wheremylc.. You can get your H1 extension for 3 years since your 140 has been approved. check this link : http://www.immihelp.com/visas/h1b/beyond6.html#Scenario1

Bio metric: code 3- 10/02/2005 (me & wife)

I-485 LUD: 10/4/05 (self)
I-485 LUD: 10/4/05 (wife)

AP LUD: 09/14/05 (wife, approved)
EAD LUD: 09/21/05 (wife, approved)

11/07/05 - calles USCIS and started enqurity on I140 and it
takes one month to get the feedback)


Any one knows why delay on my I140?

Wow..what a news. I never expected this much faster. I am holding PD of March 1999 under EB3. I am very close to 485 approval dates. My details are found below.

140 is not yet approved still :mad: . I have been waiting for the last 5 months eagerly. Can anyone tell me - is there any chance to approve I-485 without I-140 approved? Please guide me.

Not sure if 485 can be approved without approved 140 but I do know even it is, it wont amount to much.
See the purpose of this process is to ensure that there is a need for your job and that a US resident/citizen is unable or unwilling to perform (labor cert)
Then the 140 proves that your employer can pay your promised wages AND you have the qualifications that your employer said they couldn't find in the local market.
Finally 485 is just an adjustment of status including security checks to make sure you're not a terrorist or criminal...
Unless the 140 is approved, thereby proving your eligibility there cannot be a employment based immigration number given to you....

And I dont mean to be personal when I say "you".... of course this applies to all of us.

There have been a few cases where 485 was approved without I140. You have to search, if I recall, the 2004 thread. Both mine were approved the same day.

Sree2005: There is also the possibility that both I140 and I485 will be approved at the same time. It happened to 2 people I know.

Just an update: I had an LUD on 11/11/2005 but without any message.

When you got LUD's on I-140 , did you receive automatic emails or you went and checked it on the Online status ? I got lud on 11/09/05.

Thanks for your reply. I got one LUD (07/01/05) on my 140 but no msg change.

one quick question, I never mentioned (at least I haven't seen) in 485 application about labor PD. I heard that if PD approaches for visas availability and 140 is not approved, 485 pushes the 140 to approve it first and then 485 later. Is that true, how that happens since 485 doesn't contain the PD info in it?

Hi Sree,

Congratulations on your I-140 approval. Being a Substitute Labor you must be very pleased. I have a question for you ? I see that VSC is currently processing 485 cases as of Dec 1 2004.
Your PD is March 1999 and your 1485 application date is June 2005. Assuming that the PD move to March 1999 next month, will your case be taken up even though VSC is processing only DEC 1 2004 cases.

I don't the time lines mentioned in USCIS site are valid for 485 applications. The new approach (retrogression concept) approving 485 applications follow this info: http://travel.state.gov/visa/frvi/bulletin/bulletin_2744.html

Currently 485's are being approved prior to Jan 1999 cases under EB3. I need to wait until my PD(march '99) matches the visas availbility dates (hopefully in Jan/Feb 2006). Hope you are clear now.

Regarding my 140, there has been no LUD after the first one on 9/24 after the notice date. Wondering whats happening with it.
