Also, provide the info as detail as possible about your previous history (I mean, before your last trial). That will tell other folks here better idea of your situation.

Also, trying administrative effort (including contacting congressmen, FBI, first lady, etc) should start after 6 months of I-485 application (RD), not PERM, not LC, not even H-1B. We all have certain amount of history for this immigration process, most of them several years. However, from FBI and USCIS side, I-485 RD is the only number that counts. Mentioning that "I have been through this process 7 years (or 8) and should be treated better" when your I-485 RD is within 6 months is meaningless. Fortunately, your RD seems just out of the timeline and you could start this so-called ADMINISTRATIVE EFFORT.

Also, I'd like to mention (not just to you, but to everyone) that WOM is still active at this time. I have seen a few friends of mine who filed WOM and got their I-485 approved last week. USCIS surely is trying to divert us away from WOM, but it seems active at least so far. So, if you I-485 RD is way beyon one year or something, consider this WOM, too. As you can see, my RD is just about 10 month and I am planning to start my administrative effort from now, and hopefully file an WOM may be this coming August (after an year).

If you really want to go back I have been in the GC process since 1987. Aged out thru parents (now USCs), then file lost, then atty died and file got denied due to not respnding to RFE/abandoned and the list goes on. Those days there was no website/LUD/forum and alike. Have been in this country since '98 and working and publishing since..... This is only the last attempt at it.

I just came to know that my FP has been cleared and FBI sent back the results to USCIS. Does it mean name check has been cleared?
 
My congressman also agreed to check on my FBI NameCheck status with FBI directly. Hoiwever they said me it takes about 30/45 days.

I am stuck in namecheck, and I wrote to a couple of my Congressmen (about 10 days ago) to help me out. Both of them contacted me today - one through email, and the other through regular mail.

One of them told me that they have placed a "congressional inquiry" with USCIS, and will let me know once they hear back.

The other Congressman told me that they have requested FBI to "expeditiously process" my case. (He also attached a copy of the letter that he faxed to FBI).

Here's my question: How long does it take from the time a Congressman initiates an inquiry to the time the case is resolved by FBI/USCIS?

Does anyone have any anecdotal experience to share?

I-140: ND: July 2006; AD: Aug 2006
I-485: ND: Oct 2006
 
I made an Freedom of Information Request to FBI based on suggestions from this forum April, 2007. I got a response from FBI last week, informing me that there is no record that match my request. What does this mean? Thank you!

Freedom of Information and Privacy Acts (FOIPA) requests are sometimes confused with name check requests. FOIPA provides copies of FBI files relevant to a specific FOIPA request. For FOIPA, the FBI search uses the name or information as provided in the FOIPA request. A FOIPA search determines whether there is an investigative file associated with an individual—a "main file" search. For a name check, "main files" and "reference files" are both checked, in an effort to protect our national security, in addition to searching a name in a multitude of combinations.

Who can I call to check on the status of my name check?

The FBI will only respond to status inquiries from its customer agencies. Please contact the organization receiving your original application. In Citizenship and Immigration cases, contact USCIS for the status.

As you can see the thing that gets most people grounded is the search in reference file with multitude of combinations of applicants name.

it seems that TSC is back behind. on may 18, they are processing sep 15 2006 whereas on april 18 , they were processing october 14. it measn they went back. how efficient really they are.

We were waiting for the new update to get past the line so we can place an official inquiry. Well at least though, this backward move matches our observation here that TSC has been slow for quite a long time. Honestly, I was sorta surprised that they still claimed a month ago they were moving forward (with a phony update date).

it seems that TSC is back behind. on may 18, they are processing sep 15 2006 whereas on april 18 , they were processing october 14. it measn they went back. how efficient really they are.
 
Man this sucks! I've been checking the processing date every day for the past two weeks getting ready for an infopass, and it moved backwards! Now what is USCIS going to do when a flood of new applications will be pouring in next month? Their processing date has always been fishy and doesn't mean much anyway, but at least it gives out a chance to place an official inquiry before more dramatic actions are taken. Run out of words to describe them.

Unfortunately no. FP is usually processed within 24hrs, meaning you have no criminal records on file, but it has nothing to do with name check.

Read it on another website that the director at TSC will change soon. TSC has been better than other centers in many aspects, and hopefully it will not go the other direction afterwards.

Yes, and this really undermines the validity of this dates. How can they have gone thru Oct of 2006 last month and now they are back to sep. 2006. They found a pile somehwere. Alas no infopass/status inquiry for me for at least another two months. Granted I am not sure if any of those would have had any real result.

Unfortunately no. FP is usually processed within 24hrs, meaning you have no criminal records on file, but it has nothing to do with name check.
 
The processing dates moving back for I-485s was bound to happen given the flood of applications from VSC/CSC. At least they are not posting deceptive dates - the question is, what happens next month with the flood of I-485s coming in from the priority dates moving forward. My guess - they'll be frozen, just like they have been for Nebraska for the past few months now.
 
The approval notice email and LUD on 5-10-07 and the Post mark date on Card notice is 5-12-07
The card mailed LUD and email on 5-14-07 and the Post mark date on Approval Notice is on 5-14-07.

I just came to US today, so not sure when the card is actually delivered but my friend checked my mail at home on 5-17-07 and card was received but not the approval notice, and he sent me the card to India. So, I received the card first and then approval notice. Also, the card is valid from 5-9-07 to 5-9-17.

FBI Name Check

Hi Guys,
I appplied for 485 in June 2004 and was stuck in priority date retrogession . Now that the days have moved I was hoping my application would be approved. I was called for second FP on may 8th 2007. How do I find out if my FBI name check has been cleared. The other day i called TSC and the lady said she does not have any information.
Can someone provide me with advice and also the numbers to contact for FBI name check.

Did you guys notice that USCIS was processing Oct 14 2007 for I485 employment based category. Now they are processing Sep 15 2007. Went back by 1 month!!!!!!!!!!!!!! As EB3/EB2 for different countries priority date jumped by 2 years in last one month, its the side affect of that. Theoretically it should go back more. Because there are more than 15k I485 will be filed in next 15 days whose priority date just got current.

I would suggest you to checkback this friday with the congressperson. I will and lets see what reply they give. Normally my congressperson would call me if there is any information. Let me know how it goes for you.

Hi Everyone:
My RD for I-485 is 10/31/2006. With USCIS processing dates retrogressed, when do you think they will move forward. Do you think it will retrogressed even more next months?
 
just 15k..............i am estimating around 75k new 485 applications will be filed......not to mention EAD and AP applications..

maybe its collection time for USCIS to get some new funds.....and of course they dont care about the rest since we have already paid.....(they dont care if all these madness adds 3-8 months for no reason to our processing time)
