AP is Advance Parole, it is a travel document you can use to enter USA from outside if you have filed for I-485 and do not have H1 stamping in your passport.

EAD is Employment Authorization Document (also known as work permit), which can be used to work in the USA if you have filed for I485.

Both EAD and AP have to be applied for separately, when you apply for I-485 or later.

Experience Letter

Pardon me since this question is not directly related to this thread but there are some gurus in this forum who could advice me so I am posting here.

I am planning to change my job and want my new employer to file for my LC after Jan 1 2005. I have some issues with my current employer and when I quit there are possibilities that the parting may not be good. My fear is that my current employer may not give me the experience letter and even if they give they will definitely not write what I need for future LC. I want to apply in EB-2 catagory.

What is the risk and what are my options? I appreciate your expert advice.

To safely use Act21, your 485 should be pending for 6 months and your 140 should be approved. Now I know of people who have used Act21 before 140 approval too. The good news in your case is that your 140 is approved. Negotiate with your previous company to continue the 140 and not withdraw it. You can join another company using Act21 and inform USCIS later, preferably after 6 months of filing. That would be your best bet! Again, check with your lawyer too.

Hi,
I was tracking the filings from last year(2003) and the immigration processing times that got changed in last month (oct 6 updates processing Nov 2002, Oct 22 updates processing June 2003).
The consolidated tracker for 2003 in this time duration has eighty 485 applications. This mean they processed 80 applications with in 15 days period. The remaining are 200 (2003) + 270 (2004) =470 Applications.
If they process 80 Applications per month, ours (2004) will be cleared with in next six months or earlier if processed in the same pace.

So enjoy folks. Be ready for FP and approvals.

No offence, but these calculations are totally off, reasons:
1> Our consolidated trackers do not reflect the whole universe of 140 and 485 applications at VSC.
2> When VSC says they are processing 485s from June 2003, does not mean they have processed all prior 485s.

If you want more explanation on these, please start a new thread and PM me.

Your situation seems to be the same as mine. But I did get my FP done. I have asked my company to call INS and enquire for details. Can someone else who had been or is in similar situation reply back with comments ....?

FPs moved upto March end 2004 ????

I am observing that the Notice Dates upto March 31st 2004 are getting FPs both in EB2/EB3. If you look at our Tracker majority of EB2 before 3/31 have received/completed FPs. And around 50% of filings upto 3/31 in EB3 have also done it.

Going by the trend I feel the proposed EB3 retrogression in January 2005 will start around the cut off dates of 1st April or so and applications after that may have to wait longer :(

EB2 applications before March 31st and who completed there FPs and haven't received I-140 approval yet may get I-140/I-485 approvals concurrently soon. Trying to see an approval in that direction, don't see any yet.

Lately, things have slowed down on approvals/updates. Is USCIS slowed down? Guys/Girls please submit updates asap!

Just my thoughts!
 


We are not tracking dependents' information in this tracker.

Also, you added an EB3 record in the EB2 section, formulas are missing, and you changed the name of the file.

Do you have a separate record in the tracker for yourself ?
