TSC Consolidated 485 Tracker

Hi,
I saw that Mike_7 case was approved and his Pd was Sep 2002. Mine is also Sep 2002 and I am hoping to hear the good news soon. Before that how do I check if my name check from FBI has been cleared? What number to call?

Take a infopass appointment to know the name check status. My name check was cleared :D

I have the same meessage change but not received any thing.....but I had a an address change request and they mailed my finger print notice that went back to sender and with new postal address and I received that later.....but still that happened a week before this message change.

Any idea....????

Did you mean June 2002?How do you take infopass appointment? Does it help? Does both husband and wife have to go for it?

We just realised that I was out of status for more than one year from
April 2001 to August 2002. Here is what happened.

Entered US on H4 Jan 2001, Husbands H1 was valid till April 14th 2001,
So I94 was issued till April 14 2001.

Husband's company Applied for his H1 Extention and didnt apply for my
H4
( not sure about this, its an assumption as I dont have H4 for this
period, and I can't verify, the previous company and the attorney's
office doesn't exist anymore).

Husband got H1 approved. We were under the impression that If husband
is
in status, I am in status by default.

We send our passports to St Louis for Visa stamping in October 2001, we
got the visa stamped on December 14, 2001.

Husband changed employer in August 2002. The new employer applied for
Husbands H1 and my H4. The date on H4 approval is August 2002 to April
2003.

I travelled to India in October 2002, and came back in Jan 2003. I have
maintained status since. Also, I travelled to India and got my Visa
stamped in July
2003 ( Validity july 2003 to April 2004).

so, I was out of status from April 15 2001 to August 2nd 2002 ( H4
approval date ) or October 10 2002 ( date I travelled outside of usa).
This is not clear, either way it is more than a year.

Also, I have travelled on Advance parole in Nov 2004 and Dec 2006.

The RFE is asking for legal stay in USA. Not sure how serious this is ?

Will they deny my I485 ?

What happens if they deny my petition ?

Any thoughts ??????

That is what I would do too. Get everything in writting! Send them a letter before NOID deadline explaining your recent conversation with the officer; it is very important that you get a delivery confirmation!

You can certainly do a walkin once you receive the FP notice, but without it I'm not sure if ASC is able to take you. Worth a try though.

Today I called up Customer Service and could get hold of a service rep ( could an immigration officer) she was very kind and understood the problem quickly and said she would issue another FP notice to the same address (which is correct) and advised me to go for a walk-in at ASC. Also she said she would send an e-mail to the officer who issued the NOID about the situation.

But probably I will have to respond to that NOID anyway..

I noticed that you are desperately looking for advice from this forum with several posts. I sincerely recommend you to consult a good immigration lawyer. It would save you a lot of pains later on. Good luck.

I just registered, but have been watching this forum for a while.

First of all I have a question:How do you get your name cleared before applying for I-485?

And second, this is the first time I hear there's any connection between the PD and processing of AOS. Maybe I'm wrong, but since LC is processed by DOL and AOS by USCIS, I never saw any connection once your PD allows you to apply for AOS. I know people with 2006 PD (EB2) that already have been approved. You could be right, but I'm curious to find out how do you know this.

NC is initiated AFTER you apply for I-485. Typically a few weeks after they receive it.

I did hear there may be some soft of security check thingy for I-140 as well, but if there is I don't believe it's anything to do with NC for AOS.

And second, this is the first time I hear there's any connection between the PD and processing of AOS. Technically and theoretically, you are right. Who knows what is ACTUALLY going on inside the CIS, though ;)?

Seriously, it's abundantly clear they don't even TRY to follow FIFO. There are so many variables at work behind (including their incompetence), so it's really hard to identify whatever pattern, if there's any. The best you can hope for is you won't be stuck in NC, which in most of the time is the hardest part when it comes to your processing time.

Just got CRIS e-mail that my I-485 has been approved......

I would like to thank all the members and the host of this imazing forum/concept. It has been a long and very frustrating journey but it got paid of today....

Choose #1, that is you wish to discuss with IO.
Ask for Name Check (they know as background check), FP Results and verification of your mailing address .

i believe some addresses were screwed by USCIS during the transfer (VSC->TSC) process. I got a confirmation of my address change on Mar 2007 but a notice sent on May 4 2007 went to my old address and returned :mad:

Congratulations! Although you are officially not from the pool of applicants that became current on June 1, but it's nice to see an approval today.

Yes, I've seen several folks in this situation, myself included. My wife's name check was cleared in about 3 weeks. 14 months on, I'm still waiting.
