Transferred to Local INS office in Washington -Aug 15th RD

Hi H1Blayoff,

Thanks for appreciating my aggressiveness. But i did mistake not show aggressivness about the name check before my Adjustment of Status Interview held yesterday. That's causing me further delay. I know even if i don't do anything i will get in 4-5 months time.

I am trying my best if can get within 1-2 months time. I just now could successfully fax the request to Mr. David Hardy.

These are the following actions i have taken

1) Emailed Emily immediately after the interview yesterday afternoon. She in turn sent an email to local office to find the status whether they receive the status or not? Based on that she said will followup with FBI and Congressional Officer.

2) Yesterday night i emailed the request of name check status to David Hardys office email address.

3) Next today morning i did send Fedex Overnight to Mr. David Hardy's office enclosing the request of name check status for me and my wife. Explained in detailed how it delayed my approval etc.

4) I spoke to Lynn Ransake the specialist who handles Judicial Issues for Senator George Allen's office and explained her the situation. Waiting to hear from her.

5) I could succeed to fax Mr. David Hardy's office the same request i fedexed today morning.

That's all i can do guys. People can try all these options. Adnamj, WellWisher2002, Zkhan,PeaceInSpirit do u guys think i did all possible options?

Also including a good pdf file someone provided related to name check status. I hope this would help everyone of us in this group.

wonderfulboy, You are doing wonderful job, really you are keeping lot of efforts.May be I can't do if at all will happen to me.

God is great, good things are on your way..
I know it is to say..but just feel you are in better shape than me at least.

I have a question, is this Security check is common to all the cases or they just pick some from the bundels...

Hi save_intvu,

I believe in my hardwork thats all. I don't believe god so i don't leave things to a hypothetical saver called god. Sorry if i hurted you by saying it. Its my belief.

I think now a days all the people are going through this hurdle Name check. Its my understanding though. Even for people who get the approvals straight way from Service Centers also it will be verified.

Basically it is check whether you are involved in any of the terrorist organizations etc. Why would they exempt any one for that and take risk?
 
When in the process they send to Name/Security Check

I am just curious

1. when do they actually request Name/security Check from FBI?
...Is this just after FP or after getting every thing ready for approval or..when?
2. How much time on average it is taking for Name Check.
....
3. Do they really check for every body?
...Because I heard some people got approval in less than 6months.
4.Where do they really send this request?
4.1 Is this to centrally FBI managed service center or local FBI service
center?

No news from you? What are you doing with your Name check stuff?

Its pain to wait in the dark without knowing what's happening exactly.

We suffered it when the case got transferred. I never expected that it will repeat again guys. Its really unfortunate.

Till 2nd Finger Prints my case went very smooth. After the case got transferred all the rough roads started.

I contacted my lawyer, she said she will try to contact FBI since my name check has been pending since October 2003. The officer H I interviewed with showed me the paper about my name check, it shows that my name check was required on 10/03, and the status is pending. My husband's name check was required at the same time and got back with No Record within a month. So, I am really frustrated. I also send a certified mail to Mr. Hardy at FBI, and an email to Ms. peterson at senator Warner's office. Do't know which one would work. I am also thinking to go to the local office to ask them check the status once a month, which was suggested by officer H.

Do you know if there is any place we can complain about this? It's really rediculous to have a name check pending for more than 15 months. I also heard from senator's office that someone's name check has been pending for more than 3 years.

In your case lot happened atleast that your name check is pending from 10/03. In my case i don't have clue what happened and what situation it is in. My lawyer (great Mr. Rajiv S. khanna) doesn't or never tried to call the FBI to find out the name check. i did sent an email to them in October 04 during the time of waiting for Interview letter. No response from them.

In yesterday's interview the officer who doesn't have good background about Adjustment of Status cases said he plainly said he doesn't have the name check status for me.

I don't know it does mean he doesn't have it or Fairfax office didn't receive completely the name check status. He is very ignorant.

But one only thing he said is don't worry i will let you the status by calling you. He took my mobile number. He said normally it takes 160 days but in your case since i have all the documentation it will take less than that. God knows what he mean by less.

