Can I move out of the US with a new baby?

Hello,

My husband and I are both Canadian citizens. We moved to the US for work (TN and H1B visas) two years ago and plan on moving back to Canada in Feb 2012. We are hoping to have a very young baby in tow with us at that point.

I am wondering if anyone knows whether or not we can move out of the US with a 1-2 month old baby who will have become a US citizen because s/he was born in the US. I heard from a friend that any baby that becomes a US citizen must stay in the US for 3 months after s/he is born.

I am just trying to figure everything out and I'm having a very hard time finding this specific information.

Any advice or help is very much appreciated!

Your US citizen child can leave anytime. Check with the Candian authorities about any travel document might be needed. The child should be a dual US and Canadian citizen.

No, absolutely not, there is no such rule. I wonder where absurd and ridiculous rumors like this one come from. You may leave any time after the baby is born.

There is no general rule like that. That probably was a particular case of a baby that wasn't healthy enough to withstand the rigors of international travel, so the doctor said to wait 3 months.

Still, although there is no general rule like that, you need to plan for the possibility that the baby (or you as the mother) may be medically unable to travel for 3-6 months after the birth.

I found out that I will need to apply for the baby's Canadian proof of citizenship and passport after s/he is born so I can take him/her across the border when we move.

And a US passport, so you can take the child back to the US in the future. US citizens are supposed to enter the US with a US passport, not a pp issued by Canada or anywhere else.

These rumors probably come from the same place as "if you call to inquire about the status of your application too much, they will initiate additional name checks on you". Yes, I've actually seen something like that posted here a couple of years ago.

It's impossible to tell from your post if the baby will be your own. :) With your own baby, you should have no restrictions. If not, well, . . .
