Guys,

Dont get confused, these are taken from Boston DOL tracker, this doesn't apply to CT SESA. the below mentioned statistics are Approvals for cases which are moved to Federal (Boston DOL).

ow are you doing JDK? I was travelling on work hence the delay in responding.
Your post had my heart thudding. My spouse's Labor was applied in Dec 04(RIR) and I was so happy to see that you had written that 2 of CT's RIR cases were approved. Where did you read this? or is this as the prev. post says a Regional case????

pls post details.

let's jsut all sit tight and wait. we have waited so lang a few more months / a year won't hurt. I am positive that we will all get there some day... sighhhhhhhhhhh

someone from FL SWA got the 'Love letter'

this person's PD is: PD: 12/29/2003 (RIR) Florida SWA.never made it to Regional level

So how come we from CT with PDs of Jan 2003 haven't heard anything as yet??? cause to worry????

Hi everyone, just wanted to share my news to hopefully help someone out there... I got my 45-day letter this weekend from Philly BEC! My case was still at Florida SWA (never made it to regional), so this is good news for those people in similar situation!!!

Here are case details:

- PD: 12/29/2003 (RIR) Florida SWA
- Emailed Dallas BEC on 03/01/05 for case status (using state case #)
- Got email from Dallas BEC on 03/01/05 saying no case status available
- Got another email from Dallas BEC on 03/25/05 with new Temporary case #
saying case was now at one of the BECs
- Got 45-day letter on 04/09/05 from Philly BEC with new case number

Here's my case number to be updated onto the track: P-05012-*****

Finally, some light! There were no changes on my case status since Dec. 2003 so this is VERY exciting. It shows that SOMEONE at least saw my case.

I think CT DOL hasn't done by priority date. I enclosed all labor approved (non-RIR and RIR) for years 2003 and 2004. They already cleared 2004 non-RIR cases also..

Yesterday I called to CT DOL and asked them what is the status of my case. They answered all cases has been sent to BEC.

Why our cases aren't even in BEC database?? I got an email from BEC "my case not found" in their system.

I called to BOSTON DOL and asked them what is the status of my case. They checked on their system and mine was not found.. So where is it??

Is it still in boxes at BEC centers??

Is PWD people have brains?? If data is already in the system why they need to enter manually??? Creating unnecessary back logs... I lost all my hopes...

I don't understand this JDK. Where did you get this information???
I can't believe that 2003 non-rir cases have been approved. the last time the CT DOL web site said indicated it was processing Nov 2000 non-rir cases.

also what was your rationale in calling Boston DOL to chk for your case?
Non-rir involves the employer to advertise and send results to the state before it even can move to the Regional level. correct????

pls respond. your post has me very worried.

Hello JDK98,

Please don't take it offensive and nothing against you, but please don't confuse already suffered people with wrong info.

These are list provided by department.

It contains the data available for the Permanent Labor Certification Program is for applications that have been received and entered into the Department of Labor tracking system. The data does not include information on applications pending at the State Workforce Agencies at the time the data was assembled.

Mudra, if you open any of these in MS Access and to column fifth(E) and title is "'Rec_State_Office" you can easily find that all these cases were either from 2001 or 2002.Also look at the column "'Last_Sig_Event" and can see the status of each application.

Hopefully it will clear your doubts.

I have taken (extract) data from below web site only. (2004 and 2003).
I sorted by state and extracted only CT state. Those approved labors only.

Whatever pending and unopen cases (SWA or Regional)they don't enter in their system. This is USDOL tracking system.

If you see some nonRIR cases "2004 or 2003", they already approved. Why??
That means they aren't following PD.

That's true.. without ads they can't move the case to regional...

JDK is right in getting annoyed/losing hope

I did a search for 2003, certified Non-rir cases and found 21 of them.

what is very interestignis that all 21 cases are for the position Faculty member and all are applications from Universities.

Here's my findings:

looks like the Universities had some inside leads to push their non-rir cases along.

like our govt departments in India!!!

let's wait and see. It is discouraging but what else can we do but wait.

even 2004 certified non-rir CT cases are...

from Universities and all (except one for Interist) are for Faculty Member.

shoot! makes you wonder why you didn't go work for a University instead of corporate America!

Hello Mudra/JDK,

Don't be so depressed and frustrated, let's hope for best and juz keep our finger cross and pray that all of us succeed in achieving our goals.
All of us are on a same boat, i am on my 8th year of H-1, when my labor was almost going to approve, perm implemented, all of this happening is beyond our boundaries, we cannot do any thing except wait. Just keep in touch and update each other regularly.

my spouse's company rcvd a 45 day letter on an application filed in Arp 2001 at NY SWA.
case # P05018*****
imagine after 4 LONg years in waiting....a 45 day letter asking do you wish to continue. it's so ridiculous man! if it wasn't our lives at stake it will be mildly funny !(A la TBS style!!! and we can give ourselves a giggle!!!)

Any updates or 45 days letters from BEC

Hello Mudra/Rohila,

Any updates from BEC. It already passed more than month after second shipment. (03/31/2005). Please post if you get any updates from BEC.

JDK haven't heard anything in terms of the 45 day letter.

also did u read that some of the people on thsi forum are plannign to meet in Edison, NJ this Saturday.

chk out the letter availbale at the above link ..user 'spidey' has taken the initiative and plans to send the letters to a whole bunch of people. I beleive it could cause a stir in teh right direction.

I am kinda woried - here's my situation:
my Lawyer moved to a new firm and has been taking care of all my H1 stuff. The old attorney firm that my lawyer used to work for, from which we filed the Labor, closed shop and is no longer in exisitance.
and to add to thsi my office - we moved last yr to a new office space.

So what hapepns to the 45 day resp. letter when it gets sent out.

Man I am SO WORRIED. it will be an anti climax if my lawyer/company doesnt ever receive the 45 day letter coz of an address issue.

what a night mare huh?!


do you have any idea how I can address this issue?

CT cases

Hello Mudra123,

Nothing to worry unless you changed company. Look at BEC questions, there BEC mentioned what we need to do if change lawyer or address. Ask your company people to file additional papers (lawyer changed/address changed) through your new lawyer. I think G28 papers, So new lawyer can take care those issues. Nothing to woory as long as you are in the same company.


For BEC response (what I got from BEC), please check my previous post where dotted (----) lines started and ended.

Now I am thinking to file PERM through another employer. I can't wait another couple more years. Who came to US after me they got GC.

Thanks for responding. I worte my lawyere about th address change. The frikkin idiot doesn't bother to respond to any of my emails. I guess I will call him sometiem this week and follow up.

appreciate your response. Didn't notice teh respoinse you got mentioned address change issues.

good option going to PERM.
Would you care to share info about this employer you plan to work with?
I think that would be my only other option at this time. I do know of an employer who will do it but the compay isn't strong to do PERM for an EB2.
