Concurrent Filing - Using Cross Chargeability

I140/485/ead/ap receipts

According to laywer my concurrent application filed a month back. last week tuesday when i called lawyer he said no receipts yet but he verified the I140 check has cashed and it should be coming soon. Today I have called USCIS customer service, she verified in the system, she said there is no receipt numbers yet for I140/485 in data base. But she confirm my older records such as H1 and old I140 few years back. Is it normal, does it take moer than two weeks after check cashed ? Thanks.

The I-94 that they stamp says Paroled unitl.. one year from the date you enter. What happens when that date is gets over ? Assuming that the 485 dosent get approved by then, what is the status of an individual ? Since the I-94 rules the duration of stay in the country what would be the situation ?

My assumption is that a renewed AP should cover that base as you have been offered a multiple entry renewal for another year. Sometimes people renew upto 3 AP's .If your question turns out to be an issue then I don't know what purpose would AP renewal serve.Makes sense?

Prez, I understand you have an infopass appointment on May 11th. What is it for? When you take an infopass appointment, do you have to mention what it is regarding? Pl. advise! Our papers were filed around the same date and it would be great if we could track each other's cases.

Yup, pururwa used to be a regular on the CC thread, he hasn't been for a while now, so I'd be curious to hear from him.

I actually did send a letter to the First Lady's office on Valentine's Day. I sent her a letter explaining the situation and requesting that her office intervene in perhaps helping expedite my name check. I had initially been quite skeptical of this (back in mid 2006 when this became popular), but a lot of folks have reported a great deal of success. The White House forwards the request to the Dept of Justice, which in turn sends it to the Records Division of the FBI.
As of late, a few folks have reported that their letters to the First Lady's office yielded a letter from the Feds telling them that their name checks were still pending.

My theory is that just like the WOM route, when word got out on this board, the floodgates were opened and a lot of folks sent their letters to the First Ladys office, including a couple of folks I noticed who've filed quite recently (late 2006), and are even under the published processing times. My concern is that the Feds are fed up with this influx of mail being channeled through the WH and are increasingly dismissive of such requests. This would make sense and although everyone has a right to send as many letters as they like, the sheer volume of mail, I fear, has diluted the message, thereby causing really deserving folks who've been in name check since 2005 and even earlier to get their opportunity.

Like I said, I figured a year in name check was a good time to commence my correspondence, and I did send a letter on February 14th. One other person who sent his letter on the same day received a response from the FBI (a positive one, name check cleared), but I haven't received squat thus far. Difference being that he sent it priority and I sent mine regular mail. In my reading, it takes about three months to get a response from the FBI, so I've got a couple of weeks to go. But... I'm keeping the faith.

But I am still wondering what the USCIS doing now. NC was cleared more than a month ago. Do you know if I can do something to get them look at my petition?

I haven't been visiting these forums for sometime. People with pending NCs: hang in there, you will be next to get cleared.

Long time no see. Looks like you're next in line for the approval. After Brittany's approval way back in the summer of 2006, its a welcome event.
It usually takes a few weeks after the FBI sends the name check results back to USCIS. I believe that CIS does some final background check stuff along with going over your applications to make sure things are kosher...this I believe is distinct from any pre-adjudication stuff they may already have done.
So, open a service request by calling the National Customer Service 800 number and ask them to send the service center a status check request...I am assuming its outside their processing time (?) If so, you'll get a letter stating that you should hear in 30/45/60 days. If not, then wait until you're outside normal processing times (six months). Either way, a service request wouldn't hurt...but I believe if you try to open a ticket, thats the first thing the national cust service contractors would ask you.

Not Infopass, I have an ASC appointment on May 11th. It's for my FP, which all you guys got quite quickly but took me a while to get :)

But I HAD taken an Infopass on April 19th, to find out about this FP. I just specified that I have questions about the case without any more detail. They could not help me about the FP (but luckily I got a letter about the FP the very next day), but I did find out that my name check was initiated on March 17th (and was pending as of April 19th).

So after May 11th, and subsequent LUDs, I think our cases will be on the same page again.

Oh yes, the FOIPA, sorry I zoned it earlier.
FOIPA stands for the Freedom Of Information & Privacy Act.
Its essentially a law that allows you to see what the government has on you, if anything at all. Kind of like requesting a credit report from Experian or the other credit rating agencies. Using a form available off the FBI web site (http://foia.fbi.gov/foia_request.htm), you can send that in, and request access to your records.
Note that this will NOT yeild your name check results or anything or that sort, but most likely it checks your FP records data and usually people get sent a letter that says 'no records found' or something of that nature.

I never had any LUD on mine, not even after the FP.

Oh a bunch of crazy RFE's. Lots of stuff - primarily proof of employment authorization since my wife and I listed all our campus employment and internships as well.

This is crazy man. These kind of questions are usually asked at the I140 stage.

I don't think that name check is lopsided to favor non-CC applicants over CC applicants. The FBI does not have, nor care about, case details for individual applicants such as cross-chargeability. They are not provided with that information, and even if they are, this information is irrelevant to the actual name check process. The crux of it is that, since most CC applicants are of Indian or Chinese descent (for obvious reasons - using CC to circumvent retrogression in the EB2 category), it has been my observation and those of several others that Chinese and Indians are more likely to be mired in name check than applicants of other nationalities.
The issue might be that since there are so many applicants from these nations, and a lot of them, especially our Chinese bretheren have similar names or similar names using a permutation and combination of first and last names, or even DOBs that they're likely to either be backlogged at the FBI or have a hit against some database that requires an agent to manually follow up.
All in all, its a terribly unfortunate situation, and I sincerely believe that neither agency, the FBI nor the USCIS, purposefully delay an applicants application. Its just the luck of the draw and it doesn't seem as though luck currently favors Chinese or Indian applicants.
