2004 Consolidated Tracker ONLY (140/EAD/AP/FP/485)

I-140 Approved in 41 days.

Please update the tracker with following information.

1. 140/485/131/765 RD: 09/13/04 and ND 09/16/04
2. RFE's for 131/765 on 10/12/04 for Photos
3. I-140 AD 10/27/04 no RFE
4. Now waiting for 485.

Not many people have experience in it and it is not very clear weither it applies from the date of filling I140/1485 or from the date of I140 approval. If I were you I would just check with the lawyers before any move.

Its date of filing of 485. No where is I-140 mentioned in the 180 day rule. There is no scope for mis-interpretation.
 
newbie to this forum.. question on reciept notices

Hello,

wondering if beneficary will get i140/485/EAD/AP filing reciepts or the lawyer.

Papers filed last week, will update once i get the actual dates.

Hi Kosmo,

I filed last week too, looks like attorney gets receipts and forward them to US( only 485/EAD/AP). by default 140 receipt seems to belong to Employer than us. I think we have to request that one from employer.

Let us hope for the best.

Hi,

I got fired after four months of applying I140 and 485 concurrently.
Mean while my 140 got cleared before firing.

Does my 485 valid still?.

To safely use Act21, your 485 should be pending for 6 months and your 140 should be approved. Now I know of people who have used Act21 before 140 approval too. The good news in your case is that your 140 is approved. Negotiate with your previous company to continue the 140 and not withdraw it. You can join another company using Act21 and inform USCIS later, preferably after 6 months of filing. That would be your best bet! Again, check with your lawyer too.

you will get different receipt numbers for different applications

For each stage for example EAD- one receipt number

Ap - seperate receipt number

I-140 - seperate receipt number

I-485 - Seperatereceipt Number

And also for your all depends, they also get different receipt numbers for different applications.

Question - Multiple 140s

I have already filed for 140/485 From VSC in April 2004 from another company, its labor Sub - EB3. I am not employed by them.

Lately my Labor was approved for the current employer. Can I file for 140/CP
with this labor in VSC.

My lawyer tells me if I file another 140/CP, Then my previous 485 will be rejected/terminated.

Please help.

Congrats on NY Labor !! Most of us like Bill Clinton. But he in reality, is the one who did the most harm to us by deciding to give Illegal immigrants first preference over legal ones.