Yesterday Emily sent an email to local office to find out whether they have the name check status for me at all or still waiting from FBI. Then based on that she will enquire with FBI. She didn't get response to her email.

Mean while i have resent the enquiry email yesterday night, Requesting Letter to Mr. Hardy through fax and also through Fedex today.

Mr. Rajiv Khanna is not taking any initiative to find out with FBI being my lawyer. They are very lazy guys.

What do you mean by going every month to local office and check the name check status?

You need infopass appointment for that right.

If not do u go inside everytime by showing the interview letter which we got yesterday or what?

But if it is through infopass appointment it is not that easy to get infopass appointment right?

I suggest you to try to get an infopass as soon as possible. The officer interviewed you seems know nothing about the name check. Actually, it's just a minute thing for them to get the status of your name check. Officer H did it on her computer for my husband's. Originally, she did not have my husband's name check status, because he was not scheduled to be interviewed on that day. But then I told her my husband flew to here for interview, so she helped to locate his file and said she would waive his interview and checked his name check status. SHe also told me for those has been interviewed, their files would be put aside, and their stuff will check the name check status once a month, and if yours shows "no record", your case will be approved, and your approval notice will be sent out. That's why officer H suggested me check with them once a month, just in case they ignored your case. So, the local office is the place to know the status of your name check, and if it's pending for a long time, you may need to contact FBI. That's why you still have chance to be approved right away, maybe it's just because the officer forgot to print that out, and he does not know what to do.

The officer i have been interviewed. They did expand my middle name. He asked me to give the full form of middle name. He corrected that on a paper out of my application. Then asked me to give the city and he wrote it. Then in the application there are spelling mistakes for my father and mothers name. He corrected them.

After that hardly for 1 minute he typed in something. But later some other lady came in. He said i don't have some IBxxx number to that lady that's the reason i dont have security check for my case.

Then he told me that i cannot approve your case today because i don't have security check info of you.

But i remember he typed in something just for 1-2 minutes in his computer. May be that may be this one as you said may be. I am not really sure.

I will try to take an infopass appointment and then see what will happen.

But tell me onething even if we take infopass appointment. The officer at the window will not run our security check there and tell the status right. They will say the officer will contact you as and when he has security check information. Don't you think so PeaceInSpirit.

I don't know what will happen if we take the inforpass to ask for the name check status, but I will take the interview result officer H gave me, show him the reason and ask for the status. Since it's just a minute thing for them, if we are lucky, he/she probably would do that.
 
I have not been given any result after my interview at all PeaceInSpirit. What kind of result the officer to you.

That's the reason in my case its even difficult. I don't have any proof at all.

You don't need any proof. Just go with your I-485 receipt notice. They will check the status on thier computer and tell you whats going on. When I had been to the local office, there were couple of couples who had come for the same reason...status check.

Just get an Infopass appointment and visit the local office.

Office H gave me a piece of paper, which says that my case is continuing because the name check is pending. So, I can just ask them if they can check the name check status. I think you don't have to have this, just go ahead to check the status, and you can tell them the interview is done, the name check status is not known.

Hey that's good news. I can go and ask them to find out the status of name check in INS location.

But is that a mandatory situation to have Infopass appointment. Its great difficult to get Infopass appointment.

Meanwhile we applied for our EAD and AP on October 19th 2004 and they are transferred to local office. EADs for me and my wife are expiring by February 10th 2005.

Though i am not working on EAD my wife is working on EAD. She should get EAD before 10th February. if not thats a problem. She should stop working. What's the procedure to follow?

After 19th January will complete 90 days shall we take appointment and get the EAD's and AP?

How did it work with local Washington DC Office?
 
This is my exp. on EAD Renewal,

I am working on EAD, Applied on 10/28 , moved local office on 11/11 and i took app. for 12/20 , they lady at counter appoved EAD w/o asking any questions,and asked me to collect on 12/29 and i did it.
My current EAD is expiring on 1/25/05, so the lady at EAD collecting center changed start date(to 1/26/05) and end date on NEW EAD.

Take an app., no need to wait for 90 days then you can collect following wed'day or week after.

I havn't applied AP with my EAD, but I beleive it has to be appoved same time
You Just need one app. for you and your spouse for both EAD and AP.
