    I-94 stamping/Passport expiring

When I was coming back in July of 2002, my I-94 was stamped for the validity of my H1b (till June 2004) even though my passport was to expire much earlier (June 2003). I don't think you should worry about it.

    Apr 2002 approval

Re: Thanks, Frodo They do it because the process takes so much time and they want to make sure that you are still employed.

    my take

Dadagiri I think you are confusing the meaning of the word "backlog." To quote a dictionary backlog is "An accumulation, especially of unfinished work or unfilled orders." Hence, even if NSC processed only 2002 cases they would still be reducing the backlog as long as they processed more...

    Withdraw 140/485 possible?

Employer cannot withdraw I485 because the employer is not the one that filed it. I think even if the employer asks the attorney to withdraw it, the attorney will have to get your permission first. IMHO, the best way would be to hire another lawyer so that s/he requested all docs from the old...

    I485 pending & Marriage

In addition to other comments, immigration attorneys say that if you already have GC and want to sponsor your spouse, it is usually faster to wait till you get your citizenship. This implies that such case can take 5-6 years. So, you should file I485 for your spouse as soon as possible.

    help me pls

On a side note, the processing date for asylum cases in NSC is November 16, 1999. Thus, they may be saying that you should wait until your RD is 30 days after official processing date before they can initiate an inquiry. I may be wrong but I think someone on this forum with EB case was told...

    GC and F1

From what I heard, lawyers do not recommend switching from H4 to F1 while GC is pending. When applying for F1, you have to prove that you will be returning to your country. So, if they find out that her spouse (i.e. you) applied for I140 they may consider it as an immigration intent and deny F1...

    Travel:I94 surrender

New I94 replaces the old one. It also invalidates the previously issued form. You should submit your new I94 to prove that you are not overstaying in the US. Theoretically, they may not request I94 in the Consulate because it's supposed to be surrended when you leave the US. However, I'd...

    Husband (dependent) canadian citizen

Unfortunately, yes. This will cause a problem because I485 is a status adjustment process and it requires applicant's presence in the US. Those who are not present in the US must go via consular processing.

    New NSC processing Times

AILA shows the report dated Nov 15 while USCIS shows the report dated Nov 14. Hence the difference.

    I-485 Interview

Hmmm... May be you shouldn't blame the doctor though. I have an allergic reaction to the TB test. So I did an X-Ray at my doctor's along with all immunization and brought everything to the immigration doctor. Though she said that she never heard of allergic reactions to this test (makes me...

    Urgent - AC21, please assist...

One more thing. If a lawyer was involved (the lawyer's name would appear on I485 receipt), your friend can hire a new lawyer. Then the new lawyer can request all documents for your case including I140 receipt from the old lawyer and s/he will have to release them. I think it's a law. Even if...

    Processing Times for NSC updated

Backlog cleared by 2015? No. But they will need to build a new storage facility. Perhaps, it's their weird way to save on TP?

Don't you need an address in the US to continue with I485? If not, CP is required. That's what I thought. If his case has been pending for over 180 days he can freely leave and find a different job. Is I140 approved at least? If so, after 180 days, it can't be revoked. I think it doesn't...

Changing Job After 180 Days Using EAD

Acording to my lawyer, there is nothing that you need to do immediately. Your new employer should be willing to provide USCIS with letter that proves a permanent job offer and other documents if (or rather when) RFE is issued. The job must be in the same field and preferrably to have the same...

    Change of Address Issue

Oh, I forgot to add. Mail forwarding may not work for USCIS letters. Some post offices don't forward such mail. I think it's safe to change addresses and it shouldn't disrupt anything. On the contrary, you can get into troubles if your old post office is strict about forwarding rules.

    Change of Address Issue

By law, you must notify USCIS about the change of address within 10 days of the move. If you don't USCIS may claim that you are trying to commit a fraud. Smitha, talk to your lawyer again and mention the law (AR-11 10-day requirement). Ask what repercussions might be. May be the best way...

Job in NSC Service Area and live in VSC Service Area ?

You must file AR-11 whenever you move regardless of your status and destination. You also need to update all your cases that are pending with USCIS either by calling them or sending them another form. As far as I know, cases are filed in a service center that corresponds to the employer's...

    RFE documents Question Please help

It says "may include" not "have to include" or "must include", so I think it means at least one of those docs. IMHO, if you submit W2s, pay stubs, and tax return you should be fine. If you think about it, all those documents are redundant. Say, why are pay stubs needed, if W2 shows your...

    Address change

I think you can do it by phone. I did it this morning and I was told that they would update my case. Anyway, my lawyer told me just to file AR-11 and call the customer service to update the case.
