Concurrent Filing - Using Cross Chargeability

Still,
Don't know if this is a state-by-state thing, but up here in the northeast, your EAD card is more than sufficient to get a driver's ID renewal. The ID expires when the EAD card does, and in NH they issue you the renewal the same day based on EAD...H1-based driver IDs take 2-3 weeks to reissue. Call me this weekend if you want to chat.

Hi Ks_cc,

I dont have an EAD, Iam on H1B only. My wife is on EAD/AP.

Hey Still,

I have my h renewal stuck in VSC too arnd the same time frame.. Keep me posted if you hear anything on it..

Is getting an International drivers permit an option? You might still need a valid licence from your home country.

Cheers
Over

Hi overboard,

IDL can only be used for 100 days(not sure of this number) or so after entering the country(US). Following which one needs to have a valid US lic.
Furthermore sitting here how does one get an IDL? Iam from India. And I think I still have my valid Indian Lic. with me. I need to check the attic:)

AP and EAD Renewal

Guys,

I am wondering if I should start preparing for the renewal for our AP and EAD documents which are set to expire on 01/10/08.

The thing is, we are planning to visit India in Dec-jan and would need to ensure that we have our AP extension approved prior to leaving.

I know this might be a little early however I think it would be safer considering the fact that there would be thousands of applications filed in the last 6 weeks or so.

This would be true for all late 2006 and Jan 2007 filers i guess.

Any advise would be appreciated!

Yes, you absolutely should. I believe that they have up to 90 days to approve your EAD and AP, so that itself puts you in at the end of November (assuming everything goes smoothly). I plan to start the renewal process atleast 6 months in advance for myslef

passcore,
Ever since they pulled back issuing interim EADs, their recommended guideline is to file 6 months before expiration. Their processing time is stipulated at 90 days, but with all new applications, who knows. The 6 month thing is also bullcrap since thats their estimated AOS processing time, so you're expending your finances, but all in all, its an insurance policy.

Folks - A quick question. I am returning to the US after a visit overseas. I have my valid AP form and EAD card. Is there anything else i need to enter the US?

Thank god there was no embassy visit required this time around

You dont need anything bud. The AP form is good enough. You would be taken to a seperate room, but dont panic. Its pretty smooth. I guess its just for verifying the AP. The immigration officer will ask you to sit while he verifies your AP and will stamp the I-94 in the Passport with a stamp - Paroled Until XXXX (Dated 1 year from the date you enter). It takes about 5-10 mins and you will be out of there.

Cheers!

Since when did they revoke issuing interim EADs? I was under the impression that 90 days since your receipt date one could go to the local immigration office and they would issue an interim EAD. Is this not the case now? I have quite a few friends who are planning on using the 90 day clause given the latest flood of applications.

I140 & 485 was filled concurrently in Jan 2007.
I140 has been approved on the 3rd of aug 07 .
Can I now safely leave the company I'm working for now who has done the application and work for another company ?

Great, thanks! Do I still need to stand in the regular immigration line (which can be up to an hour long)? or can I tell someone and they will send me to another place?

Thanks

Still, I think you're looking to be approved within a month or so.

Update

Hey folks,

Quick update on my front.

1. TB Skin Test RFE Response for my wife was sent to Texas earlier this week. They should have gotten it by now. No LUDs nor email thus far. Not surprising since there hasn't been an LUD on her case since the VSC to TSC transfer.

2. We got a FP notice for her for today for code 3. This is in addition to the code 1 we both did last week. According to the congresswoman's office (who called Texas), they need her photos done again, hence the code 3.

That's about it. Don't know if you guys are keeping tabs, but TSC just went batsht insane on a flurry of approvals yesterday.

Yes, you can invoke AC-21. Its best to notify CIS of the change. You can get more information on the AC-21 threads off of the main 485 Issues thread.

I think they stopped doing that in the middle of 2006....of course this caused a great deal of furor. Don't think they ever reinstituted it.

Yes, you would have to wait in the regular line after which the immigration officer at the counter will send you to the room.

You seem to be having action on your case. You may be in for a party. All the best!

Got letters from the Congressman and the Senators office in a weeks gap or so and both indicated the same that I am stuck in the name check. I was hoping that the "in process" letter I got from the FBI by writing to the first lady's office would have changed the course in a month or two. But that dosent seem to be the case. I believe its a result of a lot of people writing to the first lady and in turn the FBI is just issuing the "in process" letter now and not really doing anything about it.

I called the NSC to put in an inquiry yesterday after the USCIS released the new processing dates. The lady told me that if you have already inquired a couple of months back, it would be the same reply if your name check is not clear. She was asking me questions related to expediting the name check. I told her its been long and she transferred me to another guy who asked me my receipt no etc and then told me am pending on name check. I told him that yet I would like to put in a service inquiry and he said that he could not do so !!!!! Wierd !!!!!

Frustrating!!!!!!!!! Wondering what to do next ??????
