VSC I-140 Denied MTR Sent and waiting for response TRACKER

HI GURUS,
My lud and message changed 6-20-05 on i140 ..opened on BCIS motion.....
But till now no updates on the decision.Can they send the case to appeal even after they open on BCIS motion.Has it happened.Lud on 290a was on 6-21-05.After that no developments.Please enlight ur ideas who had similiar experience.please reply.

If it is 290A, it cannot go to AAO, only 290B is MTR/appeal.sp05 said:
Lets say if it was 290B, once they reopen the case, they usually make a decision on it. I have not seen reopen cases going to AAO. Not to scare you but I did see one (and only one) case where they denied 140 after reopening. In that case they did not even reopen the 485. In your case, if they have reopened both 140 and 485, hopefully it is going to be approved, no sure though and not a guru either

I-140 Denied, due to edu eval Feb 2005
I-290 RD & ND March 2005
Opened I-140 & I485 on MTR/Appeal
I-140 Approved June 2005
F5 ND July 2005
I-485 waiting ????????

I-485 case is not opened till now and no Finger Prints ?????????Mr Erics please tell me do you have any info, how long takes for open file and gets FP of Spouse
also my final quot...... is do we need file for Spouse I-290 B or else do they open after primary applicant
or else do we need to call USCIS 1-800..... cust sevice
what about your case and spouse case please give me details if U don't mine

How to contact DOL to know where the request from INS stands?
Hello Eric,
I have talked to INS regarding my MTR status and they have said that the INS has requested DOL for the Labor Approval Copy. Is there anyway to contact DOL to find out the status on the request submitted by INS and if so, what is the contact number/ email address?

because my spouse did not FP and and they didnot open I-485
but I got FP I-485 re-opend

Not initially, I had to call and request that my spouse case be reopened.

Actually, as your spouse 485 is not reopened, so s/he did not get FP.

Yes, reopened and hence the FP.

I think that they have cosidered the expiration date of my visa as the last day of my lawful stay but my L visa was denied after 8 months of filing my extension and i have filed MTR for that too. during that they approved my I-140. and i applied for I 485. so as such the duration between the denial and filing the I 485 is about 90 days.
can any ond respond?
