Hello How much time it will take to get the labour after forwarding to Bostan Federal.

if any one knows about this please post the info.

SESA takes 6-8 weeks to forward cases to DOL after clearing it. DOL takes anywhere from 4 weeks to 6 months - average is generally 8 weeks.

LCVPain - got any lead from your lawyer?

Jharkhandi, I did not hear anything from my company's lawyer yet. It is such a long and painful experience.

guys is CT SESA sleeping............these guys have a cheek to keep working with same dates from last 3-4 months...........when will they move up from april 30 2001..................

also do u have to decide at RIR stage whether u will go for EB3 or EB2 category.or that comes at I 140 Stage..........

hoping for some activity from CT DOL this week

ran123,

Stage is Labor Certification. RIR is special provision at Labor Stage. EB2/EB3 categorization is for Labor as well as 140 stage.

Visit the site:
http://www.immigration.com/faq/greenvisa.html#418

For those lazy ones here it is:

Category is decided on Requirement of Labor Cert.

Correct me if did not get it right.
