I have my own I140 scanner that I use to run stats on all I140 cases with a case number of EAC042665XXXX.

Something very wierd happened today morning.
The stats in the quote for EAC04266XXXXX were run on 10/24. I ran my scanner again today morning. I got 44 approved cases. I changed my code to include some more data and ran a STATUS UPDATE on all the I140 cases and I got only 35 spprovals. I was stunned (how can the number of approval cases go down). I cleared my IE cache and ran a STATUS UPDATE again and this time I was shocked ... there were only 25 approvals. In a span of 1 hour, the number of approval cases changed from 44 to 25.

Can anybody throw some light on this. Are the guys at VSC making mistakes in the I140 approvals or are there system buggy or the approvals being reverted by higher authorities?

Any comments.

i think VSC are doing some case randomly
one you get 140 appoved email and then changed to previous,it happend to one of my friend
and when he called customer service they told if you got email confirmation that 140 got approved then it approved

I went today to the Alexandria, VA , ASC, was informed they do not do early FP. I was asked to come on the scheduled date.

I scanned the tracker and did not see a single record were someone has just applied for I-140 and not I-485.

i.e. potentially looking at doing Consular Processing.

Am I reading the tracker incorrectly?

How to ovecome future salary

Hi all,
This is my short story of a big story… Applied Labor in 2001 with one company and in 2003 this company was bought over by another company and labor got approved 2004 May . Before the new company apply for 140 they found there is a 15% different in current and future salary that mentioned in labor certificate. So this can cause RFE on my 140 and 485 application .. so company decided to go ahead with 140 and 485 separate filling . 140 got approved two months ago.. Now the new company hesitates to apply 485 because they might end up by paying 15% more once I get my 485 cleared.

Here is the question … Did any one know how to overcome this situation ? Did I get RFE if applied with the current salary ? Its a public ltd company so all accounts are audited.

Any help will be appreciated…

eternal_labor, if you have a good excuse, why you can not come on scheduled date, for example avia tickets, etc. bring them with you, it might help

You Lawyer must have received the notice, and he will send you the notice via mail soon. (Make sure you get it before you go for your FP)

No you are reading it correctly, most people go the 140/485 route as this gives them portability using Act21 etc. If I recall correctly, there's a separate forum for CP, maybe you will get more answers about CP there. Hope it helps!
 
Priority Date for I485

I just got my I140 approval. The priority date on the approval is Dec 16, 2002 (which is the day my labor was applied). I see that the date vermont service center is presently processing to be June 2003. The date got advanced from Nov 2002, in the past 2 weeks to June 2003.

Can someone comment on what this date means. Is it the priority date or the date on which VSC recieved the I485 application (in my case that would be Feb 26, 2004)?

This is the date when VSC received I485. But the question is, is this date a credible date. Have most of the guys before June 2003 received there I485, and what category does this date apply to (EB1, EB2, EB3..). It is not very clear currently. If anyone has more info. please post.

My case is an EB3 category. The reason I am interested to know about my 485 approval is that recently, I have had an interest in a company in California and I would like to join them full time.

Now that I have my 140 approved and its been over 180 days since my 485 was filed (Feb 26, 2004), what are the advantages/disadvantages? Will my case be actually moved to California, if I actually change? Will this have any effect on my wife's 485 application?

My company is in CA but my case is in VC. So working in CA does not need the processing to be done in CA.

I would suggest you talk to the "new companies" attorney in detail about the possibilities. Since the Attorney is the person going to process your case he needs to be convinced he can make it work.
I have not seen any posts with experiences on AC21 on this forum, so there is not much of information on that around here.
