Concurrent Filing - Using Cross Chargeability

I got an RFE for an I-94 which i had submitted when 485 was filled, you have to submit the latest/current you have when u file your 485.The only reason I can think of why an RFE was issued was I had changed jobs around that time.
the reason they gave was the I-94 copy was not clear enough...
Dont worry too much...now on this...just make a good copy of these
documents till you get your GC...just a good practice.

You're right, it is a good practice to keep everything. A friend of mine has even kept all his international airline ticket stubs for the last 5+ years. You never know what USCIS may ask for!!
 
multiple luds'

Got back to back lud changes on two consective days without any mesg change
after receipt of my RFE response...Is this the normal pattern after an RFE is responded? Any thoughts any one..

Do you mean you got an RFE for all your I-94s since you came to the US or only for those after 485 was filed?

Also is this common (to get an RFE for I-94s) ?

Are there others like me, who don't have copies of all their I-94s?! In some cases, I travelled out of the country within a few weeks on business and I definitely know I do not have copies of all I-94s.

I finally see a LUD for my I-140 3 months after filing (AP and EAD are approved). However, the message has not changed online. Does the LUD indicate that approval is coming soon? can there be multiple LUDs over a long period of time for a 140 case? I ask because I know the 140 needs to be approved before 485 is approved

For my AP and EAD, I had gotten 2-3 LUDs within 2-3 days and received an approval a few days later. Is it the same with140?

Hey guys...sorry I checked out for a couple of days...had an interesting meeting with my congresswoman's director of constituent services yesterday. We've been corresponding for months, so figured it'd be a good idea to have a meet and greet. She was absolutely fantastic, and I am not sure how many other individuals are lucky enough to reside in congressional districts where the staff just chill with you for over a half hour while people from DC in the GSA are walking around taking audits and stocks of govt owned inventory. Very cool.
Nothing earth shattering coming out of the meeting I'm afraid. She had put in an inquiry on my behalf earlier this week and we're awaiting a response on that. Apparently the Service Centers are also getting additional help to deal with the tsunami of fresh applications they're going to be starting July 1st. She conceded that existing applications might experience delays due to the influx of new ones.
Prez, to respond to your question, yes the current I-94 should be ok, but I think I saw an instance where CIS asked for older ones...shouldn't be a biggie, so don't sweat.
 
Hey Still, I'm just about ready to send a FOIPA request as well. Thanks to ks_cc being so active, this place is awesome - I've written to the First Lady, a Sentor and a Congressman. This is getting nuts again and its not pretty. Wonder if I should write to Cheney :D

Hey vikram, can't hurt. Remember that out of all the WH delegates, the First Ladys office is the only one who sends it to the DoJ/FBI...the others, the office of the Pres and the Veep, send it to the DHS...which doesn't really help much, but I bet it does in the end result....

dbins01, Its very normal. The message will change to read something like "RFE response recvd and case processing has resumed...blah dee blah". The coolest thing you're going to read on there is something stating that if they dont need any more stuff, you should expect a decision within 60 days...and guess what...if you're name check is cleared, then within 60 days you could be caressing that wonderful piece of plastic we all so desire.
Yeah...little early in the day to state that you'd be "caressing" something, but hey, I dont know about you guys, when I get the cards in the mail, everyone better give me some privacy...just me and the card.

Yuppers, very good thing. Your 140 has been picked up for processing. You may not see any message change. Unless they issue a notice for requesting more evidence (this would be an employer thing), I'd expect an approval around the corner.

With regards to I485 processing dates, I think it is going to go back atleast to Jan 2006, come August - because of the multitude of applications that will hit them in July. I hope ours is one of those cases, which get approved independent of the I-485 processing dates.

.. since you and I have very similar case details, I am wondering what your plan of action is?

Here is what I am thinking right now :

Wait till mid July or so; then take another Infopass appt. to find out about name check. (I've called NSC a couple of times, but they wouldn't tell me the status of namecheck on the phone)

If name check is clear, then wait till 485 processing dates at NSC go 30 days past RD (which makes it early April 07), and then issue a service request to find out what's going on.

If name check is not clear, file FOIPA with FBI. Once the report comes in, write to Laura Bush, local congressman, ombudsman etc.

I heard back from my Congressman, to quote -

"I have directed an inquiry on your behalf to the USCIS and the FBI regarding the problem you described to me. As soon as I receive a reply, I will contact you. In the interim, if you have any questions, please contact ....."

I dont have any expectations that my name check will magically clear but at least its nice to hear from someone official with promptness.

Spouse's Name Check cleared: Signature updated

We checked my spouse's name check status today through an infopass appointment; Her 'name check' has been cleared as of 04/04 (FP was done on 04/03); That explains 2 LUDs for her case after Finger printing while my case just had 1 LUD after Finger printing. My NC clearance is still pending.

I asked the official if she would not get her GC until my NC is also cleared; To that she indicated that it is not necessarily the case. According to the official, a dependent can get the GC even if the primary applicant's GC is pending. I am not sure if the official is right about that. I asked her if there is anything that my spouse could do, to expedite her GC approval, to which the official asked us to initiate a Service Request with the Service Center. I know that the service center will not initiate a service request until the processing date reaches 1 month after our receipt date, which is Feb 28, 2007.

yeah I intend to do so in the next couple of weeks. Can't hurt to make an Infopass appt, so I'd advice you to go for it as well and find out your name check status.

At least your wife got her NC cleared! That's great! I hope yours happens soon too.

I hope your two LUD theory implying NC clear is correct buddy. My FP was on 05/11, and both me and my spouse had LUDs on 05/11 and 05/14 (see my sig). I'm not trying to get my hopes up, but if the 05/14 ones correspond to name check, I'll be very pleased. Will try to find out with an Infopass appt. soon!

Dont know how far this is true!!!

Could be good news for people whose EB based AOS applications are in the pipeline waiting to be adjudicated and bad news for people hoping to file in July.

We are hearing from multiple sources that, on Monday or Tuesday of next week, State Department plans to issue a revised Visa Bulletin for July 2007.
This revised Bulletin would retrogress some or all of the employment-based
categories, very likely to the point of unavailable. Reports from AILA
members about unusual levels and types of activities by USCIS indicate a
particular push to adjudicate employment-based adjustments currently in the
pipeline so as to exhaust visa numbers for fiscal year 2007.

This follows the actions of USCIS in June, when it began rejecting EB-3 "
Other Worker" adjustment applications even though the Visa Bulletin showed
an October 2001 cut-off date, on the basis that the "Other Worker" numbers
for the year had been exhausted.

While it is very much likely that all the categories would go back to "U" as you pointed out (bad for us); at the same time it is quite possible that USCIS would start rejecting applications of people who file in July even though their dates are current.
It would be ironic if USCIS continues to accept applications in July if the visa numbers for year 2007 are already exhausted.
 
If this news proves to be true next week, I feel really sorry for the multitude of applicants whose hopes were taken for a royal roller-coaster ride.

With regards to the visa numbers being "Unavailable", I do not think that it would happen for the "Worldwide" numbers. I think, the India/China and possibly Mexico/Phillipines may get retrogressed.
