In fact, in my case, attorney never got reply to the first email. So, we dont know whether PW will be higher or lower!

This prevailing wage thing is really messy over there. They are so unknowlegable. In short, we recruit and send in the package using the higher wage they gave us since we've never heard back from them. My lawyer called them numerous time till yesterday, they admitted that they use wrong database for my case to determine pw. The wage got a bit lower but still higher than the state one we got and we plan to appeal back.

I have neither received an acknowledgement nor prevailing wage determination from the BEC yet. We did send the conversion package in December and a duplicate again in March. In spite of numerous attempts by the lawyer via email, fax and phone, BEC is not forthcoming on the current state of my application. With April 1 deadline already here, will this pose a problem? Is anyone in a similar situation? My status is still "TR in process".

The April 1 deadline is relevant only if you sent a "hold harmless" email under the December FAQ. If you submitted RIR conversion under the October FAQ, you need not worry about the April 1 deadline. Did your lawyer sent the hold-harmless email request? How did you determine the prevailing wage?

My status just changed to "Certified" but it still shows TR instead of RIR even though I filed for RIR Conversion.

So can I apply for I-140 Premium processing now?

Yes, as soon as you have your certified LC papers (you need hard copy of certified labor for premium). When was your TR-RIR conversion package submitted? Was it Dallas or Philly?
 
RIR conversion package sent on Mar 30th according to lawyer.

Now we'll see how long this takes.... :rolleyes:

They used to get approvals in just couple of weeks until Januray.
So... Its slowing down. Everybody might have converted to RIR !!
I think they have to start couple more BECs to clear backlog centers' backlogs, if they really want to meet the Sept deadline !!

Yeah, I can see your frustration. I keep checking my status 4 times a day. It still shows up as TR even though I have sent the RIR conversion package on 3/14/07.

So... Its slowing down. Everybody might have converted to RIR !!

TR->RIR Certified

I am glad to share the good news that my case now shows as CERTIFIED online, my lawyer just sent me a email about this, they did not receive any official conformation yet. Couple of things though..

- Firstly the case shows as TR certified, not RIR certified (others have mentioned on the forum earlier). I am guessing we should not read too much in to this as long as it shows certified.

- Secondly, I am pretty surprised by the timing. It has just been about 10 days since we applied for conversion (03/27/2007). I will keep my fingers crossed for a couple of days to see if the status stays certified.

Good luck to all of you guys, I have been a silent reader of this forum for over a year, it is amazing to see the enthusiasm of the people here and their willingness to help. Hope to see tons of approvals soon, hope we all move to the next stage ASAP and lets not loose hope.
 
DBEC Active on TR-RIR Conversions, PBEC is Not

People with TR-RIR Conversion cases at DBEC are reporting certifications, some as quickly as within 2 weeks of submission of conversion package. Of course, as always there is readomness as some folks have submitted their packages to DBEC much earlier but haven't seen any progress.

PBEC on the other hand seems to be completely silent on TR-RIR conversions, at least as reflected by feedback from members of this forum.
 
My labor PD OCT 2002 NY EB3 PBEC. It was applied as RIR but online shows as TR and IN-Process for a long time now. Lawyer has re-sent the RIR documents back to PBEC and I have also sent emails asking to change to RIR. Also, the online screen status shows as PW. I do not know what this means. I have also not received NOF yet. It will be really great if you can give some suggestions/tips on how this issue can be resolved. Thanks in advance.

Just like you, we resubmitted the conversion again as a duplicate. I think there are some unlucky few like me and you who are still waiting for the DBEC to release us from this torment.

DBEC certainly has a history of looking at mail in the reverse order it was received. Last year a lot of folks who received their 45-day letters in the Jun-Aug timeframe got their cases approved earlier than those who had received and replied to the 45-day letter much earlier. Overall, DBEC still has a better track record than PBEC.
