Anyone who has experience with unemployment....???

Well, what can I say......today, I got a sudden notice from my employer that he needs to lay me off by this Friday. Some of my friends are recommending me to file the unemployment insurance benefit in California after hearing the news about me. Is there anyone who have filed that kind of unemployment benefit before? Will it affect my pending I-485? It would be nice if I could use some money from this insurance......but I definitely don't want to mess up with my I-485 either.
 
You will definitely need a good lawyer.....

The recommended step at this moment for you would be filing an inquiry and/or appeal for your I-485. For whatever reason, it is the neglect of USCIS if they didn't notify you nor requested RFE. Unfortunately, USCIS will be very dull to any kind of your request or inquiry. You'd better hire a REALLY GOOD LAWYER. This is the case you need a real lawyer......

Actually we consulted USCIS’s Hartford Center using infopass to know the reason of our I-765-EAD renewal denial which we saw online on USCIS website. Immigration Officer at the infopass said that our I-765 is denied on the basis of I-485 denial at Texas Service Center. The most devastating news is that they said our I-485 petitions have been denied on the following dates:

mine Date of denial: 11/15/2006
wife's Date of denial: 01/26/2006

and we never got any notices by mail and the online status of these petitions show that our I-485 cases are still pending processing. We have always been checking the status of our pending petitions online and also by calling USCIS Customer Service.

We never received any RFE’s (Request For Evidences) on our I-485 petitions. We have always been checking our petitions statuses on USCIS’s website. As of today i.e. 08/28/2007, online status still says that the case is pending.

we are very worried and helpless.

Sorry to hear about this.
If possible avoid taking the benefit for your future citizenship. One of my friend who had his GC refused to take this as he was sure that it would hurt his citizenship.

As mitra said, you should get a VERY GOOD lawyer IMMEDIATELY since this can be really serious. I'm sorry, this is not what we expected when we read your first post. Act immediately, waste no time.

mitra, I'm very sorry to hear that. As bigbang said, I would avoid taking it now. How serious it can be, I don't know. But as you know, I-485 has that question about your past history and future likelihood of taking public assistance. So I would assume it can possibly adversely affect your case (or even if nothing happens this time, you never know about the future when you may file for citizenship). I hope you fill get a next job quickly, and more than anything, I hope you will get your case approved soon.

Hi all,

Those of you who have been reading this thread for a while might remember that I had a 485 application thru lottery in 2003 which was denied because namecheck was not received on time.

I wrote to the first lady a few month ago, asking for her help with my namecheck. I got a letter from FBI today saying that my namecheck request was received in June of 2003 and it is still pending!

As far as I know, namechecks are processed based on A# and since my current application has the same A# as the old one, FBI has to process the old namecheck which was for the old application.

I think there has been a mistake or maybe something has been lost in FBI, otherwise a nameheck should not take this long.

This made me really depressed! :(
 
Here's what you should do right away - take a screenshot and printout of the application status screen which shows "Pending". Then file for Motion to Reopen. You need to find out why your I-485 was denied - most common reason is missed FP notice. If this is the case, it should be easy to get it rectified. And yes:

You need a good lawyer.

Just trying to know more about your case -- you say that your wife's application was denied in 1/2006, yet 1st EAD renewal took place in 7/2006. Something doesn't seem right.

Hang in there. Most likely it is some error that can be corrected. You must seek legal advice.

Check from your previous employer that He revoked your 140, may be that's why you 485 got denied and your ead/ap got denials

better talk to previous employer, even you invooked AC21, previous employer has authority to revoke your 140 and eventually use your labor to another person
because your case has been denied in 2006, i think your previous employer revoked your 140

Try to write a good letter shortm strong and contain all information send it to couple of senators and headquarter of USCIS, hope this may help.
However look at good side of it too, who knows may be now they found that you got there in 2003 they may clean the dust of it and woila.

My friends think that I should be positive about it too. Senators office told me they won't inquire about anything before one year is passed from the filing, I will contact them again in Sept.
 
Well the status changed to the following today:

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Document mailed to applicant.

Does this mean its a RFE?

Folks i got this status change on my I-485 application today. I am not sure what they are talking about. I received my Finger Print notice at the address i live now 2 weeks back. But now these guys are saying that they couldn't deliver it.

Current Status: Notice returned as undeliverable.

On August 28, 2007, the post office returned our last written notice on this case as undeliverable. This can have serious effects on the processing of this case. Please call 1-800-375-5283 to update the mailing address so this notice can be re-sent.

What should i do now? Any suggestion is appreciated.
 
FP2, When? 15 months?

My first fingerprint was done in late June, 2006 (last year) I was told by someone in this forum that I should expect another FP notice 15 months after the first one. So, that means I shall get the notice for my 2nd FP around next three weeks? Have anyone who has similar RD as mine (please see my signature) got his/her 2nd FP notice already? Please share your experience and comments. Thanks.
