I think that 2 LUD's in 2 days without message change is usually a prelude to approval. Good luck. You may get an approval any time today. Maybe your NC was cleared in the meantime.

it's not that easy

Hi all,

I got a decent job offer. The new company, in a different state, wants me to join within a month. But my I-140 and I-485 were lodged on July 11 (ND) at TSC. I have a FP appointment in the next week.

I may be able to convince to give me another one month (total 2 months from now). I see some people having approval within 2 months. Do you think my I-485 will be approved by that time.

I am not worried about 6 months stay with the current employer for future citizenship issues.

By the way, I am from a non-retrogression country and a naturalized citizen of a western country. My case is EB-2, and I did not apply for EAD or AP.

Would appreciate if you could give your guess estimate.

Thanks a million.

Switching employers right after you get your GC may be considered fraud on your part (lack of intent to work permanently for the sponsoring employer). This won't just affect your citizenship, USCIS may cancel your GC.

I would use AC21 to switch employers before the GC is granted.

doesn't mean much!

I had the two LUDs in two consecutive days a while ago which got me excited apparantly for no good reason :( I wouldn't read much into it if I was you.

I am expecting nothing..

It may be just that they are processing my AP and while processing that they keep on referring back to my I-485 so they both have the same LUD's.

Trust me guys, I am like the guy who gets stuck everywhere, so I am not expecting a quick approval at all...

Cheer Up

Zany,
hope you will hear something good soon. by the way i got my singapore citizenship approved. may be the gc wait is also good :)

In my case AP approval resulted in two preceding LUD changes on all other applications, including an already approved I140.

Since then I have had a separate LUD on both I485 (my spouse and myself) on 7/13 and nothing since (probably either mine, or my spouse name check went through, with another one hanging there).

I will not pay attention to that until ~180 days passed since filing (on 4/17), if it is stuck, not much can be done anyway until an official processing date passed. No need to be anxious. (Though for people with soon to be unavailable visas that sure must suck)

Got LUDs on 485 as well

I got 2 LUDs on 7/26/06 and 7/27/06 on both my wife and my 485s. But the message did not change.

Looks like a system update rather than a manual update after case review.

When I first saw the LUD, my hopes soared a bit as I'm EB2/India but looks like I now have to tuck in for yet another long haul.... :(

Biometrics (Finger Printing) Code

Hi there,

Can any one advise me what is meant by FP Code 3. Is that for a slower or quicker processing ? What other FP codes are there.

Thanks a lot.

I would use AC21 to switch employers before the GC is granted.

Do you have any good info or web links on this? I'm in a similar situation and don't know what's the best: switching jobs using AC21 or wait till GC and swith then? Why switching jobs on AC21 is better?

Code one - just for EAD, code 2 - just for adjustment, code 3 - both. Or something exactly to this effect.

No effect on processing speed. FP are processed same day.

Meaning of Biometrics code 1 2 and 3

Axxe,

My understanding of the Biometric codes is:

Code 1 - Fingerprints only
Code 2 - Fingerprints and Photograph
Code 3 - Fingerprints, photograph and signature.

Usually, the very first Biometrics appt is code 3. Subsequent appts may be just code 1 or 2. And no, the codes don't have any impact on processing times.

Somebody correct me if I'm wrong. Thanks.

Indeed. I listed the purpose, you have listed the procedure. Same result.
