Hi, first of all want to say THANK YOU to all people who advised to file Mandamus, I read EVERY post here from 2010 and this helped me a lot!

03.2023 Tried to add spouse to my case but it was lost, I knew about this only 11 month later!
09.2023 Applied for 1st EAD for spouse
11.2023 got denial for EAD for spouse
Moved back to Miami
02.2024 Second attempt. Added spouse to whom I married while waiting for decision
03.2024 Fingerprints for spouse
03.2024 applied for 2d EAD
03.2024 applied for 1st EAD second time for my spouse

Sent 4-5 requests by myself and with the help of my lawyer, went to the office several times.
Also I changed attorney because the previous one asked 7-8k for Mandamus and new one 3.5k +405 filing fee.
Requested FOIA several times where I saw assessment to grant.

I saw every update in status in case tracker

Decision was mailed (30-45 min)
Fee were waived (2 hours)
Case was updated to fingerprints were taken (2 hours)
New card is being produced (3 days)
Card was mailed to me

I could add my case in USCIS account only next day after I saw update about decision!
So first hour was scary because decision was mailed and couldn’t add my case

New EAD validity is for 5 years

The mail with approval notice came 2 days later but USPS required signature so I wasn’t at home and picked it up next day in USPS office.

EAD came to my spouse 1 week later after status update
EAD came to me 2.5 weeks later after status update

After every interview got pick up notice to come back 2 weeks later but both times got a call 1 day before pick up day and got information that decision would be mailed

Also wish everybody who is waiting for decision to get approval in the nearest time.

If you wait for decision for more than 2 years, sent requests, your case is strong (and especially if you see good assessment in FOIA) and you have money then 100% file Mandamus.
what info you see in FOIA? Assessment- is it your asylum case notes or assessment?
 
I am trying to help a friend; wondering if anyone applied Asylum online and how was the experience? Should we prefer filing online or paper mail?
 
did you apply this june 2024? You got interview in September. Really? Ppl are waiting few years to get the interview?
My time line as below.

June 16th 2024 - asylum application submitted
Mid of July 2024 - Biometric done.
Sep 6th 2024 - interview done
After that status is decision pending and today status changed to application is pending.

Dec 2nd 2024. - I submitted I 765
Dec 15th 2024 - EAD approved
Dec 19th 2024 - card was produced

Do we have such rule currently to apply GC before 1 year?
Yes. This rule was implemented in Feb 2023, now my concern new administration may overturn to the original rule that you must file after 1 year. At the same time, I am hesitant to file too early to avoid denial or premature approval of GC. Per my lawyer I should file after 6 months to reduce such risk which would put me in March 1st.

Hi, even if 1 year rule will return, why are you afraid of it? Just 6 months more and no risks

6 months saved time would definitely help, imagine if file after 1 year and need to wait for 1-2 more year. It's been 13.5 years I have not seen my family and I would like to see them in a third country, at the same time don't want to risk it before getting my GC. I hope now you can understand my situation.

If that’s the case, you can consider applying now. In the worst-case scenario, you might lose the fees, but not the time. If your green card is approved with early date then you can immediately use it to visit your family and later address any discrepancies by ‘discovering the mistake’ and requesting a correction. If questioned, your response can simply be, ‘I was unaware of the one-year rollback and trusted USCIS.
And I still believe that case will be in line or on hold instead of denial
Also if you like old version of form I-485 then it makes sense to apply before 20 January because USCIS will stop accepting it since 10 February

Are you sure that it will be denial or USCIS will put case “on hold” till 1 year pass?
If your lawyer has clients with denials because of 1 year rule or approvals of GC with date of issue earlier than date of asylum approval?
Or is it just possible theory?
I read strange things that you should prove that you will live in the USA for 1 year after approval at time of adjudication (which is in the future), so lease agreements, bank statements can prove that you don’t plan to leave the USA for long time
I'm not sure that it will be denial. That's the information I've heard from lawyers & various information online. I read some comments from people who experienced denial & GC issued before 1 year which opens another can of worms.
Your idea of USCIS "holding" your application till 1 year makes so much sense. Would be really nice if USCIS could do such trivial thing to avoid extra paperwork & wait time.
 
Yes you have chance if you see fees were waived within several hours.
I also saw decision was mailed first but after 1 hour I saw fees were waived.
So if it wasn’t changed after 1-2 days then it is 100% referral or denial. EOIR will be updated much later

Hi bro, We have similar case. I applied affirmative asylum on june 24, I did interview on Sep 24. They approved my EAD on Dec 24. I am waiting for my EAD card. But asylum case showing decision pending. If any update let me know.

Today I received my EAD card - 5 years work authorization.
 
We received NOID and have 10 days to reply, right before Holidays‍
Thank you for information! Yes, denial, NOID or referral if no fees were waived but if you have NOID you have real chance to change it for approval. Ask good lawyer to help because it is very important

Can you please give more info about GC? i got my asylum approved in July and I applied for GC in Oct, because in the orientation the USCIS official told us we can apply for GC immediately.
 
To get decision. FOIA is about 2 months waiting
Exactly. Mine just took 2 months.

Instead of receiving the FOIA, I get my approval notice in the mail.
I know from experience being an asylum seeker is hard for two main reasons. First off, for all the things that we being through in our own country. Secondly for all the wait and uncertainty.

My case took 10 years. Seven years to have an interview and three years to have a response after the three months FOIA filed.

So, to all of you out there sometime who might feel hopeless and keep receiving countless of NOs like myself for not having the proper status to obtain certain jobs: keep focusing on yourself, archiving small goals towards bigger ones one step at the time. Stay busy, your day will come before you know it.
