Guys -

I am going in for an infopass tomorrow morning at the local uscis center and wanted some advice. My last infopass appointment was an absolute waste since the IO told me that it was too early for me to "worry" about name check and hence did not tell me the status as to whether it was pending and when it was initiated. However at that time I was under the 180 day period and that’s probably why the IO wasnt very accommodating.

This time I am hoping for a little more info so any advice as to how I should approach this and what specific things I should be asking the IO?

Don't sweat it. All you need to do is mention that your AOS is over 180 days in the making and you're looking to get information on the status of your name check. They'd tell you what the status is.

Hi everyone, seems like I will be a part of the cross-chargeability club. My and wife's I-485 was accepted by INS on August 2nd, so I am awaiting confirmation.

My I-140 (EB2) was approved via premium processing in the first week of May with priority date June 30, 2006.

I plan to travel to India in January 2008 using AP. Do you think our AP/EAD cards will arrive before then, given the huge influx of applications the past month?

Welcome to the CC club! I hope that you'd be out of this club sooner rather than later.
Just for curiosity sake, what is the country of chargeability?
And yes, I think chances are that you would get your AP before Jan 2008. You don't really need the EAD by then, but I don't think that it should be an issue...even with the influx of applications. I wouldn't worry about it until December if you haven't seen any action.
I'm sure Still would add you to the tracker....unless he got approved and is on a beach sipping drinks with paper umbrellas in them.

We went for the infopass this morning at 6:30 and were out by 7:00 which is an improvement from last time around. The IO took our SRC numbers and told us that my Wife's name check has been cleared however my name check which was initiated in Jan 07 is still pending :( . I asked her if it means that the derivatives application would be approved, however she said that the application as a whole would still be pending if my namecheck is not cleared ...so oh well..the wait goes on. I remember other guys reporting the same thing where the derivatives name check was completed and the primary's name check was pending.

Iam counting on my 2nd AP/EAD to come through before Jan 08 since I have a trip to India planned in the last week of Dec. I just sent in the paperwork for the AP and EAD, so I will update my signature once I receive the notices.

This is a consistent pattern with everyone. Same thing happened to me, wherein, my wife was done in about three weeks, but it took about 15 months for me. Hang in there is all I can say. With the recent influx of applications, i think there will be a concerted efforts from all involved agencies to reduce their pending cases. The derivative won't see an approval unless the primary is done.
 
Hi,

I've just talked to my 2 co-workers who submitted the documents to USCIS. One of them sent I-140 and I-485 to Texas instead to Nebraska. Do you know if the applications will be rejected or transfered to another USCIS?

Another question: they both sent I-485/I-140/I-765/I-131 in the first week of August. Now one of them says that he included the new fee for I-140 but the old fee for I-485/i-765/i-131.

The second says that his lawyer told him to include old fee for I-485, but the new fee for I-131/i-765/i-140.

Did you include a new fee for I-765/I-131 ?

Yes, you would have to wait in the regular line after which the immigration officer at the counter will send you to the room.

Yup, made it back. Just FYI...the seperate wait was another 25-30 minutes long during a non-busy time at the airport. I can only imagine how it is when things are really hectic

I plan to use my AP in december so am a little curious as to the duration of stay that they stamp on your I-94 when you reenter. Also assuming it is for 1 year, what happens if you do not leave (and reenter) in that 1 year period and we dont have our gc by then ? Does the status remain valid even though you have been in the country more than the 1 year that was originally marked on your I-94?

a question buddy: When your 485s were transferred to TSC from VSC did your I-140 also get transferred?
Our cases were transferred from TSC to NSC. So, wanted to know if the approved I-140 accompanies the 485s to the new center.

For all EB transfer cases, I believe that the 140 would accompany the AOS case under the covers for the most part to establish basis for adjudication of the 485. I haven't seen any LUDs on my approved 140, nor did I get a notice that the 140 has explicitly been transferred, but I believe that the transfer notice of the 485 cases implicitly implies that the 140 goes with it as well, rather the records get moved. If the 140 is pending for an applicant, I am unsure what the actual status of that application would be. To specifically answer your question, no, my 140 did not move along with the 485s, but I believe that the relationship between the 140 and 485 is more of an under the covers thing.
