Congrats to lucky people who got thru big wall of TSC.
It seems no EB3\'s approvals from TSC recently. Too much random processing. Any idea how much time will take after assigning case to IIO. I am still waiting here EB3(RIR) ND:9/14/01.

How\'s your case? Has the officer reply to your second RFE yet? Its been more than 4 months since my RFE was submitted, and I have not yet heard anything from TSC except that they have changed their message to something like 325 days!!! My attorney and AILA had contacted TSC more than 2 weeks ago, and yet nothing has happen to my case. I\'m wondering if the supervisor is even working!
Please keep me inform about your case. Thanks.

Does anyone know if the processing time of AOS under EB1 is shorter than under EB2? I\'ve just known that my EB1-EA was approved but my lawyer will file my AOS under EB2-NIW next week. I\'m wondering if I need to change my mind.

Issues
At present, no difference between the AOS times for EB-1 and EB-2.
You\'ve got two issues however:
1. Though unlikely right now, EB2 PDs might conceivably cease to
be "current", depending on your nationality.
2. EA is clearly job-independent without limit. NIW is unclear:
although not a lawful practice, INS has often questioned the
continued validity of NIW in case of job changes.
Having the choice, I\'d certainly go with EA.

Of course my company was sold the day before. I have the same job duties and the division of the company that I work for has the same name and location. However, my process was started under the name of the holding company, not the division that I work for. Now that my division was bought from the holding company this could get interesting. I am waiting to see how the lawyer handles this. She mentioned an ammendment to the LC and I-140 is all that is needed. She states that while there is no written law on acquisitions, the INS recognizes that this is the reality of todays job market and are a little more understanding and flexible than in the past. (Did I use INS and understanding in the same sentence? Wow.) I will update the board once I see how this is handled.

I am still waiting ND:9/14/01. EB3(RIR). TSC just published new times with 2/13/02, but there are lot of cases like me still waiting. Whats going on....
