140 tracker for EB2 , premium processsing

My I-140 application also got converted to PP on 19th and i got 5 emails from USCIS that my application is converted to PP. My LUD is of 20th and nothing after that.

Does anyone know pattern of LUD's for PP application? How many days USCIS is taking to approve PP cases?
 
no LUD today

same here, my application was also converted to PP on oct 19, got LUD on 19 and oct 20th, nothing after that.
hoping something will come through this week
 
check cashed

uscis seems to be very quick in cashing the check, check for $1000 was cashed today. but no decision as of yet.

This is a pleasant surprise for me this morning. I got the emails saying that my 140 is approved today. Also, I checked their automated phone system to confirm this approval. Thanks to all of you and Rajiv for creating this wonderful support system - first during the Philly BEC mess and now during NSC 140 process I have been here all along.. Now, one more step to go.. Good luck to all of you!

Yeah, I did. I was shying away from talking about my 485/EAD/AP/FP.. I wanted my 140 to be approved before talking about AOS stuff.

We, my wife and I got the code 3 FP notice and got it done around Aug 10-15, 2006.

I'll update my signature soon, after checking the accurate dates on my EAD etc. Thanks and good luck to all!
 
is premium processing make approval difficult?

Do the premium processing of I-140 and regular processing use the same standards in adjudicating a case? I heard rumors that it is more difficult to get approval in premium processing because USCIS either approves or denies a case in the 15 days, without RFE, etc. Is this true?

There does not seem to be any proof of that. I too was skeptical based on my lawyer's input on H1b, but for 140, i think it's just a rumor.

Confusion on Availability of Substitution I-140 Premium Processing for Holders of Original Approved Labor Certification

We reported earlier that the USCIS had initially blocked any substitution I-140 cases from the premium processing eligibility. But later the USCIS website changed it and has been reporting to the people that if the substitution I-140 petitioners submit the original of the approved substitution labor certificatiobn application, they will be eligible for the premium processing services. The USCIS information on ineligible cases is as follows:
(1) A second filing of a Form I-140 petition while an initial Form I-140 remains pending;
(2) Labor Certification substitution requests, unless the original labor certification is submitted with the Form I-140 requesting the substitution; and
(3) Duplicate Labor Certification requests (i.e., cases filed without an original labor certification from the Department of labor).
After we reported such website instruction changes, we received some reports from the readers that the field offices were unaware of the policy change. We urge the USCIS HQ to give a guidance letter to the Service Centers on this change. If the website information is incorrect, they should correct the information not to mislead or confuse the consumers
 
RFE in PP cases

Does anyone know how long it takes to get RFE to lawyer? I have applied in PP and today i got 3 emails from USCIS that additional evidence/information is required. When can i expect my lawyer to have all information. The email doesn't mention the type of RFE or anything more.

My case is EB3/Applied on Oct18th.

My case is EB3/Applied on Oct18th.

they Normally Fax RFE to your lawyer so by now your lawyer should have it. when did u get the emails?? does it show LUD of today or yesterday??

I got the emails today and LUD is also of today's.

Did you get your receipt number? I applied in PP on 10/25/2006. How can I get emails from USCIS without the receipt number?

Takes few days

Hi Jack_xie,

It looks like you had just applied on 25th. After they receive it takes a few days to enter the data into the system and issue a receipt notice. After that you can keep track of the status online. From the date of the receipt they issue a decision in 15 calendar days.

"I-140/EB-2" should be OK. It's just my thought. Ask your lawyer if possible.

Hello all,

I just wanted to share my happy news with all of you that my I-140 (EB2) has been approved. It was filed based on my approved RIR labor certification via premium processing. It was approved in 2 days without any RFE by USCIS Nebraska Service Center. I-140 Receipt Date: Oct 25, 2006 and I-140 Approved Date: Oct 27, 2006.
