More LUD changes on my 485 without any mesg change since RFE response was recieved. 06/27,28,& 30th.///

dbins, The message should state: "response to RFE has been recvd and case processing has resumed", if it hasn't already, it would soon enough. As aforementioned, if all is clear in terms of security checks, expect the AOS approvals within 60 days of them getting the response to the RFE. If your checks are clear, you might beat any of us to the finish line my friend.

Accordingly all the recent approvals practically ended as of July 1, 2007 and there will be no adjudication of any employment-based I-485 applications. For the reasons, those EB-485 waiters who fail to receive the approval notices within this week will have to endure further hardships and emotional trauma. Now, people understand what Washington did to them. Had they passed the SKIL bill, all of these problems would have disappeared. We still wonder who invented the point system that helped to induce the business community to oppose the CIR and partially killed the bill. History will tell.

Yes. There will be a moratorium of any EB based AOS approvals for the remainder of this fiscal year. Earliest we can hope for is October 2007 when the new quota is released to USCIS.
Bottomline, they fked us....dry.

How can they suddenly exhaust visa numbers for all the other countries ? Have they used those visa numbers for India & China ? What do you guys think?
 
Umm, dont they assign a visa number when they accept a 485 application? I mean, the whole logic behind when you can apply is that there are visa numbers available - doesnt that mean that if you 485 is accepted as a valid application, its already got a visa number?

Hi vik, yes that's what logic would dictate. However, I do believe that an AOS applicant is allotted a visa number from the pool during adjudication time.

Have you read this carefully?
"The sudden backlog reduction efforts by Citizenship and Immigration Services Offices during the past month have resulted in the use of almost 60,000 Employment numbers. As a result of this unexpected action it has been necessary to make immediate adjustments to several previously announced cut-off dates."

It's completely self contradictory. "The sudden backlog reduction efforts by USCIS have resulted.." - sudden backlog efforts? How are they sudden? Are we talking an earthquake or a natural disaster? How can something the USCIS does be sudden to itself? To go on, "As a result of this unexpected action.." - I dont get it. The USCIS does something and with all its vast experience, isnt prepared for .. oh never mind; what's the point.

After having slept on the events of yesterday, I've been trying to find a sliver of a silver lining, and so here it is....I guess to look at this positively, the months between July and October could be best spent by those who've been stuck in the FBI Name Check process to try and extricate yourselves from the name check bog. If your checks have been pending for a while, such as Endeavor, I'd suggest ramping up your efforts in the next three months to resolve the name check issue, so that when the quotas are available again, there isn't much standing in the way of you and an AOS approval. Moreover, since the FBI won't be inundated with new name check requests, perhaps they'd be spending the next three months clearing their backlogs. So, think positive and hang in there. We as CC-ers are definitely exponentially luckier than the unfortunate thousands of individuals who had high hopes for getting their AOS filed in July only to have their hopes be dashed by sheer incompetency (or sudden competency as the case might be). Yes, someone may have screwed the pooch, but its over and done with. Time to look ahead. I personally plan on spending the next three months doing yardwork and projects around the house. There are rumors that visa numbers have been already allocated to filees such as myself, but I don't think I buy that. So, anyhow...if anyone needs any help in clawing out of the name check process, please post your questions and/or sending me PM, and/or call me.
 
Just when I needed some assurance. October 24' 07 will mark one year since my ND and no LUD on my AOS. My wife and I went for an infopass on Monday and the officer was real nice to me. He told me that my wifes's (derivative) NC is clear and mine is still pending. He quoted "exactly" the same thing as you mentioned,"Sit Tight, cos now that the FBI has enough time to clear all pending cases they will work on your case". He went on and empathized with the current situation that everyone is facing and wished me luck.

According to AILA, people who had their PD current and the 485s pending for more than 6 months before the Jun bulletin came out, have already been assigned a visa number no matter if the background check is still pending or not. So, hopefully we will keep seeing approvals in the coming months.
 
I got two LUDs for AP on yesterday and today (07/02, 07/03) without message change (currently pending). Also today I got my FP done and by the time I come back (in 2 hrs) I see the LUD update in I485. This sounds me good so quick. What about AP LUDs - will it get approved soon. But there is no LUD for EAD. LUD for FP means the FP is cleared ??. I like this thread and ks_cc has gone through all this things. Hopes your answer. Thanks.

About the LUDs on your AP, I'd say barring a request for any more information from USCIS, you should expect an approval within a few days.
The LUD on your 485 is a good thing and its directly tied into your FP being recorded as having been done. The FP results don't take very long to be returned to USCIS and some people get LUDs after FP and others don't get any at all. It all depends (on what, only USCIS and God knows). As far as your EAD goes, it shouldn't be too far behind the AP. Given the holiday week and the recent uproar with USCIS, I'd anticipate action starting next week.

Yes, I read those reports too. However this has not been confirmed by USCIS HQ and is heresay between folks at USCIS and the AILA. Until I see some documented proof, I'd err on the side of caution. If true, this is definitely unprecedented on part of the USCIS, but what these days isn't. I'm approaching this cautiously because I don't want to get my hopes up too high. There's a fine line between balancing the stages of shock, disbelief, anger and acceptance and trying to grasp at any glimmers of hope. I so want to believe this...and the rub is whether someone at CIS HQ affirms or shoots down this rumor.

More evidence of illegality in the “update”

The “update” issued by the Visa Office yesterday clearly violates the explicit command of the governing regulations. The authority for issuing immigrant visa number is found in the statute in sections 201, 202, and 203. The regulatory implementation authority is found at 22 CFR §42.51:

§ 42.51 Department control of numerical limitations.

(a) Centralized control. Centralized control of the numerical limitations on immigration specified in INA 201, 202, and 203 is established in the Department. The Department shall limit the number of immigrant visas that may be issued and the number of adjustments of status that may be granted to aliens subject to these numerical limitations to a number:

(1) Not to exceed 27 percent of the world-wide total made available under INA 203(a), (b) and (c) in any of the first three quarters of any fiscal year; and

(2) Not to exceed, in any month of a fiscal year, 10% of the world-wide total made available under INA 203(a), (b) and (c) plus any balance remaining from authorizations for preceding months in the same fiscal year. [Emphasis added]

The annual quota for the employment based first through third preferences is 140,000 visas. Ten percent of that number, obviously, is 14,000 – less than one-fourth the number (60,000) of visas handed out by the Visa Office to the CIS. This is clearly an illegal allocation of visas, as commanded by the lawfully promulgated regulations.

Yes, you will see an approval within the next few days (and I am sure its already showing approved online). The EAD is seperate and in my expereince will lag the AP by 2-3 weeks. Yes the fingerprinting LUDs are reported right away, and some folks even get another one the day after (maybe thats the results of the FP)
