Waiting Asylum decision

Is it true that FOIA request delays a decision? If so, why is that?
I know some say because they have to physically pull your file to be mailed to the FOIA center, however I personally don’t think that is the case. I requested FOIA twice and while monitoring the process, each time the status goes from file requested to file received within a few hours which likely means that the file is not mailed to the FOIA center and rather it is electronically sent.
Can you please share your knowledge about this?

I got fees were waived yesterday while checking my case status. I believe this is a good sign. I also looked up the case number for my dependant and it says card is been produced. After one and a half year the wait is finally over. I'll wait and see how it goes, and I hope you guys that are still waiting will receive good news soon enough.

Hello everyone!
I had my immigration interview in May 2018. Still waiting for the decision. Don't have money for the lawyer tho.... Can anybody advice? Where should I call or go to find out what's going on? Los Angeles...

@seeker512,

This is the 2nd time I am receiving the same message from USCIS through my congressman. i did interview since July 2022

U.S. Citizenship and Immigration Services (USCIS) records indicate that your constituent was interviewed by the San Francisco Asylum Office and the application is still pending.

An asylum application may require additional time to be adjudicated after an initial asylum interview for several reasons including awaiting background and security check results, and/or requiring a re-interview. Additionally, the need to reassign staff to high priority workloads, such as protection screenings for detained noncitizens, may also be a reason for delaying the adjudication. Please be assured that your constituent’s application has not been overlooked.

To ensure your constituents receive correspondence from USCIS and avoid unnecessary delays, they must inform USCIS of any change of address within 10 days of moving. Your constituent may find information on how to report a change of address to USCIS

Why did you waited so long? You should have contact to your congressman or senator for help. Don't waist your time. Send an email to your congressman or senator and ask them to get the decision. You will have to fill out their privacy release form first. They will send you request on your behalf and reply you within one month. If you need more guidance, write in my inbox. Please also share your timeline.

Good morning all!
It’s been a year since I had my interview (Chicago Office). I inquired through the congressional office a couple times: 1st was in March and their response was case is pending background checks; 2nd was in June and their response was case is in the processing queue; 3rd was in July and their response was that case is still pending. Yesterday my attorney sent them an email inquiring about the case and asking that a decision be made, their response was as you see in the attachment.

Please advise what’s your take on their response in the attachment? Do you see that answer contradicts their earlier response regarding the background checks? And what else I should do to get a decision? Your thoughts please….

Hello everyone,
I need a little help to understand when Judge grant your case what happens? Do you receive any letter stating that you are approved? Also after how long you can file travel document and when should you expect. Also is it okey to change your address from NY to texas after approval or it good to stay as it is. As I heard texas is not immigrant friendly state.

Good morning, guys
I have seen some posts saying that you are waiting for a decision on your case. I waited one year for Newark Asylum Office to issue my decision. As my best advice is: call them. Every week. Go there! Try your congressman, anybody from the politics could help. I called them EVERY WEEK. The lady already knew my name and case number. Show them you are very worried and interested. Because of the pandemic, it is ok for them to send you something after one year, but do not wait more than that. One year is time enough for them to get a decision on your case.

Sharing my timeline - Houston office
I Applied for asylum with my wife and our two children as dependents
- 2/3/2017 : Application sent to Asylum office
- Received notice a week later
- Fingerprints about 3 weeks later
- August 2022 : Sent first expedite request to AO only - Rejected by AO
- 1/4/2023 : Sent second expedite request to AO, Congresswoman and Senator
- 3/31/2023 : Received letter from Congresswoman - USCIS approved the expedite request but no date for interview provided
- 7/29/2023 : Received USCIS letter - notification of interview date
- 8/15/2023 : Attended interview with my wife, our two children coming from home country and the 3 children born in the in the US
The interview started around 8:30 with the entire family. The AO asked some general questions to my wife and the two first children and then released them around 9:30. My personal interview started and lasted until about 12:15. After the interview, I and my wife were requested to do fingerprints and pictures.
- 8/15/2023 : Case status changed to Decision is pending
- I know its only been 2 weeks since my interview, but the case status has not changed

Note : current EAD will expire at the end of March 2024. Seeing that the time it takes to receive a decision is not certain, I am not sure when I should request the renewal of my EAD.

Are you checking your status every day?

Any idea how someone can get a police report from the FBI revealing the findings of the background checks?
I need that report to attach to my request to the Ombudsman office to show that my case is held for no reason as I have a clear background checks.
Please guide me if you know the process of getting such a report.

Unfortunately, you cannot get the background report. FBI does not share this report to applicant. So there is no option but wait. You can write ombudsman with your complete situation without that report.
