VSC I-485 RFE Sent and waiting for response TRACKER

Jiang_62 got approved (2/1/05) after 5 day after RFE received (1/25/05). His REF is for EVL pay-stub and W2...his case is EB1 though, don't know if that makes any difference at this stage..still encouraging. Hang on there, friends
 
beneficiary received 3rd FP notice

Today my spouse received 3rd FP notice in mail. It is scheduled for 2/22/05.
Online message shows the same old message of "Received your response..."

We had our 2nd FP in august 2004.

If you check my signature, it shows good LUD changes after RFE Response.
Is this a positive move? I am affraid as it will delay the process for one more month.

Should my spouse go for EARLY FP? He will be going to Newark. Any suggestion for best time for EARLY FP?

Do you think, I will also get the FP3 notice?

Pl. share your views and knowledge.

2nd RFE

first RFE received byUSIS on 12/14/2004, it is about evl, w2, 2 months paystubs and tax resturn.
after waiting for almost 2 months, got an email that says RFE is issued.
what could it be?...........

Do you know what your second RFE is all about? This is the first time I am hearing about a second RFE.
 
no, I am waiting for the letter right now( sent out 2/7 by uscis)
My lawyer moved, hopfully the letter will be deliveried on time.

One way you are lucky they issue 2nd RFE. In my case, they didnt. just they denied case. I asked my attorney what was my RFE. she said its acquisition issue and did not give me the RFE copy, when I requested. so I was believing the same thing. today I received a copy of my RFE from her after asking 10 times, RFE clealy says to proof my legal status from march 2000. Now when I am digging my case details, I understood that, when she filed my LCA, she missed my previous employer information, which I worked for 8 months. the LCA got approved. Then she never told us and filed G-325 A with same information. then they issued RFE in Oct 2004, and she responded in Nov 2004 and she never told me. when I seen my on-line message changed to RFE responce received, on Nov 11th I called her to findout what was the RFE.

She told me that it USCIS is asking about acuisition and she did send Company acquisition entire documention. she did charged me for coping and mailing around $250. my case was denied on jan 28th 2005 statying I was out of status for 8 months.

Today I read the my RFE copy, they did asked to proove for the period march 2000 onwards. she just sent acquisition copy and did not bother for other time. she did not asked me for W2s or paystubs or any other. i never knew what exactly RFE was.

I asked today, why you didnt file at the time of RFE, all W2s and paystubs. what she gave answer you know, she doesnt know, since her subordinate prepared and responded to RFE. and she also said that, the RFE was not clear. they did not asked for W2s or employers letters or paystubs. so they misunderstood and sent only acquisition copy.

Due to her mistakes, I am suffering now. I am filing MTR. Not sure how it goes.
 
Bad attorneys

My Story:

I had 2 sloppy lawyers...first one forgot a document, the new one, cannot
even spell my country (Malaysia), quote wrong amount for filing fee, etc etc.
Not to mention, I've got an incompetent HR person handling my case.

So my solution is:

micromanage the whole process.
Do your own homework and find out what's happening.
Get updates every two weeks, etc etc.

It's your green card, so might as well get into the driver's seat
and control all that you can.
 
USCIS received my reply to RFE (for W2, EVL and paystubs) on Feb 4, then the LCD updated 2/7, 2/8, 2/9. (no message changes, still say your reply was received Feb 4...) 3 days in a row...anyone see similiar LCD updates? or have any idea how long it will take for approval after RFE. I believe my PD is in 2001.
 
my sloution:
i resused to file G28. RFE comes to me directly and the attorney will be forwarded a copy of RFE by me. I am the front end. This was my pre-condition when i hired them. Why should i be at the mercy of someone who is being paid by me? I pay the fee to do the stuff my way!

I feel sorry for the whole mess ,caused by your attorney . I wish that you come out of it ASAP . May be after your approval , You should let other members of the forum know about your attorney's name , firm name etc . That is the only thing you can do . Atleast some one else will be saved .

Those who are in the process of hiring attorney: Make sure that you negotiate everything before you hire them . You are the one who is paying . You should be in the driving seat .

But the problem is, the attorney is currently retained by
my employer i.e. they are paying his $300/an hour fee
for me. Another consolation is, this company is relatively
stable and the job is alright.

For all of you out there, if you're in Boston and need an attorney,
email me about this matter and I'll tell you which law firm to
avoid. I'm just not comfortable putting the firm's name on
this public forum. A couple of my friend's went through
another law firm, and they were done in 16-24 months.
More importantly the fees were reasonable.
