Just wanted to know if anyone has any idea how long does BEC/BRC actually plans to take in order to clean up the whole backlog.

I want to share a news..
Three days back i sent a email to status@DAL.DFLC.US to find out the case staus filed at NYSWA on 1st NOV ,2001.,
I thought I will receive like "case number not yet assigned" but....


The new case number is: P-05031-4****

I will update once lawyer rceive 45 day letter.,


Rajel,waitlisted send emails to status@DAL.DFLC.US and confirm Phil BEC is entering NYSWA cases in to database.,

I emailed Dalls by mistake and..

here's what I got: :(

At this time, we are unable to provide any status information on
Permanent Labor Certifications. Please contact your employer or
attorney.

Apparently both BRCs work off the same database.
Hope you have better luck

The new case number is: NOT YET ASSIGNED

The above-referenced case has been transferred to one of the Division of
Foreign Labor Certification's Backlog Processing Centers. At this time,
we are unable to provide any additional status information on Permanent
Labor Certifications. All Processing Center files are in the process of
being transferred into a new database. Once the data entry process is
completed, a 45-day letter will be issued on all applications and
additional information will be requested from the employer if needed.

Please do not request additional status information for at least 90 days
after responding to the 45-day letter.

I emailed the Dallas centre in error.
First I got a msg stating the following:
At this time, we are unable to provide any status information on
Permanent Labor Certifications. Please contact your employer or
attorney.

Then on Monday I realized I emailed the wrong guys and sent out an email to Philly. No repsonse as yet from the Philly folks.

But I got this today from Dallas!!!!!!!!!!!!!!

Yesterday I got same reply from BEC what you got earlier. I thing they didn't enter any cases in their system (CT Cases). Only God knows when we get love letter (45 days) and labor clearance. (couple more years)

Back in November 2003, I predicted that my petition would be reviewed at the state level by March 2005. Based on average processing times posted by CTDOL, it was right on target. Now, here we are.
 
This is what I got today in regards to my status enquiry e-mial.....God only knows when is our turn gonna come around.

"At this time, we are unable to provide any status information on
Permanent Labor Certifications. Please contact your employer or
attorney."
 
BEC for Connecticut

It is my guess that SWA cases will be entered into BEC systems in order of PD ( as opposed to what they did with Regional cases).

Is there anyone in this forum with PD of 2001, Regular filer (ie non-RIR)? If you are out there, please send e-mail to the Dallas BEC for status.

Philly BEC is not responding to inquiries but since they share the same system Dallas can provide status for Philly cases as well.

If your PD is 2002 or newer I wouldn't send inquiries right now.

Hello guys!

I received the same response from Philli BRC as :

"At this time, we are unable to provide any status information on
Permanent Labor Certifications. Please contact your employer or
attorney."

Now as my labor approval and green card processing with my current company seems to be impossible, I have few questions related to my situation, if someone would answer, i will really appreciate.

I am currently on my 7th year h-1(b) extension, which is going to expire after 6 months. I am planning to file my 8th year extension with my current employer within 2 weeks on behalf of my pending labor which was filed on CT SESA on July 2003.

My main concern is:

1) At this stage, am i able to switch my job to another company, willing to file my green card.

2) How the 8th year extension will work with new employer when they start processing my H-1 (b) first time.

3) What are the possibilities for filing new labor with new company, i order to get 9th year extension, because the new labor should have been pending for more then 365 days so i can get further extensions based on this labor

Please inform me with all the possible scenarios in steps, if possible.
I'll really appreciate.

Yes, It is highly risk. If change is avoidable, wait for your 8th year extension and change after approving that..

Your 8th year extension will depend upon your old labor. If your old employer with draw your labor case you won't get 8th year extension. That's why I suggested to wait for 8th year approval.

3) What are the possibilities for filing new labor with new company, i order to get 9th year extension, because the new labor should have been pending for more then 365 days so i can get further extensions based on this labor

If your new labor should have been pending for more then 365 days you will get 9th year extension other wise no more extension.. keep in mind..

Before taking any action please consult with your lawyer..

Did u see any approvals from CT on NON RIR cases.. I got below information from other threads..

Following are the recent approval data from this message board

CT - RIR - Entered into system, Dec 2004 - 2 cases approved
MA - NON RIR - Entered into system, Late Sept, early October 2004 - 3 cases approved
ME - NON RIR - Entered into system Dec 2004 - 1 case approved

So the currently what they are processing depends on

1) What state did you apply from
2) Whether it a RIR or NON RIR
3) Date when it was entered into regional DOL system.

I had sent another mail to philly backlog to know when my case was entered(if they had). I will post if i got any reply

Does anybody know whether all the cases have been entered in DOL?
