hi jharkandi...............i dont think my lawyer specified anything regarding eb2/eb3 at RIR stage.................they just went thru the whole ad process and made me fill eta 7035 forms ...........i didnt see any classification of eb2/eb3.......

am i correct??

You filled form ETA 750B. Your employer filled ETA 750A.

In Item 14, of ETA 750A, they have to fill in Minimum Education, Training, and Experience Required to Perform the Job Duties. This decides if it is a LC for EB2 or EB3, so as to say.

But frankly there is nothing on form which states EB2 or EB3 in Labor stage.

So let me correct my last posting - EB2 and EB3 is in I140 only and ETA 750A makes a platform for deciding which one should it be in I140 stage.

Seems CT SESA is sleeping. Looks like 'Cattles have gone for bath.' (Figurative Translation from Bhojpuri: 'Gail Bhainsiya Pani Main.').

Someone please call CT SESA next week-number is 1-860-263-6020 - as the guy has almost recognised my voice now. I will start pestering them later. Any takers?

I would suggest whoever calls must tell them (they will tell 'call after 6 weeks' in a heavy tone.) that even last time you have said same.

More importantly, ask them which drug do they use for sleeping - it will help lots of insomaniacs in this world.

Update

Hi Folks,

I had called my lawyer to ask him about my H1 and I also inquired about my labor certification status at CT DOL.

Of course, he is as good (bad) as the DOL and said, "Oh! didn't we give you and update just last month" I said, yes but I am curious to know what's going on.

Anyway he called them up and said things are still stuck at April. The reason is that there were too many applications some unexected ones and there is not enough staff to actually work on cases. He did mention some of the cases from May have splipped out and have been approved (his is different from what his secretary told me last time).

Anyway I thought I'd share this, knowing everyone everyone is expected what the update might be.

I don't think calling CT DOL every week is going to help. After all they will take their own sweet time. But I also think when April is cleared things will move much faster and we will have some encouraging news to share.

Until then, keep posting even if it is about what you had for dinner last night.

Hope CT SESA finish processing April cases by month end.
 
Lets call CT Labor once each week and get to know the status and post it here. When I called, they told me that they have very few staff. Does anyone want to take responsibility to call next week? Otherwise drink beer and enjoy the time till you get your LC cleared.

LCVPain, avipin and Goingcrazy - you people can lead us thru this situation by calling CT SESA as your cases are more likely then others to have entered in their computer system. Maybe you can lead us now. As avipin called this time - will LCVPain or Goingcrazy try next time?

Anyway, I am hopeful that next 15 days will be very crucial for CT SESA and movement will begin, as they should be working with full team of 3(!!!) people.

CT LC Forever

I have just called the CT SESA to check my LC status, and the gentalman told me that they are still processing 04/27/2002 LC application. He told me to call back after 60 day for the May LC applications. My LC has filed for 16 months. It is still in CT SESA. When it will be transferred to Regional Boston? Help me, God.
 
LCVPain - you must have talked to person with heavy voice - he is not very co-operative.

I was going thru NY SESA forum and got a couple of good points - jrinny/usnycus and others posted that NY SESA is having problem due to wrongly filled applications for 245(i) and that is giving a hard time to them too.

I guess it maybe a tool to bargain for more time for 245(i) cases as most will otherwise be rejected. Maybe this is what has happened to CT SESA too.

This is getting unbearable!

Hey Guys,

I remember someone suggesting that we all write to a Senator to inform them of our misery. I think thats the only option that may help us all. I don't think moaning and belly-aching on this forum will do us any good. If anyone has suggestions as to the content of the letters and whom should they be addresssed, please let us know.

Updated 09/27/2002: House Passed Bill Expanding 7th Year H-1B Extension Eligible Aliens

The House of Representatives passed a bill as part of the U.S. Department of Justice Authorization bill expanding the eligibile H-1B aliens to those whose alien labor certification has been pending more than 365 days. Under the AC 21 Act, the only H-1B aliens who can apply for the 7th year H-1B extension are those who meet two conditions: (1) I-140 petition is filed and (2) 365 days have passed since the filing of alien labor certification. There are currently a large number of people who filed a "regular labor certification application" as early as 1998 which have yet to be certified. Most of these people are located in large states such as New York, California, Texas, Florida, etc. Some of these waiters are approaching the 6-year limit of H-1B but unable to apply for the 7th year extension because of the requirement for (1) above. The House bill which is reportedly expected to be passed by the U.S. Senate as well next week will save such labor certification waiters by allowing them to apply for the 7th year extension of H-1B so that they can complete the green card process. What a positive news! Please stay tuned to this web site for the development of this news.

Can someone put a little extra effort to frame a common mail. I would suggest making email sound more like human cause and economy of CT - that makes it more impressive then purely asking for starting of LC for us too. To add to it we can add how illegals are getting first rated treatment and we, who follow all rules suffer. It is more like bonded laborer in a free country(That line should hit.).

Where are Winnie33, Yeswe, LCForever and others - any idea?
