Concurrent Filing - Using Cross Chargeability

Question for everyone...I'm a little confused why everybody's in a rush to renew EAD's and AP's. Can we not just renew them when we need to - of course, considering we dont need them right now. Like, if I know I wont be travelling abroad until next year, can I not just apply for AP renewals next year sometime?

USCIS guidelines recommend filing for renewals six months prior to expiration of the current ones. Reasons are several. Though a vast majority of these cases are done within 90 days, delays due to RFEs and so on can push these dates farther out. They have also stopped interim EADs (although I heard rumblings about these being restarted), so if you are on an EAD and wait for a couple of months before expiry and your renewal doesn't come in, you're toast as far as work is concerned...then you need to get into the whole leave of absence stuff, which makes for a lot of stress.
As far as AP goes, if you have a valid H stamped on your passport, you really don't need one. Me personally, I don't have one, so if I need to travel for any reason, I have to use my AP.

Wouldn't you know it?! The day after my InfoPass appointment, there's a letter in the mail about the FP! :) So at least that headache is over now.

I'm going to forget about the Green Card for the next two months before jumping around for the next round of InfoPass etc. Easier said than done though :)

Yes, forgetting about the GC for a couple of months, even a couple of days, is MUCH harder than you think...we need an equivalent of the nicotine patch....

Thanks yeah will keep the board informed. It's on May 11th, so almost three weeks to go.

As far as AP goes, if you have a valid H stamped on your passport, you really don't need one. Me personally, I don't have one, so if I need to travel for any reason, I have to use my AP.

I was told by my attorney that once your 485 has been filed you should use your AP to re enter the country and not your h1-B. Using the H1-B can possibly indicate to the processing Immigration officer that you have abandoned your 485application. So just FYI guys.....

They didnt say that it would necessarily cause a problem, just said that there could be a slight chnace that the immigration officer could assume that. I didnt get into the details around this with my attorney because there is no need for me to use the H1-B once I have my AP.

But this brings up an interesting question....why would one use their H1-B to re-enter if they have AP? Any reason to use H1-B vs AP?

Some info needed: We need the date on which LC was applied, also known as the Priority Date(PD), month and year will be ok.
I-485 Receipt Date(RD) and Notice Date(ND), u should find it in the I-485 receipt notice, you might directly receive it or u might need to get it from ur attorney.

Somebody on trackitt has a post about the attorney telling that EB-2 visa # are going to run out soon and we all would be stuck in this black hole until next fiscal year i.e., 10/07......:-(((((((((
Sounds scary to me.
Anybody has a better idea of the real situation?

Hi Guys,

How does one know when Name is sent for Name Check? Does it appear on I-485 LUD? I have checked around but I don't see anywhere where one can see that FBI has received name for Security Clearance and consequently that Name has cleared. I'd appreciate if someone can clarify or advise on that.

So i received all my notices and noticed at the bottom that they are from the Texas processing center. Is there any advantage of one prcessing center over the other? Are all the apps (485, 140, AP, EAD) processed there together now?

Over, I recall you had travelled on AP, i need to use AP to visit family for an emergency..
I am carrying with me the AP (all 3),EAD, paystubs,w2,letter from hr and approved H1B too, i am on my 7th year... Is this all sufficient ?
Handover the I-94 on departure and on arrival show the AP to the immigration authorities right?. do you recall anything about filling up the new 1-94 forms while entering.,do we still go the Visa/H1B lanes upon entering...

Yes, you should be good with those documents. You will be in the same lane as Visa/H1b, and the office will send you in the room. There you would have to wait, while the office verifies your AP etc. He will then call out and stamp your I-94 with "Paroled until...." . The date would be one year from the date of your entry. You would not have to fill in the - City where visa was issued and the date issued for the visa if you are using your AP. Its a pretty smooth sail when you enter using your AP.

I mean since the I-94 status is now valid only for a year, what happens if you dont get your GC by then. I have been Paroled until Feb 08 and have not yet started to worry about it, but I guess if I dont get approved before that, then I will have to check with the lawyers on that.

Hi all - What does a LUD on Travel Document and EAD mean when tracking online? I see a LUD on travel document only. Does that mean its approved and on its way?

Just FYI...I saw a LUD on 4/19 and then another approval LUD on 4/20 for AP document.

How long did it take for you to receive the document once the LUD showed it was approved?

Yes, AP is renewable but I was wondering what happens to the I-94. The I-94 that we get stamped when you enter using AP says "Paroled until..." So does that mean when you renew your paroles, you get a new I-94 ? Or how does it work ?

They just looked at Passport/AP. I didnt need to show any other docs although I was prepared with it. You go thru the same lane and they re-direct you to another room for further verification and parole stamp.

The I-94 that they stamp says Paroled unitl.. one year from the date you enter. What happens when that date is gets over ? Assuming that the 485 dosent get approved by then, what is the status of an individual ? Since the I-94 rules the duration of stay in the country what would be the situation ?
