Today I got up at 5:30am and drove 150 miles to have an infopass. Just to get the information of whether my case is pending because of security check. I was hoping that I can know when they initiated the security check. However, the officer is very rude and keep telling me that the processing time is just for reference. All she can tell me is my case is pending which I already know. I asked her to initate an inquiry, she won't even do that. She just tell me that an employee-based case usually tooks 2 to 3 years and my case is only pending for 6 months. She even said that I have answered your question and you can leave now!!! After she humiliated me, I drove back. On my way back, I get more and more angry and decided to drove back to the office and file a complaint. I met her on the hall and she asked me now what else? I said to her that I want to speak to her supervisor. She took a long time to get her supervisor (I think she explain to her everything so that her supervisor is already on her side!!)
Even though the superviser appeared, she said the same thing that all they have is the case is pending. I told her that other people can get the security check status from infopass. She won't answer my question but just said that every case is different and she can only let me know that the case is pending.
I finally ask her again: So you mean you don't access to the information of the status of my security check. She said yes. Then I know that I can do nothing. They won't help me at all.
At the end she even told me that she is very busy and don't have further information for me. Then I said there is one more thing. I would like to file a complaint. I feel being humiliated. Then she just told me that I can drop my commands into some cards. This is useless.
I have decided to write letters to the head of USCIS and file a complaint about this. How do you think?

maybe we should record one such conversation, edit the personal info and put it up on youtube. Then we can send that to Gonzales and other lawmakers and tell them what POS agency USCIS is.

I sent a letter today with all the evidences to TSC explaining that my case is employment based and not asylum based. The rep that I had talked to in the morning also said that she was going to notify her supervisor to correct the classification. I will check back in 2-3 days, if they haven't fixed it by then, I will go to infopass appointment.
Anyway, I opened another referal with NCSC just now. I am not gonna let those guys sit on my case forever, but I am gonna keep doing all I can, until they approve my case.
ya sure it is within the processing time if they considered ur case as asylum case and not employment. try to fix the asylium thing as soon as possible.

if u can take an infopass soon just do it in either case, a friend of mine had a smailar prob , she was waiting for like 9 months and then suddenly after doing an infopass she knew that her application wasn't sent to the right center. 9 months waiting for nothin just because the fuile is ina wrong place. so go infopass.

Somehow I think, that they screwed up my classification on purpose, that too very recently, because I have been on their back so badly. I say this because when I had infopass on Feb 6, the immigration officer didn't mention any of this asylum BS. Also in the letter received from the senator's office, they said that my case was at the last stage of adjudication, and I should receive a decision in 3-60 days.
But you are right, I should book an infopass appointment in any case. Thanks buddy.
 
To those who are seriously thinking of filing WOM:

You can still file WOM, but now they're going to fight it. Think again - you'll be fighting the US GOVERNMENT. Better get a good attorney. Also, remember you are not a US citizen, not even greencard holder. If they find even a small discrepancy in your record, they can hit back hard. So yes, you can still file WOM but the risks are higher now. Good luck!


Well, its not completely closed. The memo could be an effort to discourage people to file it. I know somoene who filed it earlier this month and got it approved. Those of us (including myself) who are more than 2 months past due (case in May 2006 or prior) were fool not to file WOM earlier. I know someone who had it only 1-2 month past due and filed WOM and got it approved. Now USCIS has officially accepted that it used to expedite name check after WOM. It may be too late for lazy fools, including myself :-(

By the way, the memo says "no longer routinely expedite", the keyword being "routinely", meaning they may still expedite it, but not all the time :)

Long time since last I "saw" ya... Have you ever tried infopass?

My case (primary) got approved on 2/1, whereas the spouse's is still pending though it's still within the official processing time. At any rate, we are going infopass next week about the case. We had some trouble when submitting the spouse's I-485, so we just want to make doubly sure if CIS has everything right in place.

Before the approval, my pattern was exactly the same as yours. The RD is 9/29, and the only LUD is 10/3. There was nothing whatsoever until the approval. I suspect that in your case, no LUD may mean everything is all fine other than security check. It's probably ready to get approved on the CIS part but FBI gets in the way.

Let's cross fingers and hope everything will work out around the processing due time.

I have same RD as well as LUD as you and I have not got the approval yet.

Thanks RJ...I am planning to initiate an inquiry through my attorney..recent posting says one July case is approved..Not sure what's going on with our cases.

I have booked infopass appointment for March 12. Lets see what they have to say. I am so tired of USCIS giving false excuses for its inefficiancy.

I have a question. One of my colleague called USCIS, I don't know the whole conversation. But instead of pressing 1 2 2 6, he pressed 1 2 6 and the USCIS representative asked him about his current address, phone number, email id, alien number. He told him that he wanted to do status enquiry because the case is beyond processing date.
Why USCIS would ask his address, employer address etc information?
Any clue, as he is getting worried.
 
To open a referal or enquiry, they need all that info, but I am sure they don't ask Employer address and email. May be the rep was trying to confirm that he was who he said he was.

So on opening a referral or inquiry, would there be a LUD. I checked with him his case account, but still there is no LUD.

I opened an enuqiry in the middle of Jan and get an mail saying my case is with in processing time. Also got an lud on 2/14. As per I remember your RD is same as my RD.
 
They use these information to check whether the application belongs to you or not, they did ask for my Social once, which i gave like a fool and i had to beat around the bush by calling a lot of people with in USCIS to confirm whether it was safe or not. atleast your friend didnt dosclose his social numbers so i dont think he should be worrying.

sk0902 - Yes, my case has similar RD, filed around end of June. I already asked my lawyer to raise inquiry for my status. Because when I called in January, USCIS told me to ask for investigation after 30 days if there is no case status change.

The conversation with USCIS was happened between one of my colleague and USCIS, his case is filed around July. He got worried about his conversation because they asked him about his address, email, phone number and alien number. He did not have alien number in his hand. I told him that USCIS never asked me all these details, so I created more worry for him.

So I am trying to clarify for him.
